Dear Patrick:
This letter is in response to a letter you sent to the Board of County Commissioners of Weld County
on June 3, 1998. In that letter,you expressed concern on behalf of Dick and Virginia Pirnie
regarding the installation of a culvert adjacent to the Pirnie property intended to drain water away
from Weld County Road ("WCR")396 (West 54h Street Road). Your letter informed that due to the
size or location of the culvert, storms in May or June, 1998, backed up and inundated the Pirnie
property.
It is my understanding that in either late May, 1998, Weld County received permission from the City
of Evans to cut a temporary drainage ditch south from WCR 396 to the Evans ditch. The cut is
intended to provide additional drainage from the roadway to the ditch. Additionally, it is my
understanding that Joyce Allely is obligated to pay for and install a permanent drainage structure,
which will remove water from the culvert referred to in your letter, over the Evans ditch and to the
river. I am currently unaware of the date upon which such installation is to be completed.

Dear Commissioners and Ms. Allely:
This office represents Dick and Virginia Pimie. In the Fall of 1997, the Pirneys and the
County resolved a dispute concerning the County's plans to widen West 54"' Street Road. Now
that the County has begun construction on the project, the Pirneys are concerned that the road
expansion has and will continue to cause water to be captured and redirected from its natural
drainage. Due to either the size or location of the culvert installed adjacent to the Pirney
property, drainage water during a recent storm backed up and inundated the Pirney property and
part of the adjacent road. The apparent culvert problems may create a dangerous condition on the
54th Street Road.
This letter is not intended to assign any liability to either the County or to Ms. Allely and
we have no desire to be confrontational. The Pirneys are impressed by the professionalism and
courtesy of the crews working on this project. This letter is intended merely to inform you that a
problem with the drainage along West 54"' Street Road appears to exist, and we would request
that the County and/or Ms. Allely examine the situation. I look forward to hearing from you
regarding this matter.
