HomeMy WebLinkAbout972392.tifff50 3 RESOLUTION RE: DENIAL OF USE BY SPECIAL REVIEW #1158 FOR A LIVESTOCK CONFINEMENT OPERATION CONSISTING OF A 4,000 -HEAD POULTRY (DUCKS) OPERATION WITH ASSOCIATED STRUCTURES IN THE A (AGRICULTURAL) ZONE DISTRICT - JAMES AND JANA YOUNGER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 12th day of November, 1997, at the hour of 10:00 a.m. for the purpose of hearing the application of James and Jana Younger, 8575 Weld County Road 21, Fort Lupton, Colorado 80621, for a livestock confinement operation consisting of a 4,000 -head poultry (ducks) operation with associated structures in the A (Agricultural) Zone District, on the following described real estate: Part of the NE% of Section 22, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendation of the Weld County Planning Commission and all the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant has not shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance, as follows: a. Section 24.4.2.3 -- That the USES which would be permitted will be compatible with the existing surrounding land USES. The Board of County Commissioners finds that the proposal is not consistent with the existing surrounding land uses, which include agricultural, residential, and existing turkey facilities to the northwest, west and southwest. The Board feels the addition of the proposed Use by Special Review would be incompatible with the existing uses in the area by creating a health hazard to the 170,000 turkeys already located in the area.
