Whereas, on May 18, 1999, a Petition for Annexation was filed with the Town by Rodger S. and Janet K. Streed, who comprise more than fifty percent (50%) of the landowners in the area described on Exhibit A, attached hereto and incorporated herein, known as Streed Annexation No. One, who own more than fifty percent (50%) of said area, excluding public streets and alleys and any land owned by the Town of Platteville; and Whereas, said Petition requests the Town of Platteville to annex said area; and Whereas, Section 31-12-107(1)(f), C.R.S., requires that the Board of Trustees, without undue delay, take appropriate steps to determine whether the Petition substantially complies with §31-12-107(1), C.R.S.; and Whereas, the Town Administrator has reported to the Board of Trustees that said Petition is in substantial compliance with the applicable requirements of §31-12-107(1), C.R.S.; and Whereas, Section 31-12-108, C.R.S., requires that any resolution finding compliance of a Petition for Annexation shall also establish a date, time, and place that the Board of Trustees will hold a public hearing to determine whether the proposed annexation complies with the applicable requirements of §31-12-104 and §31-12-105, C.R.S., and is eligible for annexation; and Whereas, i.he Board of Trustees has determined that said Petition for Annexation is in substantial compliance with §31-12-107(1), C.R.S.; and Whereas, lie Board of Trustees desires to set a date, time and place for public hearing to determine whether the proposed annexation complies with the applicable requirements of §31-12-104 and §: 1-12-105, C.R.S., and is eligible for annexation; Pti Pcci /f, Cm �, / . 991642 NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of the Town of Platteville, Colorado, as follows: Section 1. The Board of Trustees hereby finds and determines that: (a) A Petition for Annexation has been filed with the Town Clerk signed by Rodger S. and Janet K. Streed, who comprise more than fifty percent (50%) of the landowners who own more than fifty percent (50%) of the area described on Exhibit A, attached hereto and incorporated herein., known as Streed Annexation No. One, excluding public streets; and alleys and any land owned by the Town of Platteville; (b) Said Petition requests the Board of Trustees to annex said area; and (c) Said Petition substantially complies with and meets the requirements of §31-12- 107(1), C.R.S. Section 2. Pursuant to §31-12-108, C.R.S., public hearing is scheduled for August 3, 1999, at the hcur of 7:30 p.m., to determine whether the area proposed to be annexed complies with the applicable requirements of §31-12-104 and §31-12-105, C.R,S., and is eligible for annexation; whether or not an election is required under §31-12-107(2), C.R.S.; and whether or not additional terms and conditions are to be imposed. Said hearing shall be held at the Platteville Town Hall, 400 Grand Avenue, Platteville, Colorado. Section 3. The requirements of Sections 4 and 5 of the Municipal Annexation Act of 1965 (C.R.S. 1973, 31-12-104 AND 31-12-105, as amended) exist or have been met in the following particulars: a. Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is contiguous with the Town of Platteville. b., A community of interest exists between the area proposed to be annexed and the Town of Platteville; said area is now agricultural and should be urbanized in the near future; and said area is integrated with the Town of Platteville. c. No Petition for Annexation of the territory described herein or any part thereof is pending or has been made to any other municipality. 4. The landowners of one hundred per cent (100%) of the territory included in the territory proposed to be annexed (exclusive of public streets) have joined in and have signed this Petition. 5. After annexation to the Town of Platteville, the land shall be subject to all the laws, ordinances, regillations and taxes of the Town of Platteville. 6. Petitioners acknowledge that they will be required to pay all fees as set forth by the Ordinances of the Town of Platteville and agree to make such payments upon request. 7. The Petitioners desire the zoning classifications set forth upon his Annexation Map filed herewith and designated in their zoning petition filed herewith. 8i The non-refundable annexation application fee of $150.00 is tendered herewith, together with a deposit to cover costs of publication, recording fees, appraisal fees and any other reasonable expenses incurred by the Town in reviewing and processing this Petition. Petition. a) The area to be annexed lies at the west of Grand Avenue and is bordered as follows: The east boundry is Weld County Road 23-1/2; the north boundry is Weld County Road 32-1/2; the south boundary is the access road to the Ward Residence (a part of the Ward Annexation), lying directly north of Old Homestead Farm Subdivision; the west boundry is the low-lying land which will continue to be owned by the Streed Living Trust dated June 5, 1998. The legal descriptions for Streed Annexation No. One and Streed Annexation No. Two are attached hereto and made a part hereof by this reference. b) A Commitment for Title Insurance is submitted herewith as evidence of the fee simple ownership of the land to be annexed. A letter from the Streeds is submitted herewith to grant permission to James W. Plumb, Jr., President of Plumb Development, to allow him to proceed with the annexation and zoning requests on their behalf. c) The only water right associated with the property is a well owned by the Streed which will be relocated to the specific site on the property for the purpose of irrigating the open space/park area of the completed subdivision. Annexation Map. ti Five copies of an annexation map of the property to be annexed are included herewith, which have been signed by a registered engineer. a) The'property to be aimexed is adjacent to the corporate Town limits along the entire southern boundry, and on the east where the Patina property lies. After the Streed Annexation No. One is annexed, the north boundary of such annexation shall be another contiguous border so as to conform to the 1/6 contiguous requirement. b) No special districts have jurisdiction over the area to be annexed. c) Repealed. d) A street easement, 30 feet in width, exists along the east and north boundary of the property. e) A 6" water line and a gas line, as well as power, phone, and sewer lines serving Old Homestead Farm, exist at the east side of the property. f) Within the area to be annexed, the Streed residence exists, consisting of one brick home and five outbuildings for agricultural purposes, together with several small sheds. A water tap from South Central Weld serves the home, and Public Service provides electric. Greeley Gas supplies gas, and a septic system provides for sanitation needs. g) Requested zoning for the entire property to be annexed will for single family resdential use (R-1). h) Repealed. ' 14-3-3. Impacts Report. a) The project is expected to be built out in 6 to 10 years. The following will be applicable: 1) Density for residential nsaue will be 2.79 units per acre. 2) All rtructures will be single family residences, and will be 1500 square feet of finished living area each, on average. 3) The agFegate area requiring irrigation water will be approximately 6.4 acres. Water for this open space/park area will come from a well known as Eric, Ltd. Well No. 1-10805, which is part of the land purchase, and which will be relocated onto the open space as indicated on the map. Sprinkler systems will be provided for the open space area, with this well as the source. n, 4) Impervious surfaces will total approximately 16 acres. 5) There will be no commercial or industrial uses within this annexation. 6) Since the proposed project will be residential and within the scope of the current plan for future growth within Platteville, there will be no extraordinary demands on utilities or other services.
