IN tHE MATTER OF COUNTY
PRINTINU AND ADVERTISING.
The time having arrived for opening the .;uvorqi plopJ,;(2,1g received
for doing the County Printing anl. advertising required by Weld County for the ensuing year) the
clerk proceeded to open and read the bids of The Weld County Republican, The Greeley Sun
and the The Greeley Tribunes being all the proposals received, and after carefully looking
over each and taking care that all items were checked, 6it was found that the bid of The Weld
County Republican was the lowest and most satisfactory bid received, on motion ordered that
the bid of the Weld County Republican be and the same is hereby accepted , with one exception
in that the Board reserves the right to be governed by prices received from any printing
firm in the state for the printing of the official ballots etc . and should the Weld County
Republican agree / to print said ballots at the best figures received, then and in that case
the printing of said ballots will go to said Weld County Republican; providing its executing
and delivering a good and sufficient bond in the penal sum of $1000. for the faithful per-
formance of its contract .

The following petitions were presented, and after carefully examining the claims made
therein and the Board being fully advised in the premises , on motion it was ordered that
action be taken on each as follows , viz : --
A. A. Woodbury Petition praying for a rebate of 1901 taxes not gral;ted.
A. A. Woodbury Granted a rebate of taxes for the year 1902 (1,4 Erroneous assessment
on N. E.4 Section 32, Tp . 6 N. , R. 64 W, on a valuation of 0.700 .
A. E. Mead. Granted a rebate of 1903 taxes % Erroneous assessment on N. 2/ of .
Lots 1--2--3--4 and N.3/5 of Lot 5, Block 44 , Greeley on a valuation
of 4200.
IN THE MATTER OF CHANGING THE NAME
OF NANTES PRECINCT TO LA SALLE.
Several of the residents of Nantes Precinct No . 2d appeared
before t?^e Board and requested that the name of said Precinct be changed from Nantes to
LaSalle , and after carefully considering said request and the Board beim! fully advised in
the premises on motion it was ordered that their request - be granted and that said precinct
be and the same is hereby designated as La Salle Precinct No . 28 .

PLACE IN PRECINCT NO . IS .
Upon request of several of the residents of Crow Creek Precinct No .
18, the voting place in said precinct is hereby changed from the Peter Brown School House '
tothe Crow Creek school house .
f ) IN THE MATTER OF CHANGING VOTING PRECINCTS
14 and 15 AND CREATING NEW PRECINCT NO . 4,1 .
A petition signed by L . C . Mead, E E. Oviatt and
fifty-five others praying that election precinct No . 14 be divided so as to accomodate a- 1
voters situated therein was prese.:_ted to the Board when the following action was taken and
entered of record, to-wit : --
It appearing to the Board that a great deal of dissatisfaction exists as to the polling
place in said precinct No . 14, and the Board wishing to settle any further disputes with re-
gard to same, on motion ordered that one tier of sections off the south side of Surnyside
precinct No . 15 and two tiers of sections off the North side of Highlandlake precinct No . 14
be seggregated from said two precincts and constituted as Highlandlake Precinct No . 14, and
that each precinct be bounded as follows, to-wit : --

That all the territory lying within the following boundary lines be and the same is hereby
constituted as Highlandlake Voting Precinct No . 14, to : wit : --Commencing at the N. E. Corner oll

Thence South Three miles ; Thence East six miles ; thence North Three miles to place of begin-
ning. Voting place to be at Highlandlake Hall.
PRECINCT NO . 15.
Th1t all the territory lying within the following describe&. boundary lines be and the
same is hereby constituted as Sunnyside Voting Precinct No . 15, to-wit : --Commencing at the N. E.
Corner of Section 1� Tp .4 N. ) R. 68 W. ; thence running due West Six miles ; thence due South
Five miles to S.W. Corner of section 30 thereof ; thence East six miles to S. E. Corner of sec-
tion 25 thereof ; thence due North and along range line a distance of five miles to the place
of beginning,. Voting place to be at school house .
PRECINCT NO . 41.
That all the land lying within the following described boundary lines he and the same is
hereby constituted Voting Precinct No . 41, to-wit : --Commencing at the N. E. Cor-
ner of Section 13 Tp . 3 N. R. 68 ; thence running due West six miles to N. W. Corner of Sec-
tion 18 thereof; thence south four miles to S. W. Corner of Section 31 thereof ; thence East
Three miles ; thence North .one mile ; thence East three miles to S. E. Corner of Section 25 there•
of; thence North three miles to place of beginning. The Voting place to be at Liberty Hall .
And it is further ordered for judicial purposes that said voting precinct No . 41 shall be
and hereby is included in Justice Precinct No . 14, Highlandlake .

