RESOLUTION
RE: AMEND RECORDED EXEMPTION #2474 - MOTLEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 7, 1999, the Board of County Commissioners approved Recorded
Exemption #2474, for property which is located in part of the SW'/ of Section 24, Township 4
North, Range 61 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, the request to the Board of County Commissioners for review of said
Recorded Exemption #2474 was submitted by Roger and Jo Motley, 47527 Highway 34,
Wiggins, Colorado 80654, and
WHEREAS, after review the Department of Planning Services staff recommends
approval of the request to divide the property into parcels of 80 acres and 50 acres, as
described in the deed submitted by Roger and Jo Motley, and to allow a change in the
configuration of Lot A to lie approximately in the center of Lot B along the south side of the
property, and
WHEREAS, after hearing the testimony of those present, the Board deemed it advisable
to amend Recorded Exemption #2474, as stated above.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Recorded Exemption #2474, for property owned by Roger and Jo
Motley be, and hereby is, amended as stated above.
BE IT FURTHER RESOLVED by the Board that the applicant shall submit to the
Department of Planning Services, an amended plat showing the lot lines as amended, which is
ready for recording in the Weld County Clerk and Recorder's Office.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 20th day of September, A.D., 1999.

SUBJECT: Recorded Exemption 2474
Recorded Exemption 2474 was approved by the Board of County Commissioners on June 7, 1999.
The applicants, Roger D. & Jo A. Motley have requested changes from what they were originally
approved for. The Weld County Attorney and Planning Staff concur that these changes must obtain
the approval of the Board of County Commissioners.
The Recorded Exemption was applied for on property described on the deed as the east 50 acres
of a 130 acre parcel. At the Board of County Commissioners hearing Mr. Motley explained that this
was an error, that the deed should describe the west 50 acres. Condition of Approval 2.G. was
added stating "The applicant shall submit recorded deeds correctly describing the 80 acre and 50
acre parcels." Mr. Motley has submitted a new deed describing the 80 acre and 50 acre parcels.
However, the split is not consistent with what was indicated at the Board hearing.
The second change was to proposed Lot A. The lot was originally applied for as 5 acres in the south
east corner of the parcel. Mr. Motley would now like to change the configuration of Lot A to lie
approximately in the center of Lot B along the south side of the property.

RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #2474 - ROGER AND JO MOTLEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat
known as Recorded Exemption #2474, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #2474 was submitted by Roger and Jo
Motley, 47527 Highway 34, Wiggins, Colorado 80654, for property which is located in part of
the SW% of Section 24, Township 4 North, Range 61 West of the 6th P.M., Weld County,
Colorado, being more particularly described in the plat which shall be provided by the applicant
and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 45 acres and 5 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is,
exempt from the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2474 by Roger
and Jo Motley be and hereby is, approved, conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic
system shall be installed according to the Weld County Individual Sewage
Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. Lot A shall utilize the existing residential access. No additional accesses
shall be granted.
B. In accordance with Weld County Ordinance #180, Lot B shall be granted
one residential/agricultural access from Weld County Road 42.5. No
circle drives or additional accesses shall be granted. The access will be
placed in such a location as to have adequate sight distance in both
directions and not below the crest of a hill or where physical obstructions
are present.
C. All approved accesses shall be clearly shown on the plat. The applicant
shall contact the Weld County Public Works Department to determine if a
culvert is necessary at any approved access point. If a drainage culvert is

required, a 15-inch CMP is the County minimum size. If the applicant
chooses to place a larger culvert, please contact the Public Works
Department to adequately size the culvert.
D. Weld County Road 42.5 is designated on the Transportation Plan Map as
a local gravel road, which requires 60 feet of right-of-way at full build out.
There is presently 60 feet of right-of-way. A total of 30 feet from the
centerline of Weld County Road 42.5 right-of-way reservation shall be
delineated on the plat.
E. State Highway 34 requires 150 feet of right-of-way at full build out. A total
of 75 feet from the centerline of State Highway 34 right-of-way
reservation shall be delineated on the plat.
F. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum
setback and offset requirements for the zone district in which the
property is located. Pursuant to the definition of setback in the
Weld County Zoning Ordinance, the required setback is
measured from the future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate
zoning and building permits.
3) Staff supports this application for Recorded Exemption; however,
subsequent Recorded Exemptions on adjacent properties will
raise the issue of compliance with the intent of the Recorded
Exemption process. Approval of this Recorded Exemption does
not guarantee approval of future applications on adjacent
properties.
4) Prior to the release of building permits on Lot B the applicant shall
submit evidence to the Department of Planning Services that the
lot has an adequate water supply of sufficient quality, quantity and
dependability.
5) Prior to the release of building permits on Lots A or B, the
applicant will be required to submit a recorded deed describing
the lot upon which the building permit is requested with the
building permit application. The legal description on such deed
shall include the lot and Recorded Exemption number.
6) Should noxious weeds exist on the property or become
established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Ordinance #169-A.

