HomeMy WebLinkAbout970276.tiffCONSOLIDATED HEARING CERTIFICATION DOCKETS NO. 97-03A AND NO. 97-04A RE: CHANGE OF ZONE #501 FROM A (AGRICULTURAL) TO PUD (PLANNED UNIT DEVELOPMENT) FOR AN AIRPARK WITH 39 HANGER LOTS AND ONE RESIDENTIAL LOT - PLATTE VALLEY AIRPARK, C/O MARILYN TAYLOR SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN, S #409, FOR AN AIRPARK WITH 39 HANGER LOTS AND ONE RESIDENTIAL LOT WHICH INCLUDES THE AIRSTRIPS AND CONTROL TOWER - PLATTE VALLEY AIRPARK, C/O MARILYN TAYLOR A public hearing was conducted on February 12, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - EXCUSED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to amended notices dated January 2, 1997, and duly published January 9, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Platte Valley Airpark, c/o Marilyn Taylor, for Change of Zone #501 from A (Agricultural) to PUD (Planned Unit Development) for an airpark with 39 hanger lots and one residential lot and a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #409, for an airpark with 39 hanger lots and one residential lot which includes the airstrips and control tower. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Department of Planning Services representative, requested both cases and the improvements agreement be heard simultaneously. He presented a brief summary of the proposals and noted the airport is an existing public use. Mr. Hodges then recommended the following be added to S #409: Condition of Approval #1.F., concerning the management of the escrow account for the planned 970276 PL0884 RE: HEARING CERTIFICATION - PLATTE VALLEY AIRPARK (COZ #501 AND S #409) PAGE 2 improvements on site; and Condition of Approval #2.S., concerning the on -site improvements within Area "B". He clarified the improvements basically include paving and stated he has received the on -site improvements agreement, which staff recommends accepting based on Public Works and County Attorney recommendations. Kevin Kinnley, partner in Platte Valley Airpark, stated this proposal will provide lots for people to build hangers to permanently locate their private aircrafts. He confirmed all Conditions of Approval are acceptable. Commissioner Harbert voiced concern regarding increased traffic on Weld County Road 39 and mitigation of the impact. Mr. Kinnley noted this site is primarily a recreational facility, with very few corporation or business -type tenants; therefore, the activity level will increase but not to a high level. He clarified if the traffic count goes above 200, he is willing to implement a dust control program as agreed in the previously approved Special Review Permit (USR). Mr. Morrison and Mr. Hodges explained the USR is existing, and its Conditions of Approval are in effect. Mr. Kinnley reiterated that condition is part of the USR, and he would be willing to pave the road if the traffic count is over 200 as a result of this Permit. He noted the road has already been improved and there is a fair amount of traffic which travels to the property to the south as well. Mr. Hodges clarified said requirement is a Development Standard of the USR and suggested it also be made a Condition of Approval as a note on the plat for this Permit. He also noted Public Works has the ability to discuss options with the owner if the traffic count becomes too high. The Board then discussed the improvements agreement, and Mr. Hodges read the language concerning the dust abatement plan into the record. He suggested the language be transferred to the PUD plat as a Condition of Approval, in case the USR is ever vacated. Mr. Morrison stated he feels the situation is adequately addressed because even though the units for the hangers will be sold privately, the traffic will be generated by the sale of the individual units. Mr. Kinnley agreed, and no public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of Platte Valley Airpark, do Marilyn Taylor, for Change of Zone #501 from A (Agricultural) to PUD (Planned Unit Development) for an airpark with 39 hanger lots and one residential lot, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. Commissioner Harbert seconded the motion, which carried unanimously. Commissioner Hall moved to approve the request of Platte Valley Airpark, c/o Marilyn Taylor, for a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #409, for an airpark with 39 hanger lots and one residential lot which includes the airstrips and control tower, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval, including the addition of Conditions of Approval #1.F. and #2.S, as entered into the record. The motion was seconded by Commissioner Harbert, and it carried unanimously. Responding to Mr. Hodges, Mr. Morrison recommended the final improvements agreement be approved as an item of business. Mr. Hodges clarified the applicants are not posting collateral but plan to maintain an escrow account with a percent from the sale of the lots to be used for paving. Mr. Morrison explained the reason staff is recommending approval of an escrow account is that the facility is already existing and operating without the improvements.