The statement of the Expenditures for the relief of the poor for the month of March

The following petitions praying for a rebate of taxes were presented and after catefulli
examining each, and the Board being fully advised in the premises ; on motion ordered that

constituting the Board of Directors of the Union Reservoir' Company' appeared before the

Board to see what action, if any, had been taken in regard to the abandonment of one mile .
ot road lying between sections 30 and 312 Township 3 North, Range 68 West, as petitioned for
January 52 A. D. 1904, and finding that nothing had been done with regard to same urged upon
the Board the necessity of immediate action; after listening to their argument the greater
part of the day in support of said petition, the Board was of the unanimous opinion that
•
said petition should be granted, provided that a good practicable route can be secured to _
take the place of said abandoned road; after carefully discussing the matter pro and con
and taking into consideration the rights of all people , on motion ordered that the matter be
taken under further advisement so that the Board may have time to see what can be done with
regard to the securing of a new right of way. .

The meeting then adjourned to 9 o ' clock A. M. Wednesday, June 12 1904 .

IN THE MATTER OF DISPOSING OF REAL PROPERTY •
HELD BY WELD COUNTY.
Fritz Niemeyer same before the Board and stated that Lots 13
and 14, Block 21 and Lots 5 and 6 Block 13 in the Town of Evans are now held by Weld County,
and that he desired to purchase the interest of the county in said lots and offered to pay
the sum of $19. 28 therefor.
Upon investigation it was found that said lots, was sold to the county in 1896 for the
taxes of prior years ; that said property is still held by Weld County by virtue of said sale
that in consequence Of said property being held by said Weld County no taxes were paid upon
same until 1901, when Mr. Niemeyer again commenced paying said taxes again, and in order to
straighten the matter out and place said property back upon the tax rolls as it should be it
was thought best to dispose of the same ;
Therefore it was on motion ordered that the offer of Mr . Fritz Niemeyer be and the
sane is hereby accepted, and the county treasurer be and he is hereby authorized and direc-
ted to issue a redemption certificate for said property upon the payment of the said sum of
119. 28.

:/U IN THE MATTER OF PETITION TO ABANDON
COUNTY ROAD NO .46 OR ONE MILE THEREOF.
A petition signed by J. S. Barber, James L. McCain and
numerous others praying for the abandonment of One mile of County Road No . 46 that lies be-
tween sections 30 and 31, Tp . 3 N. , R. 68 West was presented to the Board when the following .
action was taken and entered of record, to-wit :--
It appearing to the Board that the right of way asked to be vacated and abandoned
as follows viz : --One mile of road 60 feet in width lying between sections 30 and. 312 tp , .
3 N. , R. 619 west , as it now is , is positively impassable at certain seasons of the year
on account of the same being seeped to such an extent that it is nothing less than a small.
lake ; and the Board believing the Public good requires that said road be closed on mo-
00 tion ordered that the prayer of the petitioners be granted and the above described road , .
be and the same is hereby declared vacated and abandoned from and after this date , viz : --
June 4, 1904 .
By the abandonment of the above described road, and complying with the law made and , ,
u provided for such cases it was further ordered that the following line of road, viz : --
Commencing at a point a little east of the S. W. Corner of the S.W. of Sec . 29, Tp .
N9 p 3N. , R. 68 West and running from thence in a northwesterly direction on a curve and ,
' along the High Water line of The Union Reservoir to a point where the inlet ditch
iLN empties into said Union Reservoir ; thence in a southwesterly direction and along the
f High Water Line of said reservoir to a point about 1300 feet north of the South line
of the S. W. * Sec . 30, Tp . 3N. , R. 6a ; thence due West from the last named point
to the West line of Weld County and connecting with the County Road which runs north
and south from the last named point, Said road to be sixty feet in width
be and the ' same is hereby declared a public highway . The Clerk is directed to record the
petition vacate the old road and plat the new road 'and notify the road overseer of the
proper district to open the same to travel at once.

