HomeMy WebLinkAbout690275.tiffRESOLUTION WHEREAS, Flatiron Paving Company, Box 1137, Greeley, Colorado, has requested permission to locate a gravel pit operation on the following described property, to -wit: In the West -half (Wz) of the Southwest Quarter (SWI) of Section Eighteen (18), Township Six (6) North, Range Sixty-seven (67) West of the 6th P.M., Weld County, containing 80 acres more or less, and WHEREAS, the said requested gravel pit operation is in an agricul- tural zone as set forth by the Planning Commission of Weld County, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be auth- orized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Weld County Planning Commission has recommended that this business operation be approved by a Resolution dated February 4, 1969. Please be advised that the gravel pit operations will be conducted on the described property which is situate approximately two miles West and 500 feet North of the Town of Windsor. May we advise that the owner of the property has leased the same to our client for a base term of five years and that Flatiron Paving Company will conduct normal and usual operations of a complete gravel pit at such location. Mr. Ruyle stated the contract is a recorded instrument dated 2/1/67. There is an option to purchase the property at the end of the 10th year. RESOLUTION: Be it therefore resolved to recommend the expansion of the feed lots to the Board of County Commissioners subject to their lease agreement. Motto: by Mr. Heitman, seconded by Mr. Bowles. A unanimous vote of "Aye". Motion carried. APPLICANT: Greeley Loveland Irrigation Co. APPEARANCE FOR: Ed Boreson DISCUSSION: Mr. Watson read a letter from Wm. Southard. Mr. Boreson stated one of the problems the Irrigations Company has is with subdivisions being developed above the ditches. With the paved streets they get all of the runoff going into the ditch. They thought it might be well to alert the Planning Commission of the problem. They are concerned about water pollution. They are imposing restrictions on their users. They are trying to develop a policy where anybody that puts land in use for irri- gation above the system, has to pass their pipe for waste water back across the system and not into the ditch. We feel these developments should have the same kind of a system. Mr. Moberg stated the Planning Commission could require a drainage study tin subdivisions and have an engineer figure out where the water is going and see if it is acceptable in these conflicts. If they are creating a problem, it is a good reason to require a drainage study. Mr. Boreson stated the drainage is more of a problem than an ad— vantage because of the silt and the washing effect it has on the banks. Mr. Moberg stated there should be some natural pattern where it can be dumped in so that it can flbdd something else. Mr. Bowles stated some of the ditch companies interfere with the natural drainage of water and they would have just as much obligation as the developer to protect the ditch. Mr. Watson stated he thought the ditch companies should be notified of any subdivisions to be developed and get the approval of the ditch companies before they are granted. The property is owned by Roger Gimp and Jack Sondheim and will be leased from them. It contains 80 acres. The lease is contingent upon proper ruse_ -+permits being obtained for a gravel pit and the uses that are designated in the lease. Lease is available for inspection. Detailed re— quirements of the rehabilitation of the property have been prepared. Mr. McMurrin explained what had been involved in selecting this particular site. The top soil ranges from 5t to 82t which will be used for fill on the 500* of frontage property to make it level. The balance of the top soil will be used for landscape purposes. The rehabilitation plan presented is what the owners want done. RESOLUTION: Be it therefore resolved to recommend the approval of the site to the Board of County Commissioners. Motion by Mr. Bartels, seconded by Mr. Bowles. A unanimous vote of "Aye". COLORADO 00631 AREA CODE 303 902-0191 302-3060 February 3, 1969 Flatiron Paving Company of Greeley, Subject: Request for Land Use as Gravel Pit within the "A", Agricultural District The following is a discussion of the requirements of Section VI, Supplementary Regulations, Paragraph 6.1(3) (A) REHABILITATION PLAN 1. Because of sub -surface water, the area will be a lake upon completion of gravel operations. 2. The ultimate use of this land will probably be an "in town" recreation area. 3. Additional restoration work will be performed as the need develops. (B) TIME SCHEDULE 1. The Total Time for completion of this gravel operation is difficult to estimate. The time required to deplete the gravel deposit is dependent on the market and therefore the demand for gravel products. (C) ADDITIONAL INFORMATION 1. Due to movement of sub -surface water, stagnant pools will not exist. The property presently 1 Weld County Planning Commission Page 2 February 3, 1969 has underground drainage from the Northwest to the Southeast, which involves movement of a substantial body of water. 2. Setback distance will be as required, or more to adequately protect adjacent county roads. Slopes into the excavated area will be three to one and neatly dressed. 3. There are no existing houses or adjacent property requiring precautionary measures, however, adequate lateral and sub -adjacent support will be maintained. 4.
