HomeMy WebLinkAbout960741 HEARING CERTIFICATION DOCKET NO. 96-20 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1109 FOR AN ARCHERY RANGE AND CONCRETE AND ASPHALT STORAGE, CRUSHING, AND SCREENING FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - CITY OF GREELEY, C/O JOE LOHNES A public hearing was conducted on April 24, 1996, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated April 3, 1996, and duly published April 11, 1996, in the North Weld Herald, a public hearing was conducted to consider the request of the City of Greeley, do Joe Lohnes, for a Site Specific Development Plan and Special Review Permit#1109 for an archery range and concrete and asphalt storage, crushing, and screening facility in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He noted this use is existing and concerns have been addressed in the Conditions of Approval and Development Standards. Trevor Jiricek, Health Department, responded to questions from the Board stating the Individual Sewage Disposal System regulations require a minimum of a vault system and the Board has approved portable units only at gravel pits where there are location changes and which are considered temporary uses. Joe Lohnes, City of Greeley, represented the applicant and reviewed the history of the property which the City has owned since the late 1960's. He presented an overview of the archery range and recycling activities which have been in place for over two years and responded to questions from the Board. Fred Stenzel, Caroline Sierra, Ramon Salazar, and Daniel Ochsner, all surrounding property owners, voiced numerous concerns regarding noise, traffic, safety of animals and children, dust, impacts to the river area and wildlife, dumping of trash, and kids trespassing and shooting guns at night. The above named and staff responded to questions from the Board regarding said concerns. Chad Phillips, Planner for the City of Evans, confirmed the shooting range belongs to the City of Evans and is not related to this proposal. He stated the two cities have an agreement regarding access off 42nd Street and the Evans Ditch Road and noted 17th Avenue is to be avoided. Mr. Phillips made further comments regarding the City of Evans' Comprehensive Plan and responded to questions from the Board. 960741 PL1029 RE: HEARING CERTIFICATION - CITY OF GREELEY, C/O LOHNES (USR#1109) PAGE 2 Let the record reflect a recess was taken at this time. Susan Barrett, surrounding property owner; Mr. Salazar; and Mr. Ochsner, on behalf of Louis Brantner, also a surrounding property owner, voiced further concerns and answered additional questions from the Board. Mr. Lohnes confirmed people do drive down the road and dump trash; however, the City of Greeley picks it up. He noted there are also tree service trucks on that road traveling to a dump site. Mr. Lohnes stated the City can apply magnesium chloride on the road to prevent dust and can provide a gate for security. He stated the Colorado Division of Wildlife has pledged Hunter's Safety funds for the area, and the operation is in compliance with the State standards for noise and fugitive dust. Mr. Lohnes stated the City of Greeley is responsible and trying to be the best possible neighbor. The Board suggested designating a haul route and limiting a time for crushing. (Changed to Tape#96-13.) Bob Harmon, City of Greeley, reiterated the City does not have a concrete plant on the site; the equipment is rented and moved on site for a period of time for crushing. Regarding the City of Evans' request to renew the Permit every three years, Mr. Morrison clarified the County does not have an ordinance which provides authority to grant temporary permits. Mr. Hodges noted Condition of Approval #10 states the Permit is nontransferable. He also confirmed staff is recommending berming be required around the archery range; however, the crusher is already in a low area. Mr. Jiricek responded to questions concerning the noise level at the property line, confirming the standard is stringent for the Agricultural Zone District. Mr. Morrison suggested the applicants submit a noise abatement plan to be reviewed and approved by the Health Department, and Commissioner Harbert suggested such language be added to Development Standard #5. During discussion among the Board members and staff, it was agreed to delete Condition of Approval #7 regarding access from 49th Street, and renumber the remaining Conditions of Approval consecutively; to add a new Condition of Approval #10 limiting crushing to a four-week time period; to add Condition of Approval #3e requiring a dust abatement plan; and to add Condition of Approval #11 limiting access to 42nd Street. Mr. Morrison and Mr. Hodges reviewed the proposed additional language with the Board. Commissioner Harbert moved to approve the request of the City of Greeley, c/o Joe Lohnes, for a Site Specific Development Plan and Special Review Permit #1109 for an archery range and concrete and asphalt storage, crushing, and screening facility in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, including the addition of Condition of Approval #3e, the deletion of Condition of Approval #7 and renumbering the remaining Conditions of Approval consecutively, the addition of a new Condition of Approval #10, and the addition of language as provided by staff to Development Standards #5 and #10.
