The summary of the last regular meeting of the Weld County Planning Commission held on April 16, 1996,
was approved as read.
1. CASE NUMBER: 89-GG
PLANNER: Keith Schuett
REQUEST: Amend the land use application fee schedule by adding Item#25 amendment to an
existing Special Review Permit application for a Solid Waste Disposal Site and
Facility.
Keith Schuett explained that this is not an ordinance, but a resolution and the Department of Planning Services
should not reference Case Number 89-GG. This request is for a fee schedule change. The existing fee for
a Special Review Permit for a Solid Waste Disposal Site is $17,114.00. This amendment would require that
the applicant post the $17,114.00. The Department of Planning Services, Weld County Health Department,
and Weld County Public Works would draw from this amount, as needed, to achieve a more accurate
application cost. Keith Schuett stated the fees are based on what it costs the County to process a new
application. Staff feels that costs would be lower to an amended Special Review Permit for a Solid Waste
Disposal Site.
The Department of Planning Services' staff recommends approval of this amendment to the Fee Schedule
Resolution regarding Special Review Permits for Solid Waste Disposal Site and Facilities.
Arlan Marrs had concerns about what type of amendments were being addressed in these applications. Keith
Schuett explained that location changes to retention ponds; additional lifts to a solid waste disposal site and
adding recycling facilities were different amendment issues.
Zachary Allely asked who controls the funds and will this fund be in an interest-bearing account. Lee Morrison
explained the County controls the funds and all County funds are invested. Zachary Allely asked how long
are funds posted. Keith Schuett stated funds are held for 60 to 90 days, but could be held longer if the
applicant was receiving a Certificate of Designation change.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.

Arlan Marrs moved that the amendment to the Fee Schedule Resolution regarding Special Review Permits
for the Solid Waste Disposal Site and Facilities, be forwarded to the Board of County Commissioners with the
Planning Commission's recommendation for approval. Jack Epple seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
Sommer-yes; Kristie Nicklas-yes;Ann Garrison-yes; Marie Koolstra-yes; Jack Epple-yes; Zachary Allely-yes;
Arlan Marrs-yes; Richard Kimmel-yes. Motion carried unanimously.
2. CASE NUMBER: USR-1117
PLANNER: Todd A. Hodges
APPLICANT: Sharon Strunk
REQUEST: A Site Specific Development Plan and Special Review Permit for a Bed and
Breakfast and Dude Ranch in the A(Agricultural)zone district.
LEGAL DESCRIPTION: A tract of land located in Section 1,2, and 12 T11N, R62W and
Section 34 and 35, T12N, R62W of the 6th P.M., Weld County,
Colorado.
LOCATION: Northeast and adjacent to Weld County Road 390; southwest and adjacent to Weld
County Road 390; south and adjacent to Weld County Road 77.
Cristie Nicklas removed herself from the podium and abstained from the vote due to the fact she is also a
surrounding property owner.
Todd Hodges explained changes to the staff recommendation were grammar changes and an addition to the
Conditions of Approval. Todd Hodges explained Condition of Approval#7G should read: The applicant shall
submit evidence to the Department of Planning Services that the existing well on the property has been
designated for commercial use.
Todd Hodges gave an overview of the case stating: "this property is located on approximately 1,550-acres
to be used as a Bed and Breakfast and Dude Ranch". This property has a creek and two irrigation lakes
located on site. There are two existing homes on the site. The applicant wishes to use one as the Bed and
Breakfast facility and the other as their home site. A future home to be built will be occupied by the applicant
and the existing home they live in will be turned into another facility for the Bed and Breakfast. Conditions of
Approval from the Weld County Building Inspection Department and the Weld County Health Department have
been incorporated. Staff has received concerns from one surrounding property owner about the water usage
on the property. Todd Hodges explained there is a Condition of Approval stating there will be no recreation
on or around this property, unless agreement is established with the owner of the water rights. Staff is
recommending approval with the Development Standards and Conditions of Approval as written.
Discussion followed among the Planning Commission members on access. Todd Hodges explained there
were three existing accesses to the property. Todd Hodges spoke with Don Carroll, Weld County Public
Works and Don Carroll explained the Weld County Public Works Ordinance#180 allows for one residential
access. Public Works Department will allow two of the accesses to remain; one for the residential use and
one for field access.
The applicant, Sharon Strunk, explained they agree with the use of two accesses. Mrs. Strunk stated they
are proposing to diversify their income by ranching and having a Bed and Breakfast facility. Mrs. Strunk
explained this is a high plains ranch with beautiful surroundings and they want to share their surroundings with
birdwatchers and people who enjoy horseback riding.

Arlan Marrs asked the applicant to address the issues about water usage of the property. Mrs. Strunk
explained they had an attorney review the deed, and were told they have the right to use the surface of the
land that the water is on. Mrs. Strunk indicated they own the land under and around the water and the 1939
deed states the water owners have the right to take care of their dam and liability is limited. Mrs. Strunk
indicated they are trying to acquire insurance of a million or more for liability purposes. Mrs. Strunk has
spoken with the surrounding property owner and they are working on an agreement for the use of the water.
Fencing will be place
around the head gate of the irrigation ditch.
Richard Kimmel asked the applicant if they were in agreement with the Development Standards and
Conditions of Approval. The applicant was in agreement.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Zachary Allely motioned Case Number USR-1117 be approved by the Board of Planning Commission with
the Conditions of Approval and Development Standards. Arlan Marrs Seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
