from the Town of Kuner , across the south Platte liver , near first party ' s headgate of
its Empire Canal , second party finds it necessary to repair a bridge , and first party
desires to have the understructure of said bridge so constructed that it may be used by
first party as a regulating works in that channel of the river over which may be built
a deck or roadway for purpose of public travel , and first party desires , in considera-
tion of such manner of construction and use , to sustaiq the costs of said understructure
on the terms hereinafter set forth ,

first party shall be permitted to construct and shall construct at said point the said

County commissioners of Weld county .
Said structure shall be 100 feet long and shall support travel ,ieck 18 feet wide .
It shall be built with sheet piling 8 feet in length driven 3 feet under the waterline
on w- ich shall be imposed a concrete structure wit'ri piers to a !�1 .d of streth
s.lffic eizt to support said deck and travel over said tublic hihway , all to be done in
good and workmanlike manner , of first class materials , accordin to l,lans and soecifi -

cations hereto attached and made a part hereof . N en said structure has been completed
in accordance tflere" i th , the second party u:prees to reimburse first party for one-half
the costs of materials and labor of said structure Imelow said travel deck , but first party
7uarant ees that the cost thereof shall not exceed Thirty- ;i;,'ht Hundred ( $3800 . 00 ) Dollars .
Weld County , thereupon , shall have the right to install said travel deck and bridge
II construction and shall thereafter own said structure , subject , however, to the right of
first party to ure said understructure for remilating the flow of the river at said point
as part of the diversion works of first party for said zrnpire canal .
PROVIDED , how ever , that at no time shall first party be permitted to so se said
structure as to interfere with the use of , or to damage the public highway at that point ,
or the property of others , and first ' arty agrees to indemnify and save harmless second
party from all damages , suits , counsel fees , and claims of other persons for injuries
arising out of the operation of said understructure by first party .
If any replacement , or repair , of said structure shall be required hereafter , the
same shall be done only subject to approval of. the .Board of County Commissioners of ,v old
County , and any costs thereof made at the instance of first party , shall he reimbursed by
it promptly to second party , and any costs made necessary Ter the joint benefit of the
parties shag_ l -i; e borne in equal shares .
First party agrees to begin such work promptly and to prosecute the same with expe-

Kelsey , Fort Lupton ; to view the above described line of road on t; e 16th day of March ,
1925 . The above resolution appointed road viewers is entered as of March 7th , 19' 25 , on

Above petition was to be heard before the Board of County Commissioners on the 6th
day of April , 1925 , at which time said hearing was ad i ourned to and until the 13th day of
April , 1925 . resolution covering the adjournment of hearing is entered as of the 6th
day of April , 1955 , on pa -fie 468 , of this book . Also on said page is entered objections

OF A PRIV:1 E ROAD.
This matter coming on to be heard upon the objections of i,,arie Pauline Nicolaus ,
Fritz Nicolaus and August Maul to the retort of the road viewers heretofore made and filed
in the above entitled matter , said hearing on said objections having been held on Monday ,
April 6th and continued until Monday April 13 , by the commissioners f r the purose of tak-
ing the same under -advisement and in order that said uom :'issioners might make a personal
examination of the proposed road ; and the Commissioners having made such personal examina-
tion and having heard the oral testimony , the argument of counsel and being fully advised
in the premises
DOTH FIND That a necessity exists for the construction of said proposed road ; that
the proposed road as laid out and determined in the report of said road viewers is the most
practicable and feasible that is available ; that the sum of One Hundred ►seventy- five Dollars
( 1- 75 . 00 ) awarded by said road viewers is adequate and sufficient compensation to be paid
to the persons entitled thereto ; that , in addition , said petitioners shall at their own
expense fence said road on either side with legal fences , shall construct all necessary
bridges and open and maintain said road , IT IS , THEEFOE,

