The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial
Center, Greeley, Colorado, December 6, 1999, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:
Commissioner Dale K. Hall, Chair
Commissioner Barbara J. Kirkmeyer, Pro-Tem - TARDY
Commissioner George E. Baxter
Commissioner M. J. Geile
Commissioner Glenn Vaad
Also present:

MINUTES: Commissioner Vaad moved to approve the minutes of the Board of County Commissioners
meeting of November 29, 1999, as printed. Commissioner Geile seconded the motion, and it carried
unanimously.
ADDITIONS TO AGENDA: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Vaad moved to approve the consent agenda as printed.
Commissioner Baxter seconded the motion, and it carried unanimously.
PUBLIC INPUT: There was no public input.
WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants
for approval by the Board:
All Funds
$641,497.46
Electronic Transfers - All Funds $79,561.09
Commissioner Baxter moved to approve the warrants as presented by Mr. Warden. Commissioner Vaad
seconded the motion, which carried unanimously.

BIDS:
APPROVE 2000 FOOD SERVICE CONTRACT BID-SHERIFF'S DEPARTMENT: Pat Persichino, Director
of General Services, recommended approval of the low bid from Correctional Food Service Management.
In response to Commissioner Geile, David Malcom,Sheriffs Office, explained by comparing the proposed
bid amounts with the average daily population of the jail, he determined the low bid to be from Correctional
Food Service Management in the amount of$2,023,242 over a five-year period. Commissioner Baxter
moved to approve said low bid. Seconded by Commissioner Vaad, the motion carried unanimously.

APPROVE 2000 JANITORIAL BID-SHERIFF'S DEPARTMENT: Mr. Persichino recommended approval
of the low bids from Northern Colorado Paper in the amount of $27,721.72, Columbine Paper and
Maintenance Supply Company in the amount of$7,956.90,and Hillyard in the amount of$11,096.90,each
for various janitorial supplies. Commissioner Vaad moved to approve said low bids. Seconded by
Commissioner Geile, the motion carried unanimously.
APPROVE INMATE COLLECT CALLING PHONE SERVICES BID - SHERIFF'S DEPARTMENT: Mr.
Persichino recommended this matter be continued to Wednesday, December 8, 1999. Commissioner
Baxter moved to continue this matter to Wednesday, December 8, 1999, at 9:00 a.m. Seconded by
Commissioner Kirkmeyer, the motion carried unanimously.
NEW BUSINESS:
CONSIDER APPLICATION FOR LICENSE TO CONDUCT DANCE OR DANCES-HEREFORD BAR AND
GRILL, INC., DBA HEREFORD BAR AND GRILL: Bruce Barker, County Attorney,stated Colorado Statute
requires dance applications from establishments which intend to host dances, and they are effective for
one calendar year. In response to Commissioner Geile, Mr. Barker stated the Liquor License for Hereford
Bar and Grill was approved earlier this year. Commissioner Kirkmeyer moved to approve said application
and authorize the Chair to sign. Seconded by Commissioner Geile, the motion carried unanimously.
CONSIDER APPLICATION FOR LICENSE TO CONDUCT DANCE OR DANCES - DEE ANN WOLFE,
DBA FORT 21: Commissioner Kirkmeyer moved to approve said application. Seconded by Commissioner
Vaad, the motion carried unanimously.
CONSIDER AMENDMENT TO AGREEMENT FOR JAIL MEDICAL UNIT SERVICE AND AUTHORIZE
CHAIR TO SIGN - CORRECTIONAL HEALTHCARE MANAGEMENT, INC.: Mr. Barker explained the
amendment includes extending the term date and the agreement amount. Commissioner Kirkmeyer
moved to continue this matter to December 8, 1999, at 9:00 a.m. to allow staff from the Sheriffs Office to
present further information. Seconded by Commissioner Geile, the motion carried unanimously.
CONSIDER RESOLUTION RE: APPOINT PAT PERSICHINO AS INTERIM DIRECTOR OF THE WELD
COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT: Commissioner Baxter moved to
approve said resolution. Commissioner Geile seconded the motion, which carried unanimously.
CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND AUTHORIZE CHAIR TO SIGN -
MICHELE MEYER: Commissioner Kirkmeyer moved to recommend the appointment of Michele Meyer as
a Deputy District Attorney. Commissioner Baxter seconded the motion, which carried unanimously.

