RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR MUTUAL AID RESPONSE AND
AREA OF MUTUAL DISPATCH PROTOCOL WITH MORGAN COUNTY AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement for
Mutual Aid Response and Area of Mutual Dispatch Protocol between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of Weld
County Ambulance Services Department, and Morgan County, commencing upon execution of
agreement, with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, copies
of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Intergovernmental Agreement for Mutual Aid Response and Area of
Mutual Dispatch Protocol between the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of Weld County Ambulance Services
Department, and Morgan County be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 4th day of January, A.D., 1995.

INTERGOVERNMENTAL AGREEMENT
DATE: December 20 , 199 4
WHEREAS: Morgan County, Colorado, by and through its Board of County
Commissioners, and Weld County, Colorado, by and through its Board of County Commission-
ers, (collectively, "agencies"); and
WHEREAS, the agencies are authorized by Colorado statute to enter into intergovern-
mental agreements; and
WHEREAS, the agencies named above maintain paid or volunteer emergency medical
services together with personnel and equipment for such purposes. The agencies agree that it
is to their mutual benefit to assist each other.
NOW, THEREFORE, in consideration of the premises and the mutual covenants and
agreements herein set forth, the agencies agree as follows:
1. Definitions.
1.1 "Answering agency" means the agency responding to a request within the boundaries
of another agency.
1.2 "Requesting agency" means the agency requesting aid of an answering agency under
this Agreement.
1.3 "Director" means the person responsible for the ambulance service at the respective
agencies, or his or her designated representative or successor.
1.4 "EMT -in -charge" means the EMT or other individual in charge of the personnel and
facilities of the respective agencies at the scene of the response.
2. Mutual Assistance and Aid.
2.1 Agreement for Mutual Assistance. Each agency agrees to respond to requests for
assistance within the jurisdictional boundaries of the other agency upon request of the director
of the requesting agency at all times consistent with the safety and protection of the citizens and
property of the answering agency, in the sole judgment of the director of the answering agency.
Such response shall be without charge to the requesting agency.
2.2 Level of Response. The director of the answering agency shall have complete
discretion to select the personnel and equipment to answer the call.

2.3 Control. The equipment and employees of the answering agency shall at all times
be under the supervision and control of the director of the answering agency.
3. Protocol for Mutual Aid.
3.1 Form of Request for Aid. Any request for aid hereunder shall include a statement
of the amount and type of equipment and personnel requested, and shall specify the location to
which the equipment and personnel are to be dispatched.
3.2 Protocol when both agencies are on the scene. The EMT -in -charge of the answering
agency shall report to the EMT -in -charge of the requesting agency at the location to which the
answering agency was dispatched, and shall coordinate all activities with that official. The
resources or facilities that are assigned pursuant to this Agreement shall be under the immediate
supervision of the EMT -in -charge of the answering agency.
3.3 Protocol when only answering agency is on the scene. If only personnel and
equipment of the answering agency are on the scene to which they were dispatched, the
answering agency will follow its own treatment protocols and procedures, and will determine
the appropriate destination based on its own protocols and procedures. The answering agency
may, but shall not be obligated to, contact the requesting agency's medical base for additional
instructions and a destination site.
3.4 Release. The answering agency will be released by the requesting agency when the
services of the answering agency are no longer required or when the answering agency is needed
to provide emergency medical care or other emergency public services in its normal service
jurisdiction.
3.5 Standard of Care. Each agency agrees that its equipment, and the actions, methods
and practices of its personnel shall conform to the applicable requirements of Colorado law and
to acceptable methods and practices of emergency response services.
3.6 First Responders. If a first responder is on the scene before either agency, said first
responder shall follow its own protocols to stabilize the patient and prepare for transport, and
shall relinquish control to the EMT -in -charge of the requesting agency or agencies on the scene.
Said first responder shall then offer assistance, and shall depart the scene if assistance is not
required.
4. Additional Provisions.
4.1 Insurance. At all times that the personnel and equipment of an answering agency
are dispatched pursuant hereto, the said personnel and equipment of the answering agency shall
be subject only to the liability, worker's compensation, and other insurance of the answering
agency.