1 . .1` at the report of said road viewers be , and the same hereby is , fully approved .
2 . '1' at the objections to the opening and establishment of said road by Marie Paul-
ine Nicolaus , et al , are hereby overruled and the petition is hereby granted .
3 . That the full and final report of the viewers , including the plat and report of
the surveyor , be recorded in this office of the County clerk and recorder of eld County ,
Colorado .
4 . That said petitioners be , and they hereby are , ordered to pay to this board the
amount of One Hundred aevent,iT-five Dollars ( 176 . 00 ) awarded as full compensation for damages
to the owner or owners of the land tat:en for said road , and that the same be paid by the
Board herein to said owner or owners .
5 . That said petitioners be, and they hereby are , ordered to fence said road with
a legalfence on either side ; construct necessary bridges and flumes and open and thereafter
maintain said road at their own expense .
6 . Tr t said road shall not in any sense be a public road to be established or
maintained by the County unless hereafter made so by due process of law , but is and shall
be a private wagon road from the dwelling of the petitioners to be opened , established and
maintained by the petitioners , their heirs and assigns at their own expense .
. 7 . That all parties interested be notified of the action of. the .board herein and
be given a reasonable opportunity to accept or reject the action of this .board.
The above findings , resolution and order , made and etered by the board this 13th
day of April , 1925 , upon the following vote :

Commissioners to make an additional levy of general school tax to correct an error made
in which said District has been injured , regarding the omission of a sufficient amount
to pay a third teacher , was presented to the Board , when the followin action was taken ,

WriERr a , the Board of Directors of School District No . 24 , of Weld County , Colo-
rado , known as Ashton District , have filed herein their written petition and have ap-
peared before this board showing that by oversight and omission the County Superintendent
of Schools failed to certify to this board in the fall ., f 1924 prior to levy of taxes the
amount necessary to be levied as a general school fund in order to pay 975 a month for
three teachers for said school district , and in feet , certified only the amount necessary
for two teachers for said school district , and levy was made only in said R-enera1 school
fund for two, teachers for said district , and. unless an additional levy is made for that
purpose , said. school district will have been denied its right to receive from the general
county fund the amount of 05 per month, for nine months , . for one of said teachers , to
wit , 0675 ; 4

for extension of levies of taxes , would require that said levy he spread over all the

tax until the regular time for levying county taxes in she fall of 1925 ,
NOW , TH_1]_ FO± E, BE IT 1ESOLVED That a levy be spread over all the pr ) perty of Geld
County, for general school purposes at the regular time for levy of taxes. in the fall of
1925 , sufficient ( in addition to providing the general School fund for the school year then
ensuing) to provide for the benefit of said school district the further amount of 0675 ,
and that from the taxes realized out of said farther school fund to be raised from said
- levy to be made in the fall of 1925 the Treasurer shall pay to said district the said
4675 , in addition to the amount to which said school district shall he entitled on ac-
count of the number of teachers employed for the school . year er_suin.7 the fall ''if 1925 .

less ) , has filed with this Board written petition, containing all the allegations and
averments necessary by law to be contained therein , praying for tLe inclusion of the
above described land in The Henrylyn Irrigation District ; and
WHEREAS , said petition has been duly set for hearing upon this day , and the
notice of the filing of said petition , and the time and place at which the Board of
Directors of The Henrylyn Irrigation District would hear the same , and take evidence
in support thereof , and take action thereon , has been duly published and given as pro-
vided by law , and the proof thereof filed with this Board , and the said petition , hav-
ing at the said time and place duly come to be heard before , and has been heard by this
Board ; and
WHEREAS , after careful consideration of the evidence before it , the Board did
then and there find and determine that it was for the best interests of said District
to include said land in and make same a part of the District .
IT IS TH FREFOh'E ORDERED , by the Board of Directors of The Henrylyn Irrigation
District , that for the reasons in said petition stated , and proven as aforesaid , that
the prayer of the petition for the inclusion of said land of said C . C . Milhoan be ,
and the same is , hereby allowed and granted and that the said hereinabove described
land be , and the same is , hereby included in and made a part of The Henrylyn Irrigarion
District , subject to the payment of all assessments or tax levies for irrigation district
purposes of said District , and that in case no protest in writing be filed with this
Board within thirty days from this date , signed by a majority of the legally qualified