County Treasurer ' s report for the month of May 1904 was presented, examined and on mo-
tion audited and ordered placed on file .
The petition of W. B. Woodruff pyaying for an abatement of taxes for the year 1903 on
account of Double assessment was presented and after carefully investigating the claim made
therein and the Board being fully advised in the premises on motion ordered that he be
granted a rebate on personal property on a valuation of 4130 .
IN THE MATTER OF APPOINTMENT OF CON-
STABLE FOR JUSTICE PRECINCT NO . 3 .
A petition signed by E. D. Riker and numerous others pray-
ing for the appointment of Frank Fowler to the office of Constable within and for Justice
Precinct No . 3 was presented and after carefully investigating the matter it was found that
George Gray who was appointed March 3, 1903 lad never qualified, therefore it was on motion
ordered that the prayer of the petitioners be granted and that Frank Fowler be and he is
hereby appointed to the office of Constable within and for said Justice Precinct No . 3 , pro-
viding that he will file his bond in the penal sum of 11000 . for the faithful performance of
his duties .
The Justice ' s accounts of Thos Tregoning, E. P . House in the cases of the People of the
State of Colorado vs . Frank Dupree ; Cliff Brown; Cal Haney; Lon Deitrick ; We' b S. Logan;
Halmuth Sanders ; Dwight E. Bone ; Cal Haney; Ben W. Hilton and Webb S. Logan respectively
were presented, examined and on motion were allowed for the amounts stated on each .

TIFTOATE FROM TAX SALE OF 1880 .
Frederick M. Dille , having filed his affidavit showing that
in 1880 he became the purchaser of tax sale certificate of lot 6, Block 6o, Greeley, being
certificate No . 22 , sales of 1,879; that said certificate of purchase has not been redeemed,
but that said certificate of purchase has since been lost and after diligent search he has
been and is still unable to find the same ; that said tax sale is a cloud upon the title to
said real estate and he asks that the Board, by proper order entered of record, authorize the
County Treasurer of Weld County to issue his certificate of redemption from said sale .
It appearing to the Board that the said Frederick M. Dille has filed his indemnifying
bond in the penal sum of of $10. 00 to save and keep harmless the said County of Weld and all
of its o7ficials from all damages that may be occasioned by said redemption without the sur-
render of the original certificate of purchase, it was , on motion ordered that tie County
Treasurer - e and he is hereby authorized and empowered to issue proper redemption certificate
for said real estate from the tax sale of 1630 upon payment of the proper fees therefor .

A petition of The Great Bend, Farming, Stock, Land,
Ditch and Mercantile Company as follows, viz : --
TO THE HONORABLE BOARD OF COUNTY COAMMISSIONERS, WELD COUNTY, COLO .

(4ENTLEMEN: --We the undersigned, Citizen Corporation of your county, respectfully
represent that the necessities of the Public does not require the maintenance of that
part of County Road No . 371 that lies between the S.W.4 of Sec. 7, Tp .4 N. R. 65 and
the N. W.4 Sec. 1S same township ad range for the reason that at this point lies the -
Clark Reservoir which at all seasons of the year is nothing less than a large lake
which completely covers said road, necessitating the travelling public to go along
�° the north side thereof . And for the further reason that the owner of three forths of
fro the land abutting on the strip of road which you are petitioned to abandon have hereto-
. fore conveyed to Weld County a good road a short distance to the north thereof, acr-
oss an expensive dyke , built by the company asking this abandonr::ent, which deed of
conveyance is a matter of record, and which was given because the traveling public
q insisted in traveling over the same , breaking down the fence of your petitioner, the .
said company, and with the understanding that the said Weld County would abandon the
40ld road in question and maintain the road across the aforesaid dyke ..

