RE: Beebe Draw Water and Sanitation District

We received your letter of May 20, 1997, concerning the Beebe Draw Water and
Sanitation District (Beebe Draw) which requests the Adams County
Commissioners to take affirmative action concerning allegations against Beebe
Draw. In particular, we are aware of and have had our staff review the on -going
dispute between Beebe Draw and the Town of Lochbuie.
We attach a copy of our letter to Mayor Fisher of the Town of Lochbuie. As
indicated to Mayor Fisher, we have, for the present, declined to pursue additional
litigation with Beebe Draw.
We appreciate your concerns regarding this matter and hope that pending litigation
for the Town and Adams County are resolved favorably.

RE: Beebe Draw Water and Sanitation District
Dear Mayor Fisher:
Commissioner Strickland brought your correspondence of May 19, 1997, expressing
Lochbuie's concerns regarding the Beebe Draw Water and Sanitation District (Beebe
Draw) to the Board of County Commissioners. We understand that there are outstanding
disputes between the Town and Beebe Draw which are before the Weld County District
Court. Just as the Town is involved in litigation, so is Adams County. We currently have
a case pending in Adams County District Court with the City of Brighton and Beebe
Draw, concerning utility service to the new Adams County Courthouse. We are advised
that additional litigation with Beebe Draw would not clarify or simplify the pending
litigation.
Consequently, Adams County respectfully declines to institute or join in an injunctive
action against the Beebe Draw Water and Sanitation District.
In the event that your pending litigation in Weld County results in an adverse decision, we
would again review your request for action.
