RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST CANDACE MISTLER FOR VIOLATION OF THE WELD
COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Candace Mistier, VI #9600199, is allegedly in violation of the Weld County
Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of October, 1996, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Candace Mistier, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of
said violation to the Weld County Attorney's Office for a period of two weeks to allow adequate
time for the property owner to bring the subject property into compliance and for an inspection
of the property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individual without further Board action if the subject property is not brought into
compliance within two weeks.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that if said violation still exists on October 22, 1996, the Weld County
Attorney be, and hereby is, authorized to proceed with legal action against Candace Mistier to
remedy the violation of the Weld County Building Code Ordinance, and any other persons
occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

completed within 180 days of the date of issuance of the building permit. The required inspections

1996. If the final inspection is not completed by this date the department has no choice but to
pursue this matter as a violation.

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDmONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) as the only well on a residential site of 18.368 acres described
as part of the NW1/4 of the NE1/4 of Section 19, Townshi 1 North, Range 65 West, 6th P.M. more particularly
described in the attached Exhibit A.
4) The use of ground water from this well is limited to ordinary household purposes inside a single family dwelling.
The ground water shall not be used for irrigation or other purposes.
5) The total depth of the well shall not exceed 100 feet, which corresponds to the base of the alluvial aquifer.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The return flow from the use of the well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
8) This well shall be constructed not more than 200 feet from the location specified on this permit.
Note: To insure a maximum productive life of this well, perforated casing s4ould b set through the entire
