GREELEY, CO 80632 COLORADO August 3, 1998 Secretary of State 1560 Broadway Denver, CO 80202 Board of County Commissioners 915 Tenth Street Greeley, CO 80631 Weld County Council 915 Tenth Street Greeley, CO 80631 Dear Secretary of State, Board, and Council: Pursuant to § 24-18-109(3)(b) and § 24-18-110, C.R.S.,this letter constitutes disclosure of a relationship which may have the appearance of a conflict of interest in my official duty as a member of the Board of County Commissioners of Weld County, Colorado. My husband, Roger Harbert, and I own a rental property at 403 10th Street. We currently have a contract to sell the property to Gerardo Ramos and Maria Isabel Gutierrez. It is my understanding that a portion of the money they plan to use to purchase the property will come from the High Plains Housing Development Corporation ("High Plains"). As a member of the Board of County Commissioners, I participated a number of years ago in establishing the High Plains. High Plains is a non-profit corporation designed to assist persons in getting adequate housing in Weld County. High Plains was incorporated and listed with the Colorado Secretary of State's Office as a non-profit corporation in 1994. By Resolution dated June 27, 1994, the Board of County Commissioners appointed the initial members of the Board of Directors; however, since that time, the members of the High Plains Board have made all of the appointments to fill vacancies on the Board. In the Board of County Commissioners' function sitting as the Weld County Housing Authority, I have / 1/ /(A3196-194' j 981483 vg/fly ( Conflict of Interest August 3, 1998 Page 2. participated in at least one decision to approve a contract with High Plains for home ownership assistance. I may be asked to do so again in the future. The contract was general in scope. It did not deal with any specific grants to persons for housing. Decisions on specific grants by High Plains are made without input or decision making by the Board of County Commissioners, or when the Board sits as the Housing Authority Board. Additionally, the grants funded by the contract were for properties located in the unincorporated areas of Weld County (outside of municipalities). The property which Roger and I are selling is located within the City of Greeley. I have discussed this matter with Bruce T. Barker, Weld County Attorney, and he and I concur that I do not have a conflict of interest in the contract for the sale of the property, in my continued work on the Board of County Commissioners, or as a member of the Housing Authority Board.
