HomeMy WebLinkAbout950403.tiffRESOLUTION RE: SUBMITTING TO THE REGISTERED ELECTORS AT A SPECIAL ELECTION OF THE COUNTY OF WELD, STATE OF COLORADO, AN AMENDMENT TO THE HOME RULE CHARTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Clerk and Recorder reported on March 1, 1995, that staff had reviewed the Petition to Initiate an Amendment to the Home Rule Charter for Weld County, which report to the Board is attached hereto as Exhibit A, and WHEREAS, the Weld County Clerk and Recorder indicated there appeared to be a sufficient number of valid signatures on said petition, and WHEREAS, pursuant to Article XVII, Section 17-1 (1) (a) and (3) the Board shall publish notice of and call an election to be held not less than 30 nor more than 120 days after publication; the text of any proposed amendment to be published with said notice, and WHEREAS, the Board directs the Weld County Clerk to the Board to publish the full text of said proposed amendment along with a Notice of Election no later than March 30, 1995, and WHEREAS, within 30 days of receipt of the abovementioned report, which constitutes initiation of a proposed amendment to the Weld County Home Rule Charter, the Board, pursuant to Article XVII Section 17-1 (3), shall publish notice of and call an election to be held not less than 30 nor more than 120 days after said publication, and WHEREAS, there is no general election within the 120 days following date of publication. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the initiated amendment to the Weld County Home Rule Charter be considered at a special election to be held June 13, 1995. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board shall publish notice of the election along with the full text of the proposed amendments in the Windsor Beacon, the legal newspaper for Weld County, no later than March 30, 1995. You may recall that the Board of County Commissioners, sitting with the Clerk and Recorder as the Weld County Ballot Issue Title Board,set the ballot title on December 5, 1994. A total of 2,054 signatures are necessary for an election on this issue, pursuant to Article XVII, Section 17-1 of the Charter. We conclude that 2,429 valid signatures have been received. Therefore, the petitioners have met the requisite number necessary for an election and I respectfully request that the Board set dates for the publication of the entire text of the amendment and for the election. TITLEt Shall the Home Rule Charter for Weld County, Colorado, be amended by adding a new Article XV, Section 15-5 - Election Required Regarding Siting of Correctional or Detention Facilities - providing that, from and after the date of adoption of this Article XV, Section 15-5, neither Weld County, nor any department, agent or employee thereof, shall issue a certificate of occupancy to allow the occupancy or use of, nor shall any person, corporation or entity occupy, operate or use, any structure or building within Weld County as a correctional facility, pre -parole facility, jail, prison or other place of incarceration, whether or not the structure, building or facility is owned or operated as.either a public or private facility, unless and until the location and siting of such correctional or detention facility, jail, prison, pre -parole facility or other place of incarceration has been approved by a majority of the registered electors of Weld County voting on such question at a regular or special election? 10. 11. 12. 13. 14. 15. 16. 17. 18. 19. 20. 21. 22.
