SUBJECT: USR-1059 A-1 Organics
September 20, 1995
The Weld County Health Department recommended a change to development standard number 3 and
the addition of another standard in a Memorandum dated August 14, 1995.
Department of Planning Services staff recommends that development standard number 3 be changed
to read as follows:
3. The Weld County Health Department and the Weld County Planning Department shall be
notified in writing of any new materials (other than Manure\Bedding) proposed for
composting. Written approval to proceed with composting shall be obtained from the
Weld County Health Department prior to receipt of the new material. Submittal
information shall include operational procedures. All materials considered for composting
shall meet current and future regulatory requirements for that specific material.
Department of Planning Services staff recommends that the following standard be added and
numbered standard 5, with all other standards that follow being renumbered accordingly.
5. No stockpiling of raw material such as manure/bedding, food waste, Bio Solids, or any
other putrescible material shall be allowed on site. All raw, uncomposted material shall be
placed in windrows or other processing unit within 72 hours upon receipt at the facility.
This Shall not include bulking agents such as wood chips, grass clippings Etc.
Department of Planning Services Staff recommend the addition of the following Development Standard
based on Teresa Jones Letter dated September 19, 1995. Staff recommend that the standard be add
and numbered standard 6, with all other standards that follow being renumbered accordingly.
6. Records shall be maintained which include the number of vehicles delivering raw
materials to the site, the amount of tons of raw materials delivered to the site, the number
of vehicles removing finished materials from the site, and the amount of tons of finished
materials removed from the site. An annual report based upon a calendar year shall be
submitted to the Department of Planning Services on the first day of February of each
year and every subsequent year based upon the previous year's records.
Department of Planning Services staff recommends that the following condition of approval be added
as number 5.
5. The use of the property shall be maintained in compliance at all times with the Colorado
Department of Transportation requirement.

The criteria for review of this Special Review permit is listed in Section 24.3 of the Weld County Zoning
Ordinance.
Planning Commission Function:
This proposal requires two separate actions by the Planning Commission. First, a recommendation to the
Board of County Commissioners consistent with the requirements listed in Section 24.3 of the Weld County
Zoning Ordinance for the Special review permit. Second, a recommendation to the Board of county
Commissioners consistent with Section 45.4 of the Weld County Zoning Ordinance for the certificate of
designation. The planning commission shall be guided in its review of a certificate of designation by the
regulations contained in the State Statutes. A copy of the requirements for the consideration of a certificate
of designation are provided. Historically, the Planning Commission has listened to all the testimony required
for both actions and then developed two separate recommendations.

LOCATION: Approximately 1/2 mile north of State Highway 66 and one mile east of Weld County

The Department of Planning Services' staff recommends approval of the request for the following
reasons:
1. The submitted materials are in compliance with the application requirements of Section 24.7
of the Weld County Zoning Ordinance.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Sections 24.5 and 24.6 of the Weld County Zoning Ordinance:
The location of the Special Review Permit Area, and the attached Conditions of
approval and Development Standards make the proposed use consistent with the
Weld County Comprehensive plan's Agricultural, Urban Growth Boundary Area, and
Environmental Quality and Natural Resources Goals and Policies.
The proposed use is consistent with the A (Agricultural) zone district and is provided
for as a Use by Special Review.
The proposal is compatible with the existing surrounding land uses and with the
future development of the surrounding area as permitted by the existing county
zoning and the Weld County Comprehensive Plan. The surrounding land uses
include farm production and rural residences.
No overlay district affects this site.
The Special Review Permit Development Standards will provide adequate protection
of the health, safety, and welfare of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses form the referral entities.

The Department of Planning Services' staffs recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit shall be adopted and
placed on the Special Review plat prior to recording the plat. The plat shall be delivered to
the Department of Planning Services and be ready for recording in the Weld County Clerk
and Recorder's office within 15 days of approval by the Board of County Commissioners.
2. No building or electrical permits shall be issued on the property until the Special Review plat
is ready to be recorded in the office of the Weld County Clerk and Recorder.
3. Prior to recording the plat, the facility operator shall submit a fugitive dust plan to the Weld
County Health Department for review and approval and a copy of the approved plan shall be
submitted to the Department of Planning Services.
4. The facility shall be maintained in compliance at all times with the Mountain View Fire
Protection District.