electors of said District , then a copy of this resolution , certified by the President
and Secretary of this Board , shall be filed for record in the office of the Clerk and
Recorder of Weld County , Colorado , and also there shall be delivered to the Board of
County Commissioners and the County Assessor of Weld County , Colorado , each a copy of
this order , notifying them of the action of this Board , and that said land has been
included in said District , and is now subject to taxation for irrigation district pur-
poses of said District , and that the Couuty Assessor be directed to include said land
in any assessment to be made by him for irrigation District purposes of said District . "

STATEMEN T
By the Commission:
This proceeding arises from the application of the Union Pacific Railroad Company ,
in compliance with section 29 of the Public Utilities Act of Colorado , as amended April
16 , 1917 , for the abandonment of a public highway crossing on the section line between
Sections Twenty-four ( 24 ) and Twenty- five ( 25 ) , Township Five ( 5 ) North , Range Sixty-
four ( 64 ) vest where it intersects the line of said railroad , which point is at Mile
Post 145 . 29 , Sterling Subdivision of Union Pacific Railroad , and for relocating the
rublic highway at said crossingr so as to connect with the public highway crossing over
said railroad on the section line between Sections Twenty-four ( 24 ) and Nineteen ( 19 ) ,
Township 'ive ( 5 ) North , Range Sixty-four ( 64 ) West , in accordance with plans submitted
° ith a, plication . This abandonment of said crossing and change of location is alleged
to Le in compliance with the Commission ' s order In re Improvement of Grade Crossings in
Col rado , 2 Colo . P . U . C . 128 .
From inquiry it was learned from the State Highway Department that the highway
at the crossing that applicant desires to abandon is not a state highway and , there-
fore , the State Highway Department is not involved in the matter.
Attached to the application is a statement from the County Commissioners of
Weld County , who have jurisdiction over said highway at crossing whichit is desired to
sbandon at Mile Post 145 . 29 , giving their consent to the abandonment of the crossing
and rearranging the highway , as indicated in the plan attached to the application de-
signated Exhibit 1 .
The Commission ' s engineer investigated the site of the crossing in question
on July 29 , 1925 , and is of the opinion that the abandonment of the crossing and
change of road to the other corssing referred to in the application will be to the
improvement of the public safety and crossing facilities at this point . The crossing
proposed to be abandoned is at such an angle with the railroad as to add to its dangerous
features , while the proposed road to the other crossing will increase its safety , and
this road crossing is at such an angle with the railroad as to be safer . Also a good
road can be constructed , as sh _.wn on plan , with good visibility . The nearest ranch
house , occupied by a Mr . Henry , is about one-fourth mile from this crossing , and he
said he had no objection to the change and did not :,now of anyone who would have any
objections to the change.
Since the change proposed in the application will ire for the benefit of the
public and has the approval of all parties concerned therein , the Commission will ,
therefo _' e , issue its order granting the abandonment of the crossing as herein requested .
MRDER
IT IS YHEiii1TORE ORDERED , In accordance with Section 29 of the Public Utilities
Act of the State of Colorado , as amended April 16 , 1917 , that permission is hereby
granted to abandon the present crossing over the track and right- of-way of the Union
Pacific Railroad Comoany located at a point on the section line between Sections Twenty-
four ( 24 ) and Twenty-five ( 25 ) , Township Five ( 5 ) North , Range Sixty-four ( 64 ) West
where it intersects said railroad at Mile Post 145 . 29 , Sterling Subdivision of the
Union Pacific Railr , ad , and to change the crossing of aforesaid public highway to a
crossing of the public highway of: er said railroad at a point wherethe section line
between Sections Twenty-four ( 24 ) and Nineteen ( 19 ) , Township Five ( 5 ) North , Range
Sixty-four ( 64 ) West intersects the Union Pacific Railroad , said crossing being about
525 feet eastward along the railroad from the crossing that is to be abandoned .
IT IS FURTHER OLtD.RED , That all the expense incident to the abandonment of the
present crossing at Mile Post 145 . 29 , Sterling Subdivision of the Union Pacific Rail-
road , and the expense for the construction in the rearrangement of the highway to
the other crossing located about 525 feet eastward along said railroad from the cross-
ing to be abandoned , including any expense required for drainage and fencing , shall be
borne by the applicant , the Union Pacific Railroad Company .

