January 17, 1995
A regular meeting of the Weld County Planning Commission was held January 17, 1995, in the County
Commissioner's Hearing Room (Room #101), Weld County Centennial Building, 915 Tenth Street, Greeley,
Colorado. The meeting was called to order by the Chairman, Richard Kimmel.

The summary of the last regular meeting of the Weld County Planning Commission held on January 5, 1995,
was approved, as read.
CASE NUMBER: AM USR-1047
APPLICANT: Denver Television, Inc., KDVR
REQUEST: A Site Specific Development Plan and a Special Review permit for an existing 605 foot
transmission tower and transmitter building to remain on site in the A (Agricultural) zone
district.
LEGAL DESCRIPTION: A tract of land in the SE4 of Section 19, T8N, R66W of the 6th P.M., Weld County,
Colorado.
LOCATION: North of and adjacent to Weld County road 90; approximately 1/3 mile west of Weld County
Road 27.
Fred Baumgardner, representative, Denver Television, Inc., KDVR, explained they originally planned to
remove the existing tower after installation of the new tower. One of their "FM" customers wants to remain with
the existing tower so this amendment would allow both towers to exist on -site. The property is owned by one
individual and the towers are leased separately.
The Chairman asked the applicant if he agreed with the Department of Planning Services recommendation.
Fred Baumgardner said yes. The Chairman asked if there was anyone in the audience who wished to speak
for or against this application.
Meg Brown, Attorney, representative for KUAD and prospective buyer, had questions regarding the
amendment process and wanted to determine there were no other restrictions on the existing tower.
Curt Moore moved Case Number AM USR-1047, be forwarded to the Board of County Commissioners with
the Planning Commission's recommendation for approval. Bud Clemons seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron

CASE NUMBER: USR-1072
APPLICANT: One Comm Corporation
REQUEST: A Site Specific Development Plan and a Special Review permit for a 163 foot two inch self
supporting radio communication tower and one 11 foot x 20 foot prefabricated equipment
building in the A (Agricultural) zone district.
LEGAL DESCRIPTION: Part of the N2 E2 E2 of Section 27, T2N, R64W of the 6th P.M., Weld County,
Colorado.
LOCATION: Approximately 1/4 mile west of Weld County Road 57; south of and adjacent to Weld County
Road 18.
Monte Force, representative, One Comm Corporation, explained this is not a cellular tower it is a two-way radio
tower and they are in agreement with the Department of Planning Services' staff recommendation.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Bud Clemons was concerned the Planning Commission members had no way of knowing the difference
between a Special Review permit and a Major Facility of a Public Utility and how motions should be made. Lee
Morrison explained if the application is a Major Facility of a Public Utility it would be referenced on the
"REQUEST" line of the recommendation.
Bud Clemons moved Case Number USR-1072, One Comm Corporation, be forwarded to the Board of County
Commissioners with the Planning Commission's recommendation for approval. Judy Yamaguchi seconded
the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron
Sommer - yes; Curt Moore - yes; Judy Yamaguchi - yes; Jack Epple - yes; Marie Koolstra - yes; Shirley
Camenisch - yes; Bud Clemons - yes; Richard Kimmel - yes. Motion carried unanimously.
Consider proposed amendments to Sections 10, 32, and 46 of the Weld County Zoning Ordinance. The
amendments establish new definitions for a single family dwelling and manufactured home. The amendments
will permit a manufactured home as a use by right in all residential zone districts and delete the requirements
for a zoning permit for a manufactured home to be used as a principal dwelling when the manufactured home
is located in the Agricultural zone district.
Chuck Cunliffe, referred to the Planning Department's written recommendation for approval to establish a new
definition of a single family dwelling for a manufactured home.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Ron Sommer moved that the amendments to Sections 10, 32, and 46 of the Weld County Zoning Ordinance
be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for
approval. Shirley Camenisch seconded the motion.

Consider proposed amendments to Section 20 of the Weld County Building Code Ordinance. The amendment
creates new construction standards (ANSI A225.1-1987, Manufactured Home Installations. Appendix C.) for
a perimeter sidewall and end wall foundation for a manufactured home.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
No one wished to speak.
Jack Epple moved that the amendments to Sections 10, 32, and 46 of the Weld County Zoning Ordinance be
forwarded to the Board of County Commissioners with the Planning Commission's recommendation for
approval. Ron Sommer seconded the motion.