G. The applicant shall submit recorded deeds correctly describing the
80-acre and 50-acre parcels.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall
be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days
from the date of approval by the Department of Planning Services. The
applicant shall be responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

The Department of Planning Services'staff has reviewed this request and recommends that this request be denied
for the following reasons:
1. It is the opinion of the Department of Planning Services' staff that the applicant has not shown compliance with
Section 11.4.2.1 through 11.4.2.6 of the Weld County Zoning Ordinance, as follows
a. Section 11.4.2.4-Consistency with the purpose of efficient and orderly development as expressed in Section
1.3 of the Weld County Subdivision Ordinance 173-E.
1) Section 1.3.8 ensures securing equitable handling of all subdivision plans by providing uniform
procedures and standards. By not including the entire original 130 acres as required by Section 11.8.7
of the Weld County Subdivision Ordinance, the applicant is attempting to create more than the two lots
he is eligible for.
b. Section 11.4.2.5 - Compliance with the recorded exemption standards set forth in Section 11.8 of the Weld
County Subdivision Ordinance 173-E.
1) Section 11.8.7 states: "The recorded exemption application shall include the total contiguous land
ownership, except in the A (Agricultural) district. In the A (Agricultural) district when a contiguous
ownership equals at least twice the minimum lot size (160 acres), or a parcel otherwise recognized as
a complete quarter section, a portion of the lot equal to the minimum lot size (80 acres) may be used
in the recorded exemption application. The fact that the applicant has conveyed,within the last calendar
year, land which would have been considered contiguous had it been retained, may be considered as

Should the Board of County Commissioners approve this request,the Department of Planning Services'staff
recommends the following conditions be attached:.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to
the Weld County Individual Sewage Disposal System (I.S.D.S.)regulations.
2. Prior to recording the plat:
A. Lot A shall utilize the existing residential access.No additional accesses shall be granted.
B. In accordance with Weld County Public Works Ordinance #180, Lot B shall be granted one
residential/agricultural access from WCR 42.5. No circle drives or additional accesses shall be granted.The
access will be placed in such a location to have adequate sight distance in both directions and not below the
crest of a hill or where physical obstructions are present.
C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public
Works Department to determine if a culvert is necessary at any approved access point.If a drainage culvert
is required,a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert,
please contact the Public Works Department to adequately size the culvert.
D. WCR 42.5 is designated on the Transportation Plan Map as a local gravel road,which requires 60 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline
of Weld County Road 42.5 right-of-way reservation shall be delineated on the plat.
E. State Highway 34 requires 150 feet of right-of-way at full build out.A total of 75 feet from the centerline of State
Highway 34 right-of-way reservation shall be delineated on the plat.
F. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the
zone district in which the property is located.Pursuant to the definition of SETBACK in the Weld County
Zoning Ordinance(Ordinance 89,as amended),the required setback is measured from the future
right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) Staff supports this application for Recorded Exemption however subsequent Recorded Exemptions on
adjacent properties will raise the issue of compliance with the intent of the Recorded Exemption
process.Approval of this Recorded Exemption does not guarantee approval of future applications on
adjacent properties.
4) Prior to the release of building permits on Lot B the applicant shall submit evidence to the Department
of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and
dependability.
5) Prior to the release of building permits on Lot A or B,the applicant will be required to submit a recorded
deed describing the lot upon which the building permit is requested with the building permit application.
The legal description on such deed shall include the lot and recorded exemption number.
6) Should noxious weeds exist on the property or become established as a result of the proposed
development,the applicant/landowner shall be responsible for controlling the noxious weeds,pursuant
to Ordinance 169A.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld
County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the
Weld County Subdivision Ordinance. The plat shall be submitted within sixty(60)days from the date of approval by
the Department of Planning Services. The applicant shall be responsible for paying the recording fees.

