RE: SHOW CAUSE HEARING CONCERNING REVOCATION OF SPECIAL USE PERMIT#961

A public hearing was conducted on April 13, 1998, at 10:00 a.m., with the following present:
Commissioner Constance L. Harbert, Chair
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Esther Gesick
Assistant County Attorney, Lee Morrison
Public Works representative, Drew Scheltinga
The following business was transacted:
I hereby certify that pursuant to a notice dated December 8, 1997, and duly published
December 31, 1997, in the Platteville Herald, a public hearing was conducted on January 12, 1998,
to consider the revocation of Special Review Permit #961 for William Kobobel for an Open-Pit
Gravel Mining Operation. At said hearing it was determined by the Board of County
Commissioners to continue this matter to March 16, 1998. At said hearing on March 16, 1998, Mr.
Kobobel was unable to attend due to an injury and it was determined by the Board of County
Commissioners to continue this matter to April 13, 1998. Lee Morrison, Assistant County Attorney,
made this a matter of record. Drew Scheltinga, County Engineer, stated the Board has approved
an agreement with Mr. Kobobel. In response to Chair Harbert, Mr. Scheltinga stated Mr. Kobobel
has met the requirements and signed the agreement. Mr. Scheltinga explained Mr. Kobobel will
haul the necessary base material from the pit to the road; the County will place the base material,
haul and place the hot bituminous pavement. Mr. Kobobel will reimburse the County in two
payments which are due on June 15, 1998, and October 15, 1998. Mr. Kobobel has already paid
a partial payment of $5,000. No public testimony was offered concerning this matter.
Commissioner Hall moved to dismiss the Show Cause Hearing to consider the revocation of
Special Review Permit#961 for William Kobobel for an Open-Pit Gravel Mining Operation without
prejudice. Seconded by Commissioner Webster, the motion carried unanimously.
