Licensee by this voluntary surrender hereby requests the Division, on behalf of the Colorado State Liquor Licensing Authority, to immediately cancel, terminate, and void Licensee's Colorado State Alcoholic Beverage License. Licensee states that this surrender of Licensee's State Alcoholic Beverage License and licensing privileges is made voluntarily by the Licensee, and that Licensee is not surrendering the aforesaid State Alcoholic Beverage License and privileges as the result of any threat, promise, or coercion by the Division or any of its agents or employees. Martinez, D/B/A Gill Recreation Center, 5 '/ Lots 11 and 12, Block 6, Gill, Colorado 80624, ("Licensee") for his 3.2 Percent Beer Retail license (On Premises) on the following grounds: Pursuant to Regulation 46-105.3., 1CCR 203-1, each retail licensee selling fermented malt beverage on draft, or selling such beverages in sealed containers for consumption on the premises, shall maintain his establishment in clean and sanitary condition and in full compliance with the requirements of restaurants under the supervision of the State Board of Health. If the licensed establishment is a restaurant licensed by the State Board of Health, it shall maintain such license in full force and effect at all times while selling such beverages for consumption therein. It is alleged that on or about June 12, 1997, the Licensee failed to maintain his establishment in a clean and sanitary condition as required by the State Board of Health; specifically, the Licensee failed to maintain sanitary restroom facilities on the premises.