1. The site Specific Development Plan and Special Review permit is for a composting facility
for no more than 100,000 finished tons of compost per year in the A (Agricultural) zone
district as submitted in the application materials on file in the Department of Planning
Services and subject to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld
County Zoning Ordinance.
3. The facility shall only compost non -hazardous solid waste materials. The facility shall advise
in writing the Weld County Planning Department, the Weld County Health Department, and
the Colorado Department of Public Health and Environment of any new (not previously
indicated in the submitted Special Review permit and Certificate of Designation application
materials) materials proposed for composting prior to initiation of site composting of product.
4. The facility shall be limited to processing of 100,000 finished tons of compost per year. In
the event the facility expects to process finished product in excess of 100,000 tons per year,
an amendment to the Special Review permit shall be submitted to the Weld County Planning
Department.
5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
6. No permanent disposal of wastes shall be permitted at this site.
7. Waste materials shall be handled, stored, and disposed of in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
8. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as
measured according to 25-12-102, Colorado Revised Statutes.
9. An individual sewage disposal system, is required for the facility and shall be installed
according to the Weld County Individual Sewage Disposal Regulations. A vault system shall
be acceptable. If a vault is installed, pumping records shall be kept for review.
10. The facility shall be operated in a manner to control flies. The fly control plan shall be
implemented at the request of the Weld County Health Department in the event that flies
(which can be determined to be associated with the facility) are in such a number to be
considered a nuisance condition. The plan shall also be implemented in the event the Weld
County Health Department receives a significant number of fly (associated with facility)
complaints and in the judgement of the Health Officer, there exists a fly condition requiring
abatement.

11. Any solid waste as defined in the regulations pertaining to Solid Waste Disposal Sites and
Facilities (6 CCR 1007-2) received or generated at the site must be removed and disposed
of at an approved sanitary landfill.
12. The facility shall have on -site and available to the Weld County Health Department, Weld
County Planning Department and Colorado State Health Department at all times the specific
procedures to handle the following:
a. hazardous materials received on -site
b. contamination or discharge of water from the site
c. odors in excess of established limit
d. flies determined to be a nuisance condition
e. dusty conditions
13. The facility shall be operated in a manner which controls odor. Odors detected off -site shall
not equal or exceed the level of fifteen -to -one dilution threshold, as measured pursuant to
Regulation 2 of the Colorado Air Pollution Control Regulations. The odor abatement plan
shall be implemented at the request of the Weld County Health Department in the event odor
levels detected off -site of the facility meet or exceed the level of fifteen -to -one dilution
threshold or in the judgement of the Weld County Health Officer there exists an odor
condition requiring abatement.
14. The facility shall be operated in a manner to control fugitive dust at all times. The facility
operator shall implement the approved plan for controlling fugitive dust at the request of the
Weld County Environmental Protection Services Division. Any changes or updates to the
plan for controlling fugitive dust shall be made by the facility operator when requested in
writing by representatives of Weld County.
15. The Special Review permit site and facility shall be operated in compliance with any required
Air Emission Permit approved by the Air Pollution Control Division of the Colorado
Department of Health
16. A metal sign shall be posted at the facility entrance near Colorado Highway 66. The signs
shall be a minimum of three feet in width and four feet in length. The sign shall state the
following:
a. name of operation
b. type use
c. emergency phone numbers

17. The facility shall comply with the Regulations Pertaining to Solid Waste Disposal Sites and
Facilities (6 CCR 1007-2) the facility shall also comply with any composting regulations
promulgated Pursuant to the Solid Waste Act, Section 30, Article 20, Part 1, C.R.S.
18. The facility shall comply with all materials submitted as the result of this Certificate of
Designation and Use by Special Review application. These include the USR application
dated March 25, 1995, the geologic and hydrologic conditions dated May 23, 1995, and the
final drainage report dated May 9, 1995. In addition the facility shall comply with all
supplemental materials requested by either Weld County or the Colorado Department of
Public Health and Environment.
19. Portable fueling equipment shall be kept within a bermed area to contain any spills.
20. The property owner shall be responsible for complying with the Design Standards of Section
24.5 of the Weld County Zoning Ordinance.
21. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 24.6 of the Weld County Zoning Ordinance.
22. Personnel from the Weld County Health Department and Weld County Department of
Planning Services shall be granted access onto the property at any reasonable time in order
to ensure the activities carried out on the property comply with the Development Standards
stated hereon and all applicable Weld County Regulations.
23. The Special Review area shall be limited to the plans shown hereon and governed by the
foregoing Standards and all applicable Weld County Regulations. Major changes from the
plans or Development Standards as shown or stated shall require the approval of an
amendment of the Permit by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards are
permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
24. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of County Commissioners.

