IN THE MATTER OF REPEALING ORDINANCE NO. 136-I AND RE-ENACTING THE SETTING
OF THE AMOUNT OF PURCHASES WHICH MUST BE BY WRITTEN SEALED BIDS WITH A
TEN-DAY PERIOD FOR CONSIDERATION
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, Paragraph 5 of Section 14-9 of Article XIV of the Home Rule Charter for Weld
County, Colorado, as amended November 6, 1984, provides that written, sealed bids and a ten-day
period for consideration and investigation of the bids be required for purchases in excess of an
amount set annually by the Board of County Commissioners by Ordinance, and
WHEREAS, it is necessary that this Board set the limit for the year 1996 to comply with said
provision, and
WHEREAS, the Board after consultation with staff, consideration of past bid procedures,
and being otherwise fully advised, has determined that all purchases for the year 1996 in excess
of $7,500.00 shall be by written, sealed bid, and shall be followed by a ten-day period unless
waived by this Board.
NOW, THEREFORE, BE IT ORDAINED, by the Board of County Commissioners of the
County of Weld, State of Colorado, that all purchases for the year 1996 in excess of $7,500.00
shall be by written, sealed bid, and shall be followed by a ten-day period for consideration and
investigation of the bids submitted to determine comparisons of quality and price unless waived by
this Board by Resolution for emergency purchases.
BE IT FURTHER ORDAINED by the Board that this Ordinance shall supersede all prior
ordinances and resolutions concerning setting of the amount of purchases which must be by
written, sealed bids with a ten-day period for consideration as enumerated in this Ordinance.
BE IT FURTHER ORDAINED by the Board that the effective date of said Ordinance
No. 136-J shall be January 1, 1996.

BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph,
sentence, clause, or phrase of this Ordinance is for any reason held or decided to be
unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The
Board of County Commissioners hereby declares that it would have enacted this Ordinance in each
and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the
fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might
be declared to be unconstitutional or invalid.
The above and foregoing Ordinance Number 136-J was, on motion duly made and
seconded, adopted by the following vote on the 11th day of December, A.D., 1995.
