AT MILE POST 145 . 29 , STERLING SUBDIVISION ) BET BETEN K RSEY ,1ND AUBURN . ) August 6 , 1925 . • 'r ,/ ' STATEMEN T By the Commission: This proceeding arises from the application of the Union Pacific Railroad Company , in compliance with section 29 of the Public Utilities Act of Colorado , as amended April 16 , 1917 , for the abandonment of a public highway crossing on the section line between Sections Twenty-four ( 24 ) and Twenty- five ( 25 ) , Township Five ( 5 ) North , Range Sixty- four ( 64 ) vest where it intersects the line of said railroad , which point is at Mile Post 145 . 29 , Sterling Subdivision of Union Pacific Railroad , and for relocating the rublic highway at said crossingr so as to connect with the public highway crossing over said railroad on the section line between Sections Twenty-four ( 24 ) and Nineteen ( 19 ) , Township 'ive ( 5 ) North , Range Sixty-four ( 64 ) West , in accordance with plans submitted ° ith a, plication . This abandonment of said crossing and change of location is alleged to Le in compliance with the Commission ' s order In re Improvement of Grade Crossings in Col rado , 2 Colo . P . U . C . 128 . From inquiry it was learned from the State Highway Department that the highway at the crossing that applicant desires to abandon is not a state highway and , there- fore , the State Highway Department is not involved in the matter. Attached to the application is a statement from the County Commissioners of Weld County , who have jurisdiction over said highway at crossing whichit is desired to sbandon at Mile Post 145 . 29 , giving their consent to the abandonment of the crossing and rearranging the highway , as indicated in the plan attached to the application de- signated Exhibit 1 . The Commission ' s engineer investigated the site of the crossing in question on July 29 , 1925 , and is of the opinion that the abandonment of the crossing and change of road to the other corssing referred to in the application will be to the improvement of the public safety and crossing facilities at this point . The crossing proposed to be abandoned is at such an angle with the railroad as to add to its dangerous features , while the proposed road to the other crossing will increase its safety , and this road crossing is at such an angle with the railroad as to be safer . Also a good road can be constructed , as sh _.wn on plan , with good visibility . The nearest ranch house , occupied by a Mr . Henry , is about one-fourth mile from this crossing , and he said he had no objection to the change and did not :,now of anyone who would have any objections to the change. Since the change proposed in the application will ire for the benefit of the public and has the approval of all parties concerned therein , the Commission will , therefo _' e , issue its order granting the abandonment of the crossing as herein requested . STATEMEN T By the Commission : This proceeding arises oat of the application of the Board of County Commissioners of Weld County , Colorado , dated March 9 , 1925 , in compliance with section 29 of the Public Utilities Act as amended April 16 , 1917 , for the opening of a public highway crossing at grade over the right-of-way and track of the Great Western Railway , at a point in Section 31 , Township 7 , North of Range 65 , West of the 6th P. Li. , in Weld County , Colorado , adjoin- ing the Town of Eaton on the North , in order to eliminate curves and shorten distance in the state highway at this point . Copies of the application were duly forwarded to all the parties at interest in the application , viz : the State Highway Department , the Union Pacific Railroad Company and the Great Western Railway Company , for an expression of their attitude towards the application . On May 5 , 1925 , Mr . M. N. Lines , Assistant Railway Engineer of the Commission , at the direction of the Commission made an inspection of the proposed grade crossing , together with the County Commissioners of Weld County , officers of the Great Western Railway , the Assistant Division Engineer of the Union Pacific Railroad , and the Division Engineer of the Highway Department . Mr . Lines reports as follows : "The proposed crossing will cross the right- of-way and track of the Great Western Railway at a point on the line in Section 31 , Township 7 North , Range 65 , West of the 6th P. L. ,, in Weld County . The crossing will be a part of the main north and south Public Highway and serves the needs of a crossing at this point for purpose of shortening and eliminating curves of the state highway . The railroad is tangent at this poiLt and no obstructions on either side exist . There is a clear view for three quarters of a mile east and one-half of mile west . I recommend that this application be granted . " At this conference a tentative proposition for the installation of the crossing was agreed upon subject to the approval of the Commission between all the parties concerned . The verbal understandings at this