SUBJECT: Legal Action Authorization
November 30, 1995
The Department of Planning Services has scheduled the following violations to be considered at
the December 12, 1995 hearing beginning at 10:00 a.m. The Department of Planning Services
is requesting that the Board review the individual cases and determine whether or not to
authorize legal action to remedy the violations.

The Department of Planning also recommends that the County Attorney be authorized to
proceed with legal action against any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or
the Weld County Attorney's office.

LEGAL DESCRIPTION OF PROPERTY: Lot 2, Block 1, Carmacar, Weld County,
Colorado
DATE OF INSPECTION: December 11, 1995
CASE NUMBER: VI -2240
The property was inspected to determine compliance with section 31.2 and 31.3.9 of the Weld
County Zoning Ordinance. The property is not in compliance at this time. There is an
unscreened noncommercial junkyard located on the property. It consists of one derelict vehicle.
The vehicle needs to be removed or screened. If screening is the option of choice then a detailed
screening plan needs to be submitted to the Department of Planning Services for review and
approval prior to installation. When I arrived back at the Department of Planning Services I did
receive a phone message from the property owner. He stated that he had been in contact with a
salvage yard and a prospective buyer for the car. He indicated that it would be gone within a
week or so. I returned his call and I left a message telling him that I was request a two week
extension from the Board of County Commissioners unless I heard differently from him. I did
explain that the case would be referred to the County Attorney.

The property was inspected to determine compliance with section 31.2 and 31.4.8 of the Weld
County Zoning Ordinance. The property is not in compliance at this time. There is a kennel
located on the property. I observed four dogs on the property and am aware that there is a house
dog. The property owner did call me and left a message asking what her options are. She did
state that she is spending a great deal of time at the hospital. I did return her call and left a
message asking her to call and leave an approximate time period for when she would be able to
address the Zoning concerns.

The property was inspected to determine compliance with section 31.2 and 31.3.9 of the Weld
County Zoning Ordinance. The property is not in compliance at this time. There is an
unscreened noncommercial junkyard located on the property. It consists of several derelict
vehicles. Mr. Trostel indicated that it would take him until January 30, 1996 to get all the
vehicles removed. He did indicate that he does not own all the vehicles and that he will have to
contact the owners to get them removed.

CASE NUMBER: VI -2243
The property was inspected to determine compliance with section 31.2 and 31.3.9 of the Weld
County Zoning Ordinance. The property is not in compliance at this time. There is an
unscreened noncommercial junkyard located on the property. It consists of a derelict truck and
miscellaneous trash, scrap metal, tires, plastics. The tenant did say the some of the tires are to
hold the dog's water in place and that a bed frame and springs is blocking off an old well.
The tenant did say that he is a truck driver and that his wife works so they do not have much
time to do the clean up. He did say that with the possibility of the weather getting worse that the
process may be slow. I did ask if two months would be enough time and he did say that he
thought that it would be enough time. He did say that he could not go to the Board of County
Commissioners meeting as he is leaving tonight and that his wife works. There has been some
clean up of the property done since the initial inspection.