STATEMEN T
By the Commission :
This proceeding arises oat of the application of the Board of County Commissioners
of Weld County , Colorado , dated March 9 , 1925 , in compliance with section 29 of the Public
Utilities Act as amended April 16 , 1917 , for the opening of a public highway crossing at
grade over the right-of-way and track of the Great Western Railway , at a point in Section
31 , Township 7 , North of Range 65 , West of the 6th P. Li. , in Weld County , Colorado , adjoin-
ing the Town of Eaton on the North , in order to eliminate curves and shorten distance in
the state highway at this point .
Copies of the application were duly forwarded to all the parties at interest in the
application , viz : the State Highway Department , the Union Pacific Railroad Company and the
Great Western Railway Company , for an expression of their attitude towards the application .
On May 5 , 1925 , Mr . M. N. Lines , Assistant Railway Engineer of the Commission , at the
direction of the Commission made an inspection of the proposed grade crossing , together
with the County Commissioners of Weld County , officers of the Great Western Railway , the
Assistant Division Engineer of the Union Pacific Railroad , and the Division Engineer of
the Highway Department . Mr . Lines reports as follows :
"The proposed crossing will cross the right- of-way and
track of the Great Western Railway at a point on the
line in Section 31 , Township 7 North , Range 65 , West of
the 6th P. L. ,, in Weld County . The crossing will be
a part of the main north and south Public Highway and
serves the needs of a crossing at this point for purpose
of shortening and eliminating curves of the state highway .
The railroad is tangent at this poiLt and no obstructions
on either side exist . There is a clear view for three
quarters of a mile east and one-half of mile west .
I recommend that this application be granted . "
At this conference a tentative proposition for the installation of the crossing was
agreed upon subject to the approval of the Commission between all the parties concerned .
The verbal understandings at this conference developed some discrepancies in the understand-
ing which have now been satisfactorily adjusted as shown hereafter .
On March the 9th , 1925 , the State Highway Department advised that the proposed cross -
ing is in the line of the improvement for the state highway as laid out between Eaton and
Ault and has the approval of that department . The question of the matter of expense for