The Department of Planning Services' staff recommends approval of the request for the following reasons:
1. The conditions of approval and development standards included in USR-1059 will minimize the
impacts to the surrounding property and the area to the greatest extent possible. The conditions of
approval and development standards will also provide adequate protection of the health, safety,
and welfare of the inhabitants of the area and the county.
2. The location of the solid waste disposal site will be convenient and accessible to potential users.
Access to the site is proposed from State Highway 66. The proposal was reviewed by
representatives from the Colorado Division of Highways and offered no concerns regarding this
proposed development.

4. The Colorado Department of Health and the Weld County Health Department have reviewed this
request and find, Subject to Conditions, that the proposal will comply with the Standards of the
Solid Waste Disposal Sites and Facilities Act, Title 30-20-101 et seq., C.R.S., CCR 1007-2 Known
as the Regulations Pertaining to Solid Waste Disposal Sites and Facilities.
This recommendation is based, in part, upon a review of the application submitted by the applicant, other
relevant information regarding the request and the responses of the referral entities which have reviewed
this request.
The Department of Planning Services' staff recommendation for approval is conditional upon the following:
1. The property shall be maintained in compliance with the submitted application materials on file with
the Department of Planning Services for USR-1059, and all requirements of the Weld County
Health Department and the Colorado Department of Health.

4.8. Closure Data: The engineering design and operations report shall
include, as a minimum, the following closure data:

Provisions for the maintenance of the facility after closure,
to prevent or minimize nuisance conditions.
Provisions for the monitoring of explosive gas and groundwater
wells or surface water after closure.
Plans for final closure of the facility, including planned
final contours of fill surface after closure.
5.1 Issuance of certificates of designation for new facilities for
solid waste disposal: Certificates of designation are issued j
Boards or Count/ commissioners in accordance with the requirements
for the consideration of applications contained in Sections
30-20-104 and 30-20-105, of the Act.
5.1.1 Factors to be considered
(1) In considering an application for a certificate of
designation, the board of county commissioners shall take into
account:
(a) The effect that the solid wastes disposal site and
facility will have on the surrounding property, taking into
consideration the types of processing to be used, surrounding
property uses and values, and wind and climatic conditions;
(b) The convenience and accessibility of the sol-td-wastes
disposal site and facility to potential users;
(c) The ability of the applicant to comply with the health
standards and operating procedures provided for in the A•ct and
such rules and regulations as may be prescribed by the
Department;
(d) Recommendations by local health departments.
(2) Except as provided in the Act, designation of approved
solid wastes disposal sites and facilities shall be
discretionary with the board of county commissioners, subject
to judicial review by the district court of appropriate
jurisdiction.
(3) Prior to the issuance of a certificate of designation,
the board of county commissioners shall require that the
report which shall be submitted by the applicant under section
30-20-103 of the Act be reviewed and a recommendation as to
approval of disapproval made by the Department and shall be
satisfd that the proposed solid waste disposal site and
facility conforms to the comprehensive county land use plan,

if any. The application, report of the department,
comprehensive land use plan, and other pertinent information
shall be presented to the board of county commissioners at a
public hearing to be held after notice. Such notice shall
contain the time and place of the hearing and shall state that
the matter to be considered is the applicant's proposal for a
solid waste disposal site and facility. The notice shall be
published in a newspaper having general circulation in the
county in which the proposed solid wastes disposal site and
facility is located at least ten but not more than thirty days
prior to the date of the hearing.
5.1.2 If the board of county commissioners deems that a certificate
or designation should be granted to the applicant, it shall
issue the certificate, and such certificate shall be displayed
in a prominent place at the site and facility. The board of
county commissioner shall not issue a certificate of
designation if the department has recommended disppproval
pursuant to section 30-20-103 of the Act.
5.1.3 The County Board of Commissioners shall forward a copy of the
certificate of designation to the Department
6.0 These regulations apply to waste impoundments that store, treat
or dispose of liquid, semisolid or solid wastes, except as
provided in 6.0.4 for facilities in operation prior to adoption
of these regulations.
6.0.1 These regulaEions do not apply to wastes which;
A. Are subject to a permit issued pursuant to the Colorado
`lined Land Reclamation Act, CRS 1973, 34-32-101, et sea.
as -:ended; or
subject to a licensz issued pursuant to the Radiation
Cjn:rol Act, CRS 1973, 25-11-101, et sea. as amended; or
C. Are subject to a Certificate of Designation or permit
issued pursuant to the Hazardous Waste Act, CRS 1973,
25-15-101, et sea. as amended; or
D. Are industrial discha r_es which are point sources subject
cc permits under th orcv: lions of the Colorado water
Quality Control Act, C:S 19:3, 25-8-101, et sea. as
amended; or
E. Are subject to: a Consent Order, Decree or Agreement; or
a Written Cooperative Agreement issued pursuant to the
Solid Waste Disposal Sites and Facilities Act, CRS 1973,
30-20-101, et seq. as amended, to the extent that the
treatment, storage or disposal of such wast-s in a waste
impoundment is approved by the Department pursuant to