Roger D. & Jo A. Motley have requested a Recorded Exemption to occur on part of the SW4
of Section 24, Township 4, Ranges 61. The 50 acre parcel is north of and adjacent to State
Highway 34, 1/z mile west of the Weld County Line. There is one existing home located on
proposed Lot A.
Planning staff has found that the application is not in compliance with Section 11.8.7 of the
Weld County Subdivision Ordinance. For this reason we are requesting the case be
reviewed by the Board of County Commissioners.
Section 11.8.7 states: "The recorded exemption application shall include the total contiguous
land ownership, except in the A (Agricultural) district. In the A (Agricultural) district when a
contiguous ownership equals at least twice the minimum lot size (160 acres), or a parcel
otherwise recognized as a complete quarter section, a portion of the lot equal to the minimum
lot size (80 acres) may be used in the recorded exemption application. The fact that the
applicant has conveyed, within the last calendar year, land which would have been
considered contiguous had it been retained, may be considered as evidence of an intent to
evade the purpose provisions of Sections 1.3 and 11.2.1 of this Ordinance."

The Weld County Planning Staff is recommending denial of Recorded Exemption 2474.
Although the 50 acre parcel would require a Use by Special Review Permit to acquire building
permits, Planning Staff concurs that it would be inappropriate to grant relief from this
provision when the hardship was brought about solely through the actions of the applicant.
Also the applicant has already created the two parcels he was eligible for had he used the
Recorded Exemption process.
The Department of Planning Services' staff requests that the Board of County
Commissioners consider the application and determine if the standards of Sections 11.2
through 11.8 of the Weld County Subdivision Ordinance have been met and adhere to the
goals and policies of the Weld County Comprehensive Plan.

Recorded Exemption 2474 was approved by the Board of County
Commissioners on June 7 of this year. The applicants Roger and Jo Motley have
requested changes to the original application.
The parcel the recorded exemption was applied for on was described as the
west 50 acres at the Board Hearing. The deed submitted to replace the
inaccurate deed submitted at the first hearing does not conform to this
description.
The second change is to the configuration of lot A. It was originally described as
a 5 acre lot in the south east corner. This is the new configuration of lot A.
It no longer extends to the east edge of the parcel.
The Weld County Planning Staff recommends approval of this request. However,
Planning Staff and the Weld County Attorney agree that Planning Staff does not
have the authority to approve changes to a case that was originally approved by
the Board.

with surrounding properties being agricultural in nature, with limited residences.
The South Platte River and Empire Reservoir are also within close proximity.

Subdivision Ordinance. Section 1.3.8 ensures securing equitable handling of all
subdivision plans by providing uniform procedures and standards. Had the
applicant included the entire 130 acre parcel as required by Section 11.8.7 of the
Weld County Subdivisioordinance, they would haveeen eligible for two
parcels. The approval of this Recorded Exemption would not be equitable in that
it would create 3 parcels with a possibility of a 4th should the owner of the 80
acres wish to divide the parcel.
The Weld County Planning Staff is recommending denial of Recorded Exemption
2474. Although the 50 acre parcel would require a Use by Special Review Permit
to acquire building permits, Planning Staff concurs that it would be

and subdivided his property without the appropriate Recorded Exemption. His actions created
the nonbuildable parcel.
The Weld County Planning Staff is recommending denial of Recorded Exemption 2474.
Although the 50 acre parcel would require a Use by Special Review Permit to acquire building
permits, Planning Staff concurs that it would be inappropriate to grant relief from this
provision when the hardship was brought about solely through the actions of the applicant.
Also the applicant has already created the two parcels he was eligible for had he used the
Recorded Exemption process.
The Department of Planning Services' staff requests that the Board of County
Commissioners consider the application and determine if the standards of Sections 11.2
through 11.8 of the Weld County Subdivision Ordinance have been met and adhere to the
goals and policies of the Weld County Comprehensive Plan.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
WCR 42.5 is designated on the Transportation Plan Map as a local gravel road which requires 60 feet of right-of-
way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Morgan County.
Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the
required setback is measured from the future right-of-way line.
REQUIREMENTS:
The access shall be placed in such a location to have adequate sight distance in both directions and not below the
crest of a hill or where physical obstructions are present. (Lot B)
If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a
larger culvert, please contact the Public Works Department to adequately size your culvert. (Lot B)
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the State Highways.
Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to verify the access permit or for any
additional requirements that may be needed to obtain or upgrade the permit. (Lot A)
Direct access from a public road shall be limited to one access per legal parcel for residential, no circle drives.
This policy shall apply to all new and existing accesses within the unincorporated areas of Weld County.
Properties within municipalities or other counties which access Weld County roads are also subject to this policy.
(Lot B)
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.
