RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
CORRECTED
Moved by Ann Garrison that the following resolution, with changes to Conditions of Approval#2, #3, and#6D and
Development Standards#7 and #17, be introduced for passage by the Weld County Planning Commission. Be it
resolved by the Weld County Planning Commission that the application for:

REQUEST: A Site Specific Development Plan and Special Use Permit for a shooting range(shotgun sports gun
club and pro shop) in the A(Agricultural)zone district.
LEGAL DESCRIPTION: Part of the NW4, Section 11, T8N, R66W of the 6th P.M., Weld County, Colorado.
LOCATION: South of and adjacent to Weld County Road 96; approximately 550' east of Weld County Road 33.
be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld
County Zoning Ordinance.
2. It is the opinion of the Planning Commission staff that the applicant has shown compliance with Section 24.3
of the Weld County Zoning Ordinance as follows:
A) This proposal is consistent with the Weld County Comprehensive Plan and is provided for as a Use by
Special Review.
B) The proposal is consistent with the intent of the district in which the use is located.
C) The use will be compatible with future development of the surrounding area and with future development.
D) The site does not lie within any of the overlay districts.
E) The applicant has demonstrated a diligent effort has been made to conserve productive agricultural land
in the locational decision for the proposed use.
F) The conditions of approval and development standards will ensure adequate provision for the protection
of the health, safety, and welfare of the inhabitants of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other
relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. The entire range shall be fenced and warning signs posted every 200 feet. Additional signs are warranted

along WCR 96. The fencing and signage shall be maintained by the applicant.
2. The perimeter of the range along Weld County Road 96 shall be landscaped to provide natural noise bariers.
The remainder of the range shall be planted and maintained with grass or suitable crops. The landscaping shall
be maintained by the applicant and dead or dying materials shall be replaced immediately upon notice.
3. All users for the target shooting area shall be supervised by a range officer or instructor qualified by the
National Rifle Association, military service or similar training.
4. Adequate toilet facilities shall be provided for patrons of the facility.
5. An individual sewage disposal system is required for the proposed facility. The septic shall be designed by a
Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
6. Prior to recording the plat:
A) The applicant shall identify additional parking and a turnaround to accommodate patrons of the site and large
delivery trucks on the plat.
B) One designated main access to the property with an adequately graded road to permit drainage from the
facility shall be shown on the plat.
C) Prior to recording the plat, the plat shall be amended to show the location, type, number and size of all
existing and proposed landscape materials.
D) The Weld County Health Department shall review the specifications for the proposed tower. The tower and
height of the tower shall be shown on the plat.
E) The fields and buffer zones shall be shown on the plat.
F) The applicant shall submit evidence that any existing septic system(s) which is not currently permitted
through the Weld County Health Department receive an I.S.D.S. Evaluation prior to the issuance of the
required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be
brought into compliance with current I.S.D.S. regulations.
7. The attached Development Standards for the Special Review permit shall be adopted and placed on the Special
Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and
ready for recording in the Weld County Clerk and Recorder's office within 15 days of approval by the Board of
County Commissioners.
8. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property
until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder.

SITE SPECIFIC DEVELOPMENT PLAN
SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and Special Use Permit is for a shooting range (shotgun sports gun
club and pro shop) in the A(Agricultural) zone district as indicated in the application materials.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning
Ordinance.
3. No shooting shall occur in the direction of WCR 96 unless there is an adequate, safe and clear zone set up
for shooting.
4. A locked gate at the main entrance to the site shall be maintained during off hours.
5. A Commercial Parks License shall be obtained from the Colorado Division of Wildlife. The site shall be
maintained in compliance with all Colorado Division of Wildlife requirements.
6. The entire range shall be fenced and warning signs posted every 200 feet. Additional signs are warranted
along WCR 96. The fencing and signage shall be maintained by the applicant.
7. The perimeter of the range along Weld County Road 96 shall be landscaped to provide natural noise barriers
by using berming and/or evergreen species. The remainder of range shall be planted and maintained with
grass or suitable crops. The landscaping shall be maintained by the applicant and dead or dying materials
shall be replaced immediately upon notice.
8. All users for the target shooting area be supervised by a range officer or instructor qualified by the National
Rifle Association, military service or other similar training.
9. In addition to firing lines or fields, adequate space for danger areas, parking, equipment, storage building,
clubhouse and latrines shall be provided.
10. The use of the range is limited to shotguns only.
11. A 100 by 300-yard danger zone shall be provided and maintained for trap fields.
12. A 300 by 600-yard danger zone shall be provided and maintained for skeet fields.
13. Trap and skeet fields may be combined (traps layout super-imposed on skeet field)where a 300 by 600-yard
zone shall be required.
14. The trap field layout shall meet the requirements of the American Trap Association.
15. The skeet field layout shall meet the requirements of the National Skeet Shooting
Association.
16. All the activities at this site shall comply with the rules and regulations of the National Skeet Shooting
Association, the American Trap Association, and the Colorado Division of Wildlife.
17. The Special Review permit is issued for a period of 5 years. After the completion of 5 years, the Permit shall
be reviewed every 5 years after and may be revoked when a substantial change has occurred regarding
compatibility with surrounding land uses. Revocation proceedings shall follow the procedures set forth in the
Weld County Zoning Ordinance.

18. The site shall use only commercially manufactured targets produced for the purpose of recreational shooting.
The targets used shall be considered non-toxic.
19. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against
surface and groundwater contamination.
20. No permanent disposal of wastes shall be permitted at this site.
21. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing
debris, and other potential nuisance conditions.
22. Fugitive dust shall be controlled on this site.
23. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A) as measured according
to 25-12-102, Colorado Revised Statutes.
24. Adequate toilet facilities shall be provided for patrons of the facility.
25. All construction on the property shall be in accordance with the requirements of the Weld County Building
Code Ordinance.
26. The property owner or operator shall be responsible for complying with the Operation Standards of Section
24.6 of the Weld County Zoning Ordinance.
27. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5
of the Weld County Zoning Ordinance.
28. The property owner or operator shall be responsible for complying with the Supplementary Regulations of
Section 45.3 of the Weld County Zoning Ordinance.
29. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall
be granted access onto the property at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated hereon and all applicable Weld County
Regulations.
30. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards
and all applicable Weld County regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit by the Weld County
Commissioners before such changes from the plans or Development Standards are permitted. Any other
changes shall be filed in the office of the Department of Planning Services.
31. The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation
of the Permit by the Board of County Commissioners.
