The first, created to retain rights to an underground source of water is not an actual physical feature on the surface of the farm ground, and is still farmed on top. The second "flag" parcel, on the southwest corner of Lot B adjacent to Lot A was left to allow access to a ditch. The purpose of the application is to separate into two parcels, keeping the same use for both parcels. The property is and has been used since 1969 as a contractors shop, and has been approved for that use. No changes will be made to any existing improvements on the properties, nor to the present use of the subject property. There are two types of soils on the property. The largest area is Vona loamy sand. This soil has a 0-3 % slope. Permeability is moderately rapid with the available water capacity as moderate. The surface runoff is slow and erosion hazard is low. The chief limiting soil feature is rapid permeability in the substratum, which causes a hazard of ground water contamination from sewage lagoons. There could be severe seepage. The second soil found is Loup - Boel loamy sands found around lakes and ponds. They have a 0-3 % slope. Loup soil is deep dtid poorly drained, with permeability being rapid. Water capacity is moderate. The water table is at or near the surface. Surface runoff is slow and erosion hazard low. Boel soil is poorly drained and permeability rapid. Available water capacity is moderate. This type of soil would be severe for septic tank absorption and lagoons. The peculation is slow. Proposed Use : The operation and storage of oil and gas ' support service ( work over - field office - storage yard ) and contractor shop as defined in Weld County Zoning ordinance . Such as electrical , heating , plumbing , painting , -at.c . Operations that meet with Weld County Building and Inspection Dept , Planning ' Dept . and Weld County Health Dept . standards . 2 . Need for Use : The area was established in 1969 as a ' retirement income base and was used for oil field support and contracting services until 1989 . The use was then amended ( U .S .R . 894 ) to decorative rock finishing . When tenants vacate we are hampered by not knowing who or when new tenants will be approved for the area . Also , the cost of U .S .R . procedure for each new tenant . 3 . Existing Uses of Surrounding Areas: The property to the east is used for commercial turkey production; the property to the south is converted back to grass land; the property to the west and north is used as dryland pasture . 4 . Water Source : Water is supplied by Central Weld Water District and there will be no need for increase . Access Route : The main access is off WCR 19 . Employees will use normal auto/truck vehicles on a daily basis . Business ' operations can vary from pickup to tractor trailer rigs with very little increase on present traffic . 9 . Sewage Facilities : There is an approved existing septic ' system Number 671213 . 10 . Proposed Fire Protection: The area is in the Platteville ' Fire Protection District . There is a CWCWD fire hydrant 500 feet from the building and hand-held fire extinguishers within the building . ' 11 . Types and Maximum number of animals: None . IRESOLUTION I RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND AMENDED SPECIAL REVIEW PERMIT FOR A CONTRACTOR SHOP AND ASSOCIATED USES IN THE A (AGRICULTURAL) ZONE DISTRICT - JACK AND LAVONNE ECKSTINE IWHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and IWHEREAS, the Board of County Commissioners held a public hearing on the 21st day of October, 1992, at the hour of 10:00 a.m. in the Chambers of the Board I for the purpose of hearing the application of Jack and LaVonne Eckstine, 8585 Weld County Road 22, Fort Lupton, Colorado 80621, for a Site Specific Development Plan and Amended Special Review Permit for a contractor shop and associated uses in the A (Agricultural) Zone District on the following described Ireal estate, to-wit: Part of the SE}, Section 9, Township 2 I North, Range 67 West of the 6th P.M. , Weld County, Colorado I WHEREAS, Jack and LaVonne Eckstine, applicants, were present, and WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Amended Special Review Permit, and IWHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the I recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: I 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. I 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance as follows: I a. This proposal is located within the urban growth boundary area of the Town of Firestone and is consistent with the Weld County Comprehensive Plan's Urban Growth Boundary Area Goals I and Policies. The Tri-Area Planning Commission reviewed the request and recommended either rejection or substantial revision of this request. The Conditions of Approval and I Development Standards mitigate concerns expressed by the Tri- Area Planning Commission in their letter of September 1, 1992. to the greatest extent possible. I b. The proposal is consistent with the intent of the A (Agricultural) Zone District in which the use is located. The uses permitted will be compatible with the existing surrounding land uses and with the future development of the surrounding area as permitted by the Weld County Comprehensive Plan. The uses on the surrounding properties include agricultural production, pasture, rural residences and a ' turkey farm. d. No overlay districts affect the site. ' e. Amended Special Review Permit Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. ' NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Amended Special Review Permit for a contractor shop and associated uses in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: ' 1. The attached Development Standards for the Amended Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the ' Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. ' 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County ' Clerk and Recorder. 3. Within 30 days of approval by the Board of County Commissioners the existing septic system is required to be reviewed by a Colorado Registered Professional Engineer and a copy of that review submitted to the Weld County Health Department. ' 4. Prior to recording: a. The plat shall be amended to show the existing fueling ' facility. b. The plat shall be amended to show one access onto Weld County Road 19. 5. Prior to any change in uses of the facility or facility renter, the applicant shall submit a letter to the Department of Planning Services indicating the specific changes. The Site Specific Development Plan and Amended Special Review Permit is for a contractor shop and associated uses as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The Amended Special Review Permit shall not be transferable to any successors in interest to the described property and shall terminate automatically upon conveyance of the property to others for the operation of the facility. ' 4. All structures or septic systems shall not be located within the Colorado Interstate Gas Company's right-of-way. ' 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. No permanent disposal of wastes shall be permitted at this site. 7. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 8. Fugitive dust shall be controlled on this site. 9. The maximum permissible noise level shall not exceed the light industrial limit of 70 dB(A) , as measured according to 25-12-102, Colorado Revised Statutes. 10. Adequate toilet facilities shall be maintained on this site for employees and the public. 11. Storage of materials, derelict vehicles, and equipment shall be visually screened from all adjacent properties and road rights-of-way. ' 12. The property shall be maintained in compliance with S.A.R.A. Title III. 13. Access shall be limited to one from Weld County road 19 and one from Weld ' County Road 22. 14. All construction on the property shall be in accordance with the ' requirements of the Weld County Building Code Ordinance. 15. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 921017 • • ' DEVELOPMENT STANDARDS - ECKSTINE PAGE 2 16. The property owner or operator shall be responsible for complying with the ' Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 17. Personnel from the Weld County Health Department, Platteville Fire Protection District, and Weld County Department of Planning Services shall ' be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County ' Regulations. 18. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County ' Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County ' Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. ' 19. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards.