4.2 Privileges and Immunities. The equipment and personnel of each of the agencies
while engaged in performing any mutual aid service, activity or undertaking under this
Agreement shall have and retain all rights, privileges and immunity of and be deemed to be
engaged in the service and employment of such agency, notwithstanding that such mutual aid
service is being performed in the jurisdiction of or for the other agency.
4.3 Waiver of Claims. Each agency waives all claims against the other agency for
compensation for any loss of or damage to equipment and for any loss, damage, personal injury
or death sustained by its personnel, which occur as a consequence of the performance of this
Agreement.
4.4 Effective Period. This Agreement shall become effective upon the approval and
signature by the last to sign of the authorized representatives of the agencies hereto and shall
continue until such time as either agency gives 60 days advance written notice to the other
agency of its intention to terminate this Agreement.
4.5 Supplementation. This Agreement may be supplemented with various exhibits to
be alphabetically designated in chronological order of adoption and signed by the respective
agencies. These exhibits may set forth specific areas of first response, additional protocols, and
other communications and procedural matters.
4.6 Employment Relationship. This Agreement does not create an employment
relationship between the agencies. Each agency agrees that its personnel do not become
employees of the other agency as a result of this Agreement. Each agency's equipment and
personnel shall remain the responsibility of that agency even when responding to a request under
this Agreement. Each agency's personnel do not become entitled to any employee's benefits
provided by the other agency as a result of this Agreement.
4.7 Complete Agreement. This Agreement shall supersede and replace any and all
agreements, contracts and written or oral understandings in existence prior to the execution of
this Agreement.
4.8 Modification. This Agreement may be modified only in a writing signed by the
authorized representatives of the parties to this Agreement.
4.9 No Third Party Beneficiaries. Nothing in this Agreement shall be construed to
create a cause of action or civil liability remedy in any person not a party to this Agreement.
This Agreement exists for the sole benefit of the parties to the Agreement. The Agreement shall
not be construed to create a duty by either party to any third party where no such duty otherwise
existed.
IN WITNESS WHEREOF, the duly authorized representatives of the respective agencies
hereto have signed on the dates indicated below.

AREA OF MUTUAL DISPATCH PROTOCOL
Amendment to Morgan/Weld Intergovernmental Agreement
regarding mutual ambulance aid
1. The Weld County Regional Dispatch Center will dispatch Weld County Ambulance
Service to all pre -hospital medical calls in eastern Weld County.
2. Weld County dispatch shall advise Morgan County Dispatch of all emergency medical
and trauma calls occurring within the following boundaries:
North on a line equal to the East right-of-way of Weld County
Road 81 from the Adams County boundary to State Highway 14
(Weld County Road 90), and then east on a line equal to the North
right-of-way of Colorado Highway 14 (Weld County Road 90) to
the Logan County boundary. (See attached map)
3. It shall be at the complete discretion of Morgan County officials whether or not Morgan
County Ambulance Service units respond. If MCAS units do respond, it shall be Morgan
County Dispatch Center's responsibility to advise the Weld County Regional Dispatch
Center of the following information:
a. The number of MCAS units responding and their identifying numbers (e.g.
"Morgan County Ambulance Unit 3 is responding").
b. The number and levels of certification of the personnel (e.g. "one EMT I and one
paramedic on board").
c. Estimated time of arrival from ambulance personnel.
4. If Morgan County Ambulance Service units arrive on scene prior to Weld County
Ambulance Service units, they are to assess and triage the scene, initiate any necessary
treatment, and relay this information to the responding Weld County Ambulance Service
unit.
5. It shall be at the discretion of the Weld County Ambulance Service unit as to whether
or not they continue their response if a cancellation is suggested by the Morgan County
Ambulance Service unit. It shall be the Morgan County Ambulance Service unit's
responsibility to remain on scene until released by the Weld County Ambulance Service
unit.

Dear Commissioner Webster:
Enclosed are two (2) executed copies of the
Intergovernmental Agreement for the Mutual Aid Response
between our counties.
This is to replace the document that was approved in
1991. We had our County Attorney review the original
document and I believe the only modification was in the
opening statement to designate this as an
Intergovernmental Agreement and the deletion under 1.3
designating specific Directors.
If you have a better map to attach to this document
we would appreciate you returning one to us when you
return one of the signed agreements, after your approval.
