As you know, I requested this information on April 1, 1997. Unfortunately, however, ample time does not exist now for me to either adequately analyze and digest the information, let alone distribute this to the appropriate parties within the Anna Kaminsky Company prior to the hearing. We feel that a tower of this magnitude in this specific area would definitely be poor planning by Weld County. The location would have a direct effect on approximately 14 or 15 residents, all within a mile of the proposed building site. We are seriously concerned about the following: 1. Several realtors we contacted expressed the opinion that the effect of the tower on surrounding property values would be devastating. 2. This tower would be constructed in an area frequented by numerous small planes, creating a hazzard. 3. One of the flight paths of Denver International Airport is in this area. Even though commercial planes come over at a much higher altitude, accidents happen; and a 500 foot tower raises the odds of such an accident. 4. Our home is adjacent to the land being considered for this tower. The deck on the back of our home faces Southwest and the tower would be fully visible from our deck. Having to look at such a monstrosity every time we go on our deck or look out the windows on the back of our home would be AWFUL! If construction of this tower is necessary, there is plenty of open ground around this area that would not be so near to many residences. Please don't approve this; we feel it is so unfair to a large number of citizens, most of whom weren't even notified about this proposal. Unfortunately, we will be out of state the date of the hearing and will not be able to attend; but trust this letter expresses our feelings. Planning Dept. The location of this 70 foot mammoth tower is directly over my client's mineral rights, and adjacent to their farm property. I am writing to advise you of our vehement opposition to this proposal. As you know, this use is not allowed by right. This proposal is clearly incompatible with the existing use of this land and the surrounding area. We fear that this could jeopardize the preservation of both this agricultural land along with our use, and planned use of our mineral rights. This proposal would obfuscate our reasonable surface use in this area with respect to our mineral rights. It is foreseeable that it could further endanger the health, safety and welfare of those in the area. Finally, based upon the foregoing, I am sure you understand how this proposed use would seriously diminish the value of our mineral rights, and our adjoining land. The purported plan flies in the face of logic, and we respectfully request that you deny this plan. Indeed, as I expressed to you this morning, what once appeared to be a mammoth tower is truly a monstrosity. My previous concern has now been heightened seven -fold. In essence, the tower being proposed is the functional equivalent of at least a 40 -story building. Words alone cannot adequately express our deep concern over this proposal. Clearly, all of the reasons that I previously wrote you and cited as deficiencies has now increased dramatically. I would appreciate it if you could provide me with a copy of the proposed plan, and I strongly urge the Commission to deny this outrageous use. The potential harm involved here to the Anna Kaminsky Company would be nothing short of substantial. Such a radio booster tower (with its accompanying flashing red lights) is not appropriate in an agricultural zone, particularly for the farmers/residents who have homes in the area. In addition, it would be detrimental to those of us whose homes are not in the immediate vicinity but have, at this time, an unobstructed view of the foothills.