installation and maintenance of the crossing as agreed upon at the aforesaid conference was
taken up with the Highway Department and under date of Jane 11 , 1925 , the Commission was ad-
vised that it was the understanding of that department that the Union Pacific Railroad was
to bear no part of the expense of the installation and maintenance of the crossing includ-
ing any expense required in the proper protection of their block signal line at this point .
That the cost of the installation and maintenance of the crossing should be borne jointly
by the county and state on a fifty- fifty basis ; and that the Great Western Railway at their
ov, n expense was to raise their tracks sufficiently to allow for suitable cov ;;ring over the
Union Pacific block signal pipe . Under gate of June 24 , 1925 , the Chairman of the Board
of County Commissioners confirmed this understanding .
After some correspondence with the General Attorney of the Union Pacific Railroad
Company regarding the matter of the understanding as to the expense fcr the installation
and expense of the maintenance of the crossing the respondent , the Union Pacific Railroad
Company , filed an answer to the application under date of June 15 , 1925 . This answer
alleged that so long as the Union Pacific Railroad Company is not called upon to bear any
part : f the expense in connection with the installation of the crossing either directly
or indirectly or its maintenance , or any expense that might be necessitated in its pro -
tection now or in the future the Cornuany will not oppose the granting of the crossing .
On May lb , 1925 the attorneys for the respondent , the Great Western Railway Com-
pany , filed an answer to the application alleging that the respondent does not own the
ground on which the proposed crossing is located , but has a right to construct , main-
tain and operate a single track railroad over the right- of-way of the Union Pacific
Railroad at this point . The respondent further states that it does not oppose the
application for the proposed crossing , provided no part of the constructing , maintain-
ing , operating or safeguarding said proposed highway crossing is assessed against the
respondent .
The answer further specifies that all signal wires which are crossed or in any
manner affected by the proposed crossing shall be properly protected in their operation ;
and that the proposed crossing within a space 4- 1/2 feet each side of the center line
of its track shall be constructed and maintained without interferring with the opera-
tion and maintenance of their track ; and that they shall have the right to do necess-
ary repair work to their track at any time required under the crossing . Also that
the expense that might be required by public authority for any protection for this
crossing , or the cost of construction of a subqay or overhead cross in shall be borne
by the applicant .
In ,smuch as the answer stated the respondent , the Great Western Railway Company ,
was to bear no part of the expense of installation of the crossing and as it was the
understanding at the aforesaid conference that the Company was to raise its track so
as to properly protect signal wires at crossing at its own expense the matter was
taken up with the officials of the Great Western Railway and under date of July 21 , 1925 ,
the General Attorney of the company advised the Commission that the railroad company
had recently raised their track to conform to the pro ', er grade snd that therefore
this feature of the expense had been eliminated .
The records in the case therefore show that at a conference held at the site
of the proposed crossing by all the parties at interest it was agreed subject to the
approval of the Commission that there was no objection to the application with the
understanding that the state and county should bear all the expense for the installa-
tion and maintenance of the proposed crossing except expense of raising the Great
Western Railway track , dnd that said expense was to be borne equally by the state and
county . The Commission will therefore issue its order granting permission for the
establishment of the crossing as herein requested .
ORDER
IT IS THERE FOE ORD , That in accordance with Section 29 of the Public Utili-
ties Act of the State of Color :_ do , as amended April 16 , 1917 , that a public highway
crossing at grade be , and the same is hereby , permitted to be opened and established
over the track and right- of-way of the Great Western Railway Company at a point in
Section bl , Township 7 north , of i:ange 65 , West of the t th P . Li. , in geld County , Colo -
rado , adjoining the town of Eaton on the north , provided , however , that prior to the
opening of said crossing to public travel it shall be constructed in accordance with
plans and specifications as prescribed in the Commission ' s order , In re : Improvements
of Grade Crossings in Colorado , 2 Colo . P . U . C . 128 .
IT IS FiRTHER ORILLD , That the expense for the raising of the Great Western
Railway track to the required grade at this point shall be bo2ne by that company ; and
that all other expense necessary for the construction and maint en: .nc e of said cross-
ing including the proper protection of all signal wires or appurtenances at this point
or affected by this crossing shall be borne by the State of Colorado and the County of
Weld , Colorado , each to pay one-half of said cost .

Pursuant to authority received from the Colorado Tax Commission , relating to valua-
tions placed upon property Weld of Companies assessed by said Tax Commission , doing business in
County , Colorado , subject to taxation for the ,year 1925 , on motion regularly made ,
seconded and unanimously carried , it was ordered by the Board of County Commissioners of
Weld County , Colorado , that the proper relative mileage and valuations of saf i companies
be distributed to the various municipalities of the County and that same be and is hereby
now fixed and established , and that the same be spread upon the records of this office
and the Clerk is hereby directed to furnish a certified copy thereof to the Assessor of
Weld County , empowering him to extend the same upon the Assessment Rolls of Weld County ,
Colorado , for the year 1925 .
