RESOLUTION
RE: APPROVAL OF SUBDIVISION EXEMPTION#588-JAMES BROWN FARMS COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), CRS, as amended, and Section 2-19 of the Weld County Subdivision
Regulations, did determine at a public meeting held in the Chambers of the Board, that certain
parcels of land to be divided, as shown on the plat known as Subdivision Exemption #588, does
not come within the purview of the definition of the terms, "subdivision" and "subdivided land," and
WHEREAS, the request for Subdivision Exemption #588 was submitted by James Brown
Farms Company, Go A. Bruce Johnson, 801 8th Street, Suite 220, Greeley, Colorado 80631, for
property which is located in part of Section 1, Township 6 North, Range 66 West of the 6th P.M.,
Weld County, Colorado, being more particularly described as follows:

West of the 6th P.M., Weld County, Colorado,
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the above described parcels of land be, and hereby are, declared to be
exempt from the definitions of "subdivision" and "subdivided land" as set forth in
Section 30-28-101(10), CRS, as amended, and Section 2-19 of the Weld County Subdivision
Regulations.
BE IT FURTHER RESOLVED by the Board that approval of Subdivision Exemption #588,
submitted by James Brown Farms Company be, and hereby is, conditional upon the following:
1. Community sewer service may be available from the Town of Eaton. In the event
the proposed structures are located within 400 feet of any community sewer
system, the structure must be served by that system. A Weld County septic permit
is required for any proposed home septic system and shall be installed according
to the Weld County Individual Sewage Disposal regulations.
2. Prior to recording the plat, the applicant shall dedicate a building envelope for the
purpose of maintaining productive agricultural land on Lot B. The proposed building
envelope shall be submitted to and approved by the Department of Planning
Services. The approved building envelope shall be delineated on the plat prior to
recording.

3. All existing and future accesses shall be maintained in compliance with Department
of Public Works requirements as stated in a referral dated April 30, 1996.
4. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
drawn in accordance with the requirements of Section 11.13.9 of the Weld County
Subdivision Regulations. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 12th day of June, A.D., 1996.

is to exempt off the existing buildings from the irrigated
farm . The two houses then need to be split in order for one
family member to live in one house and a different family
member to retire / live in the other .
The purpose of this request is to allow the farm to be sold
for retirement reasons and allow family members to continue

This Counterproposal concerns the Vacant Land/Farm and Ranch Contract
to Buy and Sell Real Estate, dated March 4, 1996 , submitted by Lind
Land Co. and/or assigns, Buyer, to the James Brown Farms Co . , Seller.
The undersigned accept the proposed contract, subject to the following
amendments :
1 . This is an agreement to purchase what Seller calls the North
portion of its farm south of Eaton except for two houses . The
dividing line from the southern portion and the acreage estimate
is based upon the existing fields of Seller' s farm and the land
upon which the excluded houses are located. The parties are
familiar with that division and agree that the price is set
regardless of the actual acreage determined as a result of the
survey.
2 . Buyer shall make a $25 , 000 . 00 earnest money deposit .
