RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST ELEAZAR SOTO FOR VIOLATION OF THE WELD
COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado. pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Eleazar Soto, VI #9900165, is allegedly in violation of the Weld County
Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter; the violation has
not been corrected, and
WHEREAS, on the 13th day of July, 1999, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Eleazar Soto, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until November 13, 1999, to allow adequate time for the property
owner to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Eleazar Soto to remedy the violation of the Weld
County Building Code Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until November 13,
1999, to allow adequate time for the property owner to bring the subject property into
compliance.

August 20, 1998 Permit Number PR-9830218,was issued for a manufactured home. Periodic inspections
occurred through February 17, 1999, but some corrections were required.
February 16, 1999 An extension was authorized until May 1, 1999 due to financial reasons. A faxed
request in writing was received March 3, 1999 for the extension.
May 14, 1999 A 10 day letter from Tom Potter was sent out.
April 28, 1999 A second extension was authorized due to the same financial reasons. A faxed request
was received on April 30, 1999.
June 07, 1999 Building Code Violation was issued by Joe Mendez. 30 Day Letter was sent out.
June 08, 1999 Contact was made with Mrs. Perez regarding the violation. Message was left for Eleazar.
June 11, 1999 Contact was made with a different person, a male. Message was left for Eleazar.
June 17, 1999 Contact was made with Mrs. Perez regarding the violation. Message was left for Eleazar.
June 21, 1999 Contact was made with Mrs.Perez regarding the violation. Message was left for Eleazar.
June 22, 1999 I received a call from Eleazar Soto. He had mentioned that he was having some
financial problems and needed some more time to complete the inspections. I
recommended that he go to the hearing and explain his situation and discuss all his
options regarding this violation. He will be attending the hearing scheduled for the 13th
of July, 1999.
June 24, 1999 Scheduled Hearing Letter was sent out by Joe Mendez.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.

Attorney's Office.

Several attempts were:previously made to make contact with Mr. Eleazar Soto regarding the
violation, but only messages were left for him to contact me. On 6/8, I spoke with Ms. Perez
and explained the situation. She gave him the message. Another attempt was made on 6/11
inwhich I spoke with a different person, I believe it was his brother. I left another message
on 6/21 with Ms. Perez and told her it was important for him to contact me.
6/22 -I received a call from Mr. Soto. I had explained that he already had 2 extensions. He
said that due to financial difficulties, he was unable to complete the job. I told him that

Dear Mr. Soto:
The property referenced above remains in violation of the Weld County Building Code Ordinance. I
have scheduled a meeting with the Board of County Commissioners on July 13, 1999 , at 10:00 a.m.
to consider the violation occurring on the property. This meeting will take place in the County
Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance to answer any questions
the Board of County Commissioners might have about the violation. This would be a prime
opportunity for you to explain your financial situation and to request an extension to complete the
necessary inspections and to close out this violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation if
you or a representative are not available. Our records indicate that you were made aware of the nature
of the violation, the action necessary to correct the violation, and that you were given sufficient time to
remedy the violation. If you have any questions concerning this matter, please call me.

Legal Description: 2 AR44-1 L1 & 2 BLK 44 2ND ARTS 1'ROCRAT RANCHETTES
The building official has determined that the above described property is in violation of Sections 20.8.1,
20.8.2.2, 20.8.2.4, 20.8.3, 20.8.4, 20.8.6, 40.5.1, 40.5.2, 50.5.3, 60.5.2, 70.5.1, 71.3 and 70.5 of the Weld
County Building Ordinance. Setbacks, blocking, tie-downs, caissons, skirting, steps and landings,
mechanical,final mechanical,final electric final plumbing, certificate of occupancy, final approval and all
other required inspections. The Weld County Building Ordinance requires that all manufactured home
permits be completed within 180 days after the permit is issued. Permit PR-9830218 expired May 1, 1999.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however,we have no discretion in this matter. If you fail to correct this violation by June 15, 1999, it will
be scheduled for a hearing before the Board of County Commissioners to consider whether to refer this
violation to the County Attorney's office for legal action.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be approved for the following reasons:
1. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance
with Section 43.2.6 of the Weld County Zoning Ordinance, as follows:
a. Section 43.2.6.1.1-The proposed mobile home is compatible with the surrounding area, is
in harmony with the character of the neighborhood and its effects upon the immediate area.
The surrounding area is an Agricultural subdivision with mostly mobile homes and
manufactured homes and Agricultural uses.
b. Section 43.2.6.1.2-The proposed mobile home is compatible with the Weld County
Comprehensive Plan. The mobile home will be placed in an Agricultural subdivision to be
used as a principal residence and will not interfere with agricultural uses.
c. Section 43.2.6.1.3-There is available water and sewage disposal facilities for the mobile
home. Tie applicant has applied for a cistern permit and a septic permit with the Weld
County Health Department.
d. Section 4:3.2.6.1.4-The general health, safety and welfare of the inhabitants of the area and
the county will not be jeopardized or compromised by the location of the mobile home n this
site.
The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home
on the property.
2. Prior to the occupance of the mobile home, the mobile home shall be connected to an approved
septic system and a legal water supply.
3. The mobile home shall meet the minimum setback and offset requirements for the A(Agricultural)
zone district.
4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions
1 through 3 as stated above.

I am writing to you on behalf of Mr. Eleazar Soto and his request for
an extension of time to complete the setting of a mobile home in
Aristocrat Ranchettes.
Mr. Soto has encountered substantial delays— primarily in obtaining
the financing. The major obstacle has been an issue(personal)with
the IRS which involved child support. Mr. Soto is current in Colorado
on payments, however the State of New Mexico showed him in
arrears by several thousdand dollars. As a result of this outstanding
debt showing on his credit report he has been unable to get a loan
approved to enable him to accomplish the set-up and utility connections.
On Friday, July 9, 1999, we received by fax a communication from the
Albuquerque IRS office which finally brought that account up-to-date.
With this information now in hand Mr. Soto can proceed with his
loan application and should be able to finalize the new residence in
the next 4 months(120 days), unless he runs bad weather early in
the fall this year.
Your consideration and approval of his request for this extension will be
greatly appreciated.
The fact that Mr. Soto has not just thrown up his hands and said "forget it"
is commendable in light of the numerous obstacles he has had to over-
come!
