Re: Information Regarding Insurance for The Taking of Villa's "Vested Property
Right"
Gentlemen:
Our research discloses that no insurance coverage for indemnity is provided for the taking
of private property such as we understand is anticipated to be ordered by the District
Court as relates to the pre-parole facility proposed by The Villa at Greeley, Inc. ("The
Villa"). Exclusionary language of the policy of insurance available to Colorado Counties
Casualty and Property Pool (CAPP) and its participating member counties which includes
Weld County clearly states as follows:
•
",..We won't cover loss that results from eminent domain,
inverse condemnation,regulatory taking,adverse possession
or dedication by adverse use.
Nor will we cover any loss that results from: any method
or proceeding used in the taking or controlling of private
property for public use; or the diminution in value, or
inverse condemnation, of property that's caused by the
taking or controlling of private property for public use..."

It certainly appears,under the information available to me, that insurance coverage is not
available for any compensation which may be awarded The Villa in the pending case.
