RE: SITE SPECIFIC DEVELOPMENT PLAN, SECOND AMENDED SPECIAL REVIEW
PERMIT #972, AND AMENDED CERTIFICATE OF DESIGNATION FOR ADDITION OF
COMPOSTING AND RECYCLING FACILITIES, PERIMETER BERM, RELOCATION OF
SEDIMENT BASIN, AND REVISION TO CELL C FOR AN EXISTING SOLID WASTE
DISPOSAL SITE - LAIDLAW WASTE SYSTEMS (COLORADO), INC.
A public hearing was conducted on December 18, 1996, at 10:00 a.m., with the following present:

Commissioner Constance L. Harbert
Commissioner W. H. Webster- EXCUSED

The following business was transacted:
I hereby certify that pursuant to a notice dated November 27, 1996, and duly published
December 5, 1996, in the South Weld Sun, a public hearing was conducted to consider the request
of Laidlaw Waste Systems (Colorado), Inc., for a Site Specific Development Plan, Second
Amended Special Review Permit #972, and Amended Certificate of Designation for addition of
composting and recycling facilities, perimeter berm, relocation of sediment basin, and revision to
Cell C for an existing solid waste disposal site. Lee Morrison, Assistant County Attorney, made this
a matter of record. Chair Kirkmeyer informed the applicant that only four Commissioners are
present and in the event of a tie vote, Commissioner Webster would review the record and cast the
deciding vote, or the applicant may request a continuance. Fred Otis, Attorney representing the
applicant, requested the Board proceed today. Gloria Dunn, Planning Department representative,
presented a brief summary of the proposal, indicating most Conditions of Approval and
Development Standards were derived from the previous Amended Permit. She further reviewed
the five proposed changes concerning the entrance, composting, sediment area, Cell C, and the
perimeter berm. Ms. Dunn then entered the favorable recommendation of the Planning
Commission into the record as written. She confirmed for Chair Kirkmeyer that Development
Standard#49 was added at the Planning Commission Hearing and the following Standards were
renumbered. Chair Kirkmeyer noted, therefore, Development Standard #28 should reference
Development Standard#54 rather than #53, and Ms. Dunn agreed. Mr. Otis stated he and other

representatives of Laidlaw, who he introduced, are prepared for a three-hour presentation;
however, the County and State staff have thoroughly reviewed all aspects of this application. He
confirmed for Chair Kirkmeyer that all Conditions of Approval and Development Standards are
agreeable. No public testimony was offered concerning this matter. Commissioner Hall moved to
approve the request of Laidlaw Waste Systems (Colorado), Inc., for a Site Specific Development
Plan, Second Amended Special Review Permit#972, and Amended Certificate of Designation for
the addition of composting and recycling facilities, perimeter berm, relocation of sediment basin,
and revision to Cell C for an existing solid waste disposal site, based on the recommendations of
the Planning staff and the Planning Commission, with the Conditions of Approval and Development
Standards as entered into the record, including the correction to Development Standard #28.
(Clerk's note: Ms. Dunn later advised that Development Standard #15 should also refer to
Development Standard #54 instead of #53, which is reflected in the Board's Resolution.) The
motion was seconded by Commissioner Baxter, and it carried unanimously.
This Certification was approved on the 23rd day of December, 1996.