Access was available from two difference points, the one on the plat and one from the
neighbors property to the west. Material was being processed at time of inspection.
Most windrows are 4 feet tall. Raw material stacked up to 15 feet high. Windrows run
north - south. Oil and gas processing located in at least four places on -site. The
ground slopes to the north and south from the middle of the property, which is a hump.
One worker was on -site the day of the inspection. Access onto State Highway 66.
Colorado Dairy is immediately to the south of the state highway.

The Environmental Protection Division (the Division) of the Weld County Health
Department has completed the review of the documents submitted as an application
for Use by Special Review and Certificate of Designation permits. In the
interest of efficiency and to prevent duplication, we have submitted all of our
technical comments related to this facility to the Colorado Department of Public
Health and Environment (CDPHE). The CDPHE will address these issues to you in
a separate letter.
However, the Division has the following comments concerning the submitted odor
and fly control plans:
1) The fly control plan has limited fly eradication only to pesticides. The
Division is aware that parasitic wasps may be effective as a biological
control method. We recommend that you review the feasibility of
incorporating this method of eradication into your control plan.
2) The odor plan indicates that odors must be controlled and measured at the
nearest neighboring populated area. However, the Colorado Air Quality
Control Commission, Regulation 2, requires that odors are to be measured
"outside the property line of the property from which the emission
originates." Our Division does not have the authority to provide a less
stringent regulation than the State of Colorado.
In addition, in the event the Division receives odor complaints which can
be attributed to the facility; appropriate methods shall be implemented by
the operator at the request of the Division. Violations of Regulation 2
will be enforced through the Colorado Clean Air Act. Please make this
change.
These conclude the Divisions comments at this time. The Division requests that

As you are aware, the Environmental Protection Division of the Weld County Health
Department has reviewed your U.S.R. application, dated March 25, 1994, for the
Al Organics facility located west of Platteville on Colorado Highway 66, Weld
County. In numerous recent telephone conversations I have requested additional
information concerning this application. The following is a summary of the
additional information and materials the Division has requested in order to
complete its review:
1) A site map demonstrating the layout of the site. This should include the
locations and dimensions of the composting staging areas, storage areas,
and raw material stockpiles, including a definition of the buffer zones
surrounding the facility.
2) A map demonstrating the location, dimensions, and grades of all surface
water control features, including details of the detention pond. All
surface water control structures shall be designed in accordance with
section 2.1.6 of the Regulations Pertaining to Solid Waste Disposal Sites
and Facilities (the Regulations).
3) A detailed closure plan for the facility.
4) A map illustrating all surface water features (lakes, rivers, ditches,
etc.) within a two mile radius of the site boundary.
5) The location and additional information concerning all wells within one
mile of the site boundary. The following shall be provided for each well:
well depth, depth to water, screened interval, aquifer tapped, and use of
water.
6) A map which shows the local geological formation(s) and structures.
Include a written description of each geologic/soil layer at the proposed

site.
7) Provide geotechnical information on the permeability of the onsite
material and its effectiveness as a liner.
8) A demonstration that the facility does not lie in a flood plain.
9) A detailed vector (fly). management and abatement plan.
10) A detailed odor management and abatement plan.
These conclude the Division's comments regarding the U.S.R. application. As we
have discussed previously, the facility must comply with the Composting
Regulations when they are adopted by the State. Including, applying for and
receiving -a Certificate of Designation if required.