CONSIDER PETITION TO VACATE A PORTION OF WELD COUNTY ROAD 84 BETWEEN WELD
COUNTY ROADS 51 AND 53-DYER/DILLARD: Mr. Barker gave a brief description of the location of said
vacation; and stated Gerald Green has submitted an E-mail message expressing his concern regarding
this vacation, marked Exhibit A. Mr. Barker submitted two aerial Assessor's maps, marked Exhibits B and
C, and in response to Commissioner Baxter, he explained the southwest corner of Mr. Green's property
is located at the eastern end of the petitioned portion of right-of-way.
Roy Dyer, applicant, stated his house is located within 20 feet of the existing right-of-way, which he has
maintained for over thirty years. He stated Mr. Green accesses his property from Weld County Road 53
and this vacation should not pose a problem. In response to Chair Hall, Mr. Dyer explained he is
requesting this portion be vacated to ensure a road is not constructed within close proximity to his house
and the road has never been maintained by Weld County. Mr. Barker stated the portion of Weld County
Road 84 heading east from Highway 14 to approximately where Mr. Dyer's house is located is designated
on the Weld County HUTF schedule. Responding to Commissioner Kirkmeyer, Mr. Dyer stated the house
has been on the site since 1966, and Weld County Road 84 does not exist any further to the east.
Gerald Green, surrounding property owner, submitted three photographs of the area, marked Exhibit D,
and stated this portion of right-of-way would be a more direct route into his property; however, he has not
used it because of machinery parked in the right-of-way by Mr. Dyer. Mr. Green stated the alternate
access from Weld County Road 53 crosses Mr. Dillard's property. In response to Commissioner Geile,
Mr. Green stated there are no improvements on his property. Mr. Green further indicated the location of
the property on the Assessor's map.
In response to Commissioner Kirkmeyer, Frank Hempen, Jr., Director of Public Works, stated he is not
aware of the condition of Weld County Road 53 south from Highway 14; however, Mr. Green has indicated
it is more of a trail than an established road. In response to Commissioner Baxter, Mr. Hempen stated a
portion of Weld County Road 84 is on the HUTF schedule and should be maintained. Responding to
Commissioner Kirkmeyer, Mr. Barker stated if this portion of right-of-way is vacated, the utility easement
needs to be established. Commissioner Kirkmeyer clarified this request is based on the reasoning that
the applicant's house was located too close to the right-of-way. Chair Hall commented the right-of-way
is necessary for access to surrounding properties, as well as for future use.
Commissioner Vaad concurred with Chair Hall and added that if this portion were vacated an additional
access from Highway 14 would need to be generated for the Green property. Commissioner Vaad moved
to deny said petition. The motion was seconded by Commissioner Kirkmeyer. Commissioner Baxter
commented he can understand the applicant's concern with the potential of a road being constructed within
close proximity to his house; however, there are other access issues which must also be considered. The
motion carried unanimously.
PLANNING:
CONSIDER REQUEST FOR EXTENSION FOR FILING FINAL PLAT FOR S#449-WEST HILL-N-PARK
5TH FILING: Eric Jerman, Department of Planning Services, stated the applicant has submitted a letter
requesting said extension. In response to Commissioners Geile and Kirkmeyer, Mr. Jerman indicated the
location of the 5th Filing and read Section 7.1 of the Subdivision Ordinance into the record. Mike Thomas
represented the applicant and stated the Final Plat application has been submitted to the Department of
Planning Services; however, staff has indicated some concerns, which he anticipates will be addressed
within the next 10 to 14 days. In response to Commissioner Kirkmeyer, Mr. Thomas stated the title
commitment is being reissued and he reviewed the seven items which must be addressed in accordance
with Condition of Approval#4 for the Preliminary Plan. Responding further to Commissioner Kirkmeyer,
Mr. Thomas stated he would like 30 days to complete all of the outstanding issues and explained he has
had timing conflicts with his current occupation; however, he is dedicated to completing these matters for
his client. Commissioner Kirkmeyer moved extend the deadline for 30 days to allow the applicant

adequate time to file the Final Plat for Major Subdivision, S #449, for West Hill-N-Park. Commissioner
Baxter seconded the motion, which carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent
agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:45 a.m.
