On Monday, February 10, 1997, the Weld County Board of County Commissioners considered a request to
add a 24' x 60' modular unit to the Mountain View Evangelical Church property located at 6253 W. 28th Street.
Greeley, Colorado 80634. The Board considered the request for an expansion to the original CUP and the
Board found that the addition of the 24' x60' modular unit would not necessitate the need to amend CUP -63.
At the same time, the Board also addressed the fire hydrant issue which was a condition of approval under
the original CUP and recommended that because this did not require an expansion of the CUP, that a fire
hydrant was not warranted at this time.
The Board made this decision under the premise that the expansion of the 24' x 60' modular unit would occur
in a relatively short period of time. Should this expansion not happen within the next six months, the Board
has reserved the right to reconsider the expansion of the original CUP and make an additional finding, if
necessary.

Mountain View Evangelical Free Church:
Monica Daniels -Mika, Bruce Barker, Lee Morrison
The Mountain View Evangelical Free Church, located at 6253 28th Street,
Greeley, wants to expand its facility. They want to put a modular class room
on the property. Planning staff expressed concern over integration with the
community as this is not a permitted use. They would need a special use
permit, and that would cost $1,100. Going through the permit process would
also address an unresolved issue concerning a fire hydrant. Commissioners
Baxter, Hall, and Webster voted to allow the expansion without the permit.
They do not consider the addition of a 24 X 60 modular unit to be an expansion
of the original CUP -63 approved in 1980. Commissioners Harbert and Kirkmeyer
voted to require a permit.

In regard to Item No. 4 - the building committee requests
that the final drainage report be waived until Phase II
construction drawings (Sanctuary Expansion) are submitted
for construction approval. Phase I building construction
shall include landscaping 20' around the new construction.
The north parking lot shall be graveled with a 3/4" aggre-
gate rock and sloped to the west for proper drainage.
In regard to Item No. 6 - the building committee strongly
feels that the cost for installing a new fire hydrant on
the northeast corner of 63rd Avenue and 27th Street should
be a shared cost with the immediate homeowners in the area
(refer to County mailing list attached to CUP information
log) if required at this time.
If you have further questions in regard to the building
committee response, contact me for further clarification.

Dear Loren:
The Board of County Commissioners has reviewed the proposal for the
expansion of the Mountain View Evangelical Free Church. It was determined
that the construction of the 2,400 square foot addition proposed as Phase
III is not considered to be a material deviation from the plans approved
under Conditional Use permit #63. However, the Board will require approval
of a Special Review permit to amend the Conditional Use permit prior to
construction of the future Phase IV for the sanctuary. Construction of
Phase IV was considered to be a material deviation from the approved permit.
Please plan to allow approximately 45 to 60 days for the Special Review
permit application process.
The Board has requested that the following items be completed prior to the
issuance of the building permit for Phase III:
1. Submittal and approval of a drainage plan for the entire site;
2. The existing septic system shall be reviewed by a registered
professional engineer. The engineer shall certify that the septic
system is of sufficient size to handle the load or submit a design for
a replacement system to the Weld County Health Department. Please
check with the Health Department for the information it will require;
3. Compliance with the conditions of approval and approved development
standards of Conditional Use permit #63 including the installation of
the fire hydrant required in Condition #6; and
4. Compliance with any other County, State, or Federal requirements or
regulations which may apply to the use of the property.

Subject: Mountain View Evangelical Free Church's building permit
Dear Mr. Huwa:
The Board of County Commissioners has reviewed your letter of November 30.
The Board approved your request to issue the building permit prior to
obtaining approval of the Resubdivision. The Board's approval is
conditional upon the following:
1. All activities and construction conducted on the property is
at your own risk pending approval of the Resubdivision. A
completed resubdivision application and fee should be
submitted before December 29, 1989. The resubdivision
application fee is currently $500.00, after January 1, 1990,
it will be $600.00;
2. Compliance with any conditions of approval identified through
the Resubdivision application process;
3. All construction shall be in accordance with the requirements
of the Weld County Building Code Ordinance;
4. Submittal and approval of a drainage plan for the property
currently being prepared by McRae and Short, Inc. compliance
with the recommendations of the drainage plan is required.
The completed drainage plan should be submitted before
December 22, 1989; and
5. Compliance with any other County, State, or Federal requirements
or regulations which may apply to the use of the property.

The Board of County Commissioners decided not to require the installation of
the fire hydrant required in Condition #6 of Conditional Use Permit #63 at
this time. The decision was based upon the letter submitted from the
Milliken Fire Department dated November 29, 1989. The installation of the
fire hydrant will be addressed when the Church is required to obtain a Use
by Special Review Permit for the construction of the future sanctuary
identified as Phase IV on the plot plan prepared by Bley Associates dated
August 9, 1989.
The Board of County Commissioners also decided not to waive the building
permit Investigation Fee of $325.00. The Weld County Building Code
Ordinance requires that when work for which a permit is required is started
or proceeded with prior to obtaining the permit, an additional investigation
fee shall be added to the cost of the permit. The work was started without
a permit and the individuals involved with starting the work knew that the
permit had not been issued.

Dear Mr. Cunliffe,
Bley Associates Architects have been retained by our building committee to complete design and construction
management services toward the completion of our building addition.
Our records document that Mr. Bley has maintained thorough communication with the Planning Staff and County
Building Inspection Officials with particular regard given to the complex coordination of relocating the public
utilities that interfere with the expansion project.
McRae & Short, Inc. Engineering has been retained by our building committee to complete a site drainage report,
new subdivision filing plat (illustrating the vacation of the abandoned easements on site and the establishment of
new easements for the relocated utilities). Mr. Bley has informed our committee that Mr. McRae shall complete
these engineering sitework design elements no later than December 4,1989. Some of these items as you are aware
of, shall require additional review time prior to being officially recorded with the county.
We respectfully regret the untimely delay of the sitework engineering submittal, and further realize that we accept
full responsibility in proceeding with the foundation work now in progress.
We have also enclosed herewith information requested as related to the septic system design which is scheduled
for startup December 14, 1989, pending approval of historical data supporting final design input. A letter from
Milliken Fire Protection District verifying the adequacy of the hydrant system serving the church and subdivision
is enclosed.
We respectfully request that the foundation permit be released immediately and that the Planning Department
waive a referenced investigation fee as related to the Stop Work Order. Please contact our church administration
office should you have further questions as related to this project.

I have been contacted by Mr. Loren Bley regarding an addition
that the Mountain View Evangelical Free Church is constructing and
fire protection in the subdivision. The church site is presently
located in and provided fire suppression services by the Milliken
Fire Protection District. Mr. Bley stated that he needed the
location of the closest hydrant to his facility, that the county
was requesting this information. The location of the closest
hydrants are approximately two blocks away, both northwest and
northeast of the church building. One hydrant is located at 2645
64th Avenue, with the other located at 2610 61st Avenue. Mr. Bley
also asked whether the hydrant flow was adequate for fire
department purposes. I informed him that based on the type of
structures, lot sizes and hydrant locations in the subdivision,
that the hydrant system is adequate, although just adequate in some
cases.

Dear Jeff,
Please consider this letter to be an amendment to our letter to you
dated 11/16/89. After receiving your review comments in response to
the 11/16 letter, we agree to drop the 3/7 factor used in sizing the
system components. Therefore the minimum septic tank size will be:
5 gal/person/day x 1.5 X 200 persons X 1.25 days = 1,875 gallons
The minimum area for seepage trenches will be 1,300 square feet and the
minimum area for seepage bed will be 1,690 square feet.