was presented to the Board when the following action was taken and entered of record, to-wit: .
It appearing to the Board that the line of road asked to be abandoned is useless for a
public road on account of the Clark Reservoir covering same and that the petitioners herein
have provided another road in its stead, on motion it was ordered that the prayer of the
petitioners be granted and that said road be and the same is hereby declared vacated and
abandoned. The clerk is directed to record the petition and vacate the road as granted.

month for the ears and maintenance of Millie Craft a pauper child at the Peck School, Denver
said amount to be paid to Mrs Darling agent of the W. C . T . U. of Greeley, after carefully
considering the matter and the board being fully advised in the premises on motion it was
ordered -that the said sum of $5. 00 be and the same is hereby allowed per month for the next
ensuing year, unless sooner revoked by the Board.

IN THE-MATTER OF TRANS-
FERRINC FUNDS .
The following resolution was unanimously passe ' and adopted, to-wit :
WHEREAS, It appearing to the Board that an Overdraft now exists in the General County .
Fund, and, .
WHEREAS, It appearing that there is a balance to the credit of the Contingent Fund in
the sum of $3596. 25; .
THEREFORE RESOLVED, That the County Treasurer be and he is hereby authorized and direc-
ted to transfer to the General County fund the balance now to the credit of the Contingent
Fund for the purpose of reducing the Overdraft now in the said General County Fund.
The petitions of S. L . Getchell and Thomas LaVelle praying for a rabate of taxes for the

year 1903 were presented, ,,a1V after c%retuily examining the claims made therein and the BoarI
being fully advised in the Premises on motion it was ordered that said S. L. Getchell be gran-
ted a rebate of all taxes assessed against him under schedule G/192 and that the County ' Treas-
urer be and he is hereby ordered to reassess same that the school districts be properly
steeightened out ., That tHos Lavelle be granted a rebate on a valuation of $235.

A petition signed by F. C. Mapes, C. F. Keys and
twenty-one others praying that election precincts 28 and 29 be 6O .;unuged and diviaeu. Lint a,
new precinct No . 42 may be made therefrom was presented to the Board when the following ac-
tion was taken and entered of record, to-wit : --
It appearing to the Board that the voting places in both precinct No . 2$ and 29 are loca-
ted at the most distant points therein and after carefully investigating the matter and being
fully advised in the premises found that such was the case, and wishing to accomodate all the
voters living in said precincts, on motion ordered that the following described lands be and

all the lands so seggregated from the above named precincts be and the same are hereby made

WaS p esented to the Board when the following action was taken and entered of record, to wit :
The Board having carefully considered the report of the viewers herein, as well as the
objections made thereto, and finding the report correct as to form, and believing the public
ho
good requires the laying out of the road as recommended by the viewers ; it was on motion
ordered tha the report be approved and adopted, and the road therein described and recom-
mended by the viewers be and is hereby declared a public highway. The clerk is directed to
record the report, plat the road, draw warrants in favor of parties for damages awarded, and
cause notices to be posted of the opening of said road, and notify the road overseer of
proper district to open thbhsame to travel in sixty days as required by law.

IN THE MATTER OF APPOINTMENT
OF JANITOR FOR COURT HOUSE.
It appearing to the Board that the term of appointment of L. R.
Oney, Janitor of the Court House, has expired and that several applications for said posi-
tion has been filed with the Board, the clerk proceeded to read the several applications
aad after carefully considering the name of each applicant, on motion ordered that George H .
Miller of Greeley, Colorado be and he is hereby appointed Janitor of the Weld County Court
house for the term of one year with a salary at the rate of $50. 00 per month. He to hold
said position for said term of one year unless sooner -discharged for good and sufficient '
cause .

sitting as a Board of Equalization for the purpose of Adjusting and Equalizing the Asseesment
roll for the year 1904 .
IN THE MATTER OF CHANGING THE VOTING
PLACE IN CROP) CREEK PRECINCT NO . 16.
The following resolution was unanimously passed and
adopted, viz : --
WHEREAS, It appearing to the Board that several of the voters , residents of Crow Creek
Precinct No. ) have requested that the voting place therein be changed from the iirown
School House to the Lincoln School House, School District No. 87, and,
WHEREAS, It being the unanimous opinion of the Board that by making said change it
would accomodate the residents living therein better than at the old voting place ;
THEREFORE BE IT RESOLVED, By the Board of County Commissioners of Weld County, Colors-
do that said voting place be and the same is hereby ordered changed from said Brown School
house to that of the School House of School District No . 87, better known as the Lincoln
school. And it is further ordered that the Clerk note said change upon the records of his
office .

