The Weld County Council met in regular session in full conformity with the Weld County
Home Rule Charter at the Weld County Centennial Center, 915 10th St., Greeley, CO.
ROLL CALL: The meeting was called to order by President Pam Malcom. Vice
President Judy Curtis, Councilman Ralph Campbell, and Councilman Dan Oster were
present, constituting a quorum of the members. Councilman Al Roberts was excused.
Also present: Bill Philpott, Matt Johnston, Sharon Hopper, Kay Stehle, Virginia Shaw,
Virginia Scheel, and the Council secretary, Bev Thomas.
APPROVAL OF MINUTES: Councilman Ralph Campbell made a motion to approve
the September 16, 1997 meeting minutes. Councilman Dan Oster seconded the
motion and it was approved unanimously.
APPROVAL OF THE THIRD QUARTER REPORT TO THE PEOPLE: Councilman
Dan Oster made a motion to approve the longer version of the 1997 third quarter
Report to the People. Vice President Judy Curtis seconded the motion and it carried
unanimously.
ADDITIONS TO THE AGENDA: Councilman Dan Oster will give a coordinator report
regarding a possible weed ordinance to control weeds which create blind intersections
on County roads.
APPOINTMENTS: President Pam Malcom and Vice President Judy Curtis will try to
attend the November 10, 1997 Elected Officials Meeting at 1:30. p.m..
Vice President Judy Curtis will participate in the November 18, 1997 KFKA "Coffee
Break" at 8:00 a.m..
CORRESPONDENCE: The Council reviewed the correspondence.
COORDINATOR REPORTS:
Blind Intersections on County Roads Due to Weeds
Councilman Dan Oster had talked to Commissioners Harbert and Baxter about a
County ordinance to take care of weeds on property that Weld County has a right-of-
way on or owns. County attorney Bruce Barker said that there was a state statute that

requires the County to keep down the weeds on property that it has right-of-way to or
owns. Therefore, a weed ordinance is not a viable option. Commissioner Baxter and
Councilman Dan Oster then talked about giving incentive to farmers/landowners to
keep the weeds down. Working with the West Greeley Soil Conservation Board to
come up with a solution is a possibility.
Concerns Regarding Paunch Disposal
Vice President Judy Curtis had talked with Weld County Health Department head John
Pickle about the paunch being disbursed on private land in the Briggsdale area. Mr.
Pickle said that Mr. Jeff Stoll would be sent to find out exactly where the paunch is
being disbursed. John Pickle has said that there is no regulation against the paunch
being dumped, but the paunch is to be turned under so that it is completely covered by
dirt within 24 hours of being disbursed. This is not happening and therefore there is
non compliance with the County nuisance regulation against flies and odor.
Councilman Ralph Campbell suggested contacting the State Veterinarian about
possible recourse to the paunch disposal problem.
On Highway 392 Monfort Packing Plant is also distributing suet. There is a concern
that this eventually causes hardpan that will prevent the soil absorbing moisture.
Waste Processing Plant Near Hudson
The status of a waste processing plant going in near Hudson was discussed.
Weld County Budget Hearings
Councilman Dan Oster reported on the budget hearings he had attended.
UNFINISHED BUSINESS:
Buildings Leased by Weld County
Due to the illness of Councilman Al Roberts the report regarding buildings leased by
Weld County was tabled.
Land Fill Problems in the Erie Area
President Pam Malcom said that Robin Newbrey of the Weld County Health
Department had reported that it is the responsibility of a landfill owner to turn in water
samples to the State of Colorado on a regular basis. If this is not done on a regular

basis, the landfill permit will be revoked. President Malcom said that she had not yet
received an answer from the Weld County Health Department about Councilman
Roberts' concern that the BFI Erie land fill was not complying with the requirement of
cover once in every twenty -four-hour period. President Pam Malcom said that she
would contact Ms. Newbrey regarding this matter.
Illegal dumping in Weld County was mentioned by members of the audience and this
problem was discussed.
Resolution RE: Conflict of Interest Letter
President Pam Malcom read proposed Resolution 115 RE: Trevor Jiricek, Jeff Stoll, and
Laurie Exby. Councilman Ralph Campbell a motion that Resolution 115 be adopted by
the Weld County Council. Councilman Dan Oster seconded the motion and the
resolution was adopted unanimously.
NEW BUSINESS:
Payment of the Bills
Councilman Dan Oster made a motion to pay the following bills:
South Weld Sun Bill for Legal Notice $ 6.39

Mileage for Councilman Al Roberts $48.33
Mileage for Councilman Dan Oster $22.68
Mileage for Vice President Judy Curtis $23.22

Councilman Ralph Campbell seconded the motion and it carried unanimously.
Data Processing Requests for 1998
The Weld County Council reviewed the 1998 Data Processing Request form and
decided the Council had no requests to make.
Secretarial Research Requests
Councilman Dan Oster made a motion to purchase a Tensco cabinet for the Council
office. Vice President Judy Curtis seconded the motion and it carried unanimously.
Reports at Weld County Council Meetings
Councilman Dan Oster made a suggestion that the Council ask a report be given from a
different Weld County Department at each Council meeting for the following reasons:

This would provide information for the public in attendance. It would inform the Council
members. It would provide public exposure to the various departments and help them
understand the Council.
PUBLIC COMMENTS: Kaye Stehle expressed her concern about the many
developments coming into south west Weld County and specifically about the high
density module housing. She said that Sherwood Village will include sixteen -hundred
housing units; that density will have a major impact on traffic in the area and it will be
built on prime agricultural land. Ms. Stehle wanted information regarding the zoning
laws and stated that she didn't think zoning laws are being used as they were originally
planned.
President Pam Malcom referred Ms. Stehle to the Zoning section of the Planning
Department. Ms. Malcom said that Planning and Zoning should be able to explain how
agricultural zoning was changed to another kind of zoning. Councilman Ralph
Campbell offered to contact the Planning Department and find out the status of the
Sherwood Village project. Sharon Hopper asked Councilman Campbell to find out how
a MUD can be repealed.
Virginia Shaw shared her concerns about the impact of Sherwood Village on the
agricultural community. She also stated that Boulder and Longmont have bought
property in Weld County for their open space, but Weld County doesn't seem to be
protecting its open space in south west Weld.
Ms. Shaw pointed out that there is no representation on Weld County's Planning
Commission from south west Weld County, and this area is the fastest growing area in
Weld County. Mrs. Hopper asked the Council to find out if there could be another slot
added to the Planning Commission to represent this fastest growing area of Weld
County.
Sharon Hopper expressed her frustration that she had to track down odor problems and
deal with the increase in traffic in south west Weld County. She reported that Gary
Meyer of the State Patrol had told her that he does not have the personnel to cover the
traffic needs in the area. She stated that asphalt trucks are driving fifty miles per hour
in a thirty mile per hour zone on Weld County roads.
Mrs. Hopper asked if the Weld County Council would give its report about the Weld
County Finance Corporation at its November meeting. President Pam Malcom said that
the Council would do that.

Mrs. Hopper gave the Council copies of the Rinn Township Newsletter. Councilman
Dan Oster suggested that Ms. Hopper check in to "citizens' arrests" and the "right to
farm law."
Virginia Scheel voiced her concerns about these topics: the impact of growth on
Greeley's odor complaints, the number of vagrants using the Poudre Trail, the amount
of money being spent on the Poudre Trail, the possibility of a new correction facility in
Weld County next to Greeley city limits. She asked if the City of Greeley's police force
would be helping to man the new Weld County jail.