conference developed some discrepancies in the understand- ing which have now been satisfactorily adjusted as shown hereafter . On March the 9th , 1925 , the State Highway Department advised that the proposed cross - ing is in the line of the improvement for the state highway as laid out between Eaton and Ault and has the approval of that department . The question of the matter of expense for 540 installation and maintenance of the crossing as agreed upon at the aforesaid conference was taken up with the Highway Department and under date of Jane 11 , 1925 , the Commission was ad- vised that it was the understanding of that department that the Union Pacific Railroad was to bear no part of the expense of the installation and maintenance of the crossing includ- ing any expense required in the proper protection of their block signal line at this point . That the cost of the installation and maintenance of the crossing should be borne jointly by the county and state on a fifty- fifty basis ; and that the Great Western Railway at their ov, n expense was to raise their tracks sufficiently to allow for suitable cov ;;ring over the Union Pacific block signal pipe . Under gate of June 24 , 1925 , the Chairman of the Board of County Commissioners confirmed this understanding . After some correspondence with the General Attorney of the Union Pacific Railroad Company regarding the matter of the understanding as to the expense fcr the installation and expense of the maintenance of the crossing the respondent , the Union Pacific Railroad Company , filed an answer to the application under date of June 15 , 1925 . This answer alleged that so long as the Union Pacific Railroad Company is not called upon to bear any part : f the expense in connection with the installation of the crossing either directly or indirectly or its maintenance , or any expense that might be necessitated in its pro - tection now or in the future the Cornuany will not oppose the granting of the crossing . On May lb , 1925 the attorneys for the respondent , the Great Western Railway Com- pany , filed an answer to the application alleging that the respondent does not own the ground on which the proposed crossing is located , but has a right to construct , main- tain and operate a single track railroad over the right- of-way of the Union Pacific Railroad at this point . The respondent further states that it does not oppose the application for the proposed crossing , provided no part of the constructing , maintain- ing , operating or safeguarding said proposed highway crossing is assessed against the respondent . The answer further specifies that all signal wires which are crossed or in any manner affected by the proposed crossing shall be properly protected in their operation ; and that the proposed crossing within a space 4- 1/2 feet each side of the center line of its track shall be constructed and maintained without interferring with the opera- tion and maintenance of their track ; and that they shall have the right to do necess- ary repair work to their track at any time required under the crossing . Also that the expense that might be required by public authority for any protection for this crossing , or the cost of construction of a subqay or overhead cross in shall be borne by the applicant . In ,smuch as the answer stated the respondent , the Great Western Railway Company , was to bear no part of the expense of installation of the crossing and as it was the understanding at the aforesaid conference that the Company was to raise its track so as to properly protect signal wires at crossing at its own expense the matter was taken up with the officials of the Great Western Railway and under date of July 21 , 1925 , the General Attorney of the company advised the Commission that the railroad company had recently raised their track to conform to the pro ', er grade snd that therefore this feature of the expense had been eliminated . The records in the case therefore show that at a conference held at the site of the proposed crossing by all the parties at interest it was agreed subject to the approval of the Commission that there was no objection to the application with the understanding that the state and county should bear all the expense for the installa- tion and maintenance of the proposed crossing except expense of raising the Great Western Railway track , dnd that said expense was to be borne equally by the state and county . The Commission will therefore issue its order granting permission for the establishment of the crossing as herein requested . ORDER IT IS THERE FOE ORD , That in accordance with Section 29 of the Public Utili- ties Act of the State of Color :_ do , as amended April 16 , 1917 , that a public highway crossing at grade be , and the same is hereby , permitted to be opened and established over the track and right- of-way of the Great Western Railway Company at a point in Section bl , Township 7 north , of i:ange 65 , West of the t th P .