Now on this day the Board having under reconsideration the petition of Jos .
Leggitt praying for a rebate of taxes assessed against him for the year 1903 on the W. j S.W.4
Sec . 13 , Tp . 5N. , R. 65 W. , the same having been heretofore presented and granted upon a
valuation of $200. 00. And it now appearing that an error was made in making out said peti-

tion in as much as petitioner asked for a rebate on a valuation hen his intentions were to
ask for a reduction on$1100. . That his reasons for asking this reduction is on account of
said land not being subject to taxation as petitioner has not as yet received any title to
same, and it still lies in the name of the Government ; The Board now being in possession
of these additional facts in the matter and believing that he is entitled to a further re-
bate, on motion ordered that the prayer of the -petitioner be and the same .is hereby granted
and that he be allowed a reduction of taxes on a valuation of $900. 00.

A petition was presented from C. B. Eggleston setting forth that the S. f N. W.* Section

10, Tp . 2N. , R. 66 W. was assessed for taxes for the year A. D. 1901 rind under said assess-
ment . was sold for 'taxes and costs to E. P. House; December 22; A. D. 1902, amounting to
$21.64 ; that said sale was erroneous for the reason that said land was nOt _subject to tax- ••
ation for the taxes of the year 1901, as appears from -the Certificate of the register of
the U. S. Land Office at Denver , Colorado; attached -to said petition, showing that final
proof was first made and receivers certificate first issued for said land on November 1a� A.
D. 1901; that said sale is a cloud on the title to said land and petitioner prays that said
tax safe be redeemed without cost to him. After carefully investigating the matter and the
board being fully advised in the premises, it was , on motion ordered that the prayer of the
petitioner be and the same is hereby granted. The clerk is directed to draw a warrant for
424 .66 in favor of George D. Statler, County Treasurer account E. P. House the purchaser at
said sale and receive from him an assignment of the sale that the same may be recorded

PROPRIATTON FOR THE STATE FAIR.
J. E. Topping, President of the Colorado State Fair of Pueblo
appeared before the Board and prevailed upon them to make an appropriation of $100 . in which
to. make an exhibit of the various grains and fruits of the County. After carefully consider-
ing the matter and taking into consideration the benefits derived by the General Publi , on
motion ordered that an appropriation of $50.-00 be made for the purpose of collecting the
various samples as donated. -

JUSTICE OF THE PEACE IN AND FOR J. P. PRECT. NO . 5.
The resignation of James L. McCain
as Justice of the Peace in and for Justice Precinct No. 5 was presented, examined and. on

pointment of Wm. D. Young to fill the vacancy caused by the resignation of Mr . McCain, after
carefully considering the matter and the Board being fully advised in the premises , on mo-

A petition signed by Frank Benton and numerous others praying for
a bridge over and across the Platte River just East of Hardin station was presented to the
Board when the following action was taken and entered of record, to-wit : --
It appearing to the Board that the Bridge herein prayed for, owing to the location
thereof, is a matter that should be carefully investigated, and the Board wishing to be
fair with each petitioner , on motion ordered that ROBERT STEELE, A. H. IRONS and A. M. PLUMB

The Semi-annual report of the Clerk of the District Court for the Six months ending
June 30, A. D. 1904 was presented, examined and on motion ordered approved and placed on
file.

Butchers Bond of Irvin M. King and Edward J. Gainer in the penal sum of $1000. was pre-
sented, and after carefu ily examining same and the Board being satisfied with the surety
thereon on motion ordered that same be approved and placed on file .
