Be it resolved by the Weld County Planning Commission that the application for: CASE NUMBER: Am USR-881 NAME: Lakeview Village, Inc.;C/O Doris Pavlick ADDRESS: 10442 Sante Fe Street Northglenn, CO 80234 REQUEST: A Site Specific Development Plan and Special Use Permit for an existing recreational facility. to hold competitive events in the A (Agricultural) zone district. LEGAL DESCRIPTION: Located in the NE4 of Section 13, T2N, R68W of the 6th 0M., Weld County, Colorado. LOCATION: Approximately 1/4 mile south of Weld County Road 22; west and adjacent to Weld County Road 13. be recommended favorably to the Board of County Commissioners for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance as follows: This proposal is consistent with the Weld County Comprehensive Plan. This land use is not located within the Urban Growth Boundary Area of any municipality. This proposal is consistent with the intent of the A (Agricultural) zone district and is provided for as a Use by Special Review. No overlay districts affect the site. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and County. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The number of tournaments shall be limited to three (3) per calendar year, consisting of no more than two (2) days for each tournament. 951676 RESOLUTION, Am USR-881 Lakeview Village, Inc.; c/o Doris Pavlick Page 2 4. An individual sewage disposal system is required for the facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. A vault system is acceptable. 5. Prior to recording of the plat: The applicant shall submit to the Department of Planning Services documentation that the existing pond on site will not cause injury to vested water rights, as indicated in the letter from John Schurur, dated April 19, 1995. Dated the 16th of May 1995. i Wendi Swanson Secretary 951876 SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Lakeview Village, Inc.; C/O Doris Pavlick Am USR-881 1. The Site Specific Development Plan and Special Review permit is for an existing recreational facility to hold competitive events in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The site shall maintain compliance with the Mountain View Fire Protection District. 4. There shall be no more than three (3) tournaments per calendar year, consisting of no more than two (2) days for each tournament. 5. No permanent disposal of wastes shall be permitted at this site. 6. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. A dumpster or trash cans shall be provided at the site during times of use. 9. The maximum permissible noise level shall not exceed 70 db(A), as measured according to 25-12- 102, Colorado Revised Statutes. 10. An individual sewage disposal system, is required for the facility and shall be maintained according to the Weld County Individual Sewage Disposal Regulations. A vault system is acceptable. 11. The site shall maintain compliance with Section 4.6, Water Quality Standards for Natural Swimming Areas, of the Colorado Swimming Pools and Mineral Bath Regulations (5CCR1003-5). The results of testing shall be submitted to the Weld County Health Department by the 30th of each month for review. 12. All pumps, pits, and oil & gas production facilities shall be adequately fenced with a six-foot chain -link fence with three barbed wire strands on top to prevent trespassing. Gates to the enclosures are to be locked at all times except when operators are present. 13. The reservoirs shall be operated in accordance with the conditions of the decree of Water Court Case No. 85CW443. The reservoirs are subject to administration and water may not be impounded during periods of a senior call on the South Platte River System. During these periods, all inflow, precipitation, etc. must be released and returned to the river without use. 14. The U.S. Army Corps of Engineers shall be notified prior to the placement of dredged or fill material into the lakes. The conditions of the U.S. Army Corps of Engineers shall be complied with. 15. Prairie dogs and mosquitoes shall be kept to a minimum and not become a public nuisance. 16. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 17. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 18. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 351876 Development Standards, Am USR-881 Lakeview Village, Inc.; O/O Doris Pavlick Page 2 19. No commercial use shall be associated with this site without proper permits. 20. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. 21. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing Standards and all applicable Weld County Regulations. Any other changes shall be filed in the office of the Department of Planning Services. 22. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 951876 Hello
