ADDRESS: 12450 N. Washington St. Thornton, CO 80241 REQUEST: Site Specific Development Plan and Planned Unit Development Final Plan for a 19 lot subdivision in a PUD C-3 and I-1 zone district. LEGAL DESCRIPTION: Pt. N/2 10-02-68 LOCATION: South of and adjacent to SH 119; approximately'/2 mile west of I-25 west frontage road. PARCEL: 1313 10 000063 THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 28.9 of the Weld County Zoning Ordinance, as amended 2. The request is in conformance with Section 28.13 of the Weld County Zoning Ordinance, as amended as follows: 1 97265 EXHIBIT a o- 1 Recommendation; 5-431 Western Dairymen, Inc. PUD Page 2 A. The proposed P.U.D. Final Plan is consistent with the Weld County Comprehensive Plan and is compatible with the future development as permitted by the existing P.U.D. District and plans of affected municipalities. The City of Longmont has reviewed the request and fords no conflicts if consistent with the MUD Plan. The Town of Mead reviewed this request and indicated that the proposal does not affect their Comprehensive Plan. It is the opinion of the Department of Planning Service's staff that the comments listed in Mead's referral response have been addressed. The Town of Frederick reviewed this proposal and indicated no conflicts. B. The P.U.D. Plan conforms to the approved P.U.D. District. The Utility Coordinating Advisory Committee reviewed and conditionally approved the P.U.D. utility plan at its August 14, 1997 meeting. The concerns of the Utility Coordinating Advisory Committee are addressed in the conditions of approval. C. The uses, buildings, and structures shall be compatible with the existing and future development of the surrounding area as permitted by the existing zoning, and with the future development projected by the Comprehensive Plan or Master Plan of affected municipalities. D. The proposed P.U.D. Final Plan conforms with the performance standards in Section 35.3 of the Weld County Zoning Ordinance. E. The proposed P.U.D. Final Plan will be in compliance with the Weld County Zoning Ordinance, Section 50, Overlay Districts. The site is located within the MUD area and shall comply with adopted regulations of Weld County MUD Ordinance 191. A portion of the site is located within the Flood Hazard Overlay District. Conditions of approval address the Overlay Districts requirements. This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding this request, and responses from referral entities. 972652 Recommendation; S-431 Western Dairymen, Inc. PUD Page 3 The Department of Planning Services' staff recommendation for approval is conditional upon the following: 1. Prior to recording the P.U.D. Final Plan plat: A. The Board of County Commissioners shall review and approve the subdivision improvements agreement for off -site and on -site improvements and the form of collateral. The security for the agreement shall be tendered and accepted by the Board of County Commissioners for the subdivision improvements agreement. B. A phasing plan for construction of the development shall be submitted for review and approval and accepted as part of the improvements agreements. C. A complete covenants and development guideline shall be submitted for review and approval and accepted by the Board of County Commissioners. D. Sidewalks, in compliance with the MUD Ordinance 191, shall be clearly delineated on the landscape plan. 2. The following notes shall be placed on the P.U.D. Final Plan plat prior to recording: A. The uses permitted within the P.U.D. Final plan shall include a total of nineteen lots and open space which comply with the P.U.D. Zone District requirements and as described in the application materials. B. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. C. Left Hand Water District shall provide water service to all uses within the PUD Zone District. D. St. Vrain Sanitation District shall provide sewage disposal to all lots within the PUD Zone District. 972652 Recommendation; S-431 Western Dairymen, Inc. PUD Page 4 E. Installation of all utilities shall comply with Section 10 (Design Standards) of the Weld County Subdivision Ordinance, as amended and the conditions of the Weld County Utility Board. F. All uses within the P.U.D. Final Plan shall comply with the requirements of the Mountain View Fire Protection District. G. Access to the development shall be from WCR 7.5 which intersects SH 119. H. All uses within the P.U.D. Final Plan shall maintain compliance at all times with the Department of Army, Corp of Engineers requirements/standards. L Street signs and lot identification shall be in place prior to release of building permits. J. Exterior illumination of structures, yards and driveways shall be restricted as follows: (I) Sources of light shall be shielded so that beams of light will not shine directly onto adjacent properties. (2) Neither the direct or reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. K. Landscaping and signage shall comply with the MUD Ordinance 191. L. Prior to release of building permits for structures, foundation plans shall be submitted bearing the stamp of a Colorado Professional Engineer for review and approval by the Weld County Building Inspection Department. M. Prior to any use or construction of any lot within the PUD a Site Plan Review application shall be submitted, reviewed, approved and conditions met. N. Dear Mr. Yando: Your application and related materials for the request described above are complete and in order at the present time. I have scheduled a meeting with the Weld County Planning Commission for Tuesday, October 7, 1997, at 1:30 p.m. This meeting will take place in the Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. In addition, I have scheduled a meeting with the Weld County Utilities Advisory Committee for Thursday, August 14, 1997, at 10:00 a.m. This meeting will take place in the Weld County Administrative Offices, 1400 N. 17th Avenue, Greeley, Colorado. It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three miles of the property in question or if the property under consideration is located within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to the Firestone, Frederick, Longmont, and Mead Planning Commissions for their review and comments. Please call Rick Patterson with the Town of Firestone, at 303-833-3291, John McGinn with the Town of Frederick, at 303- 833-2388, Brad Schol with the City of Longmont, at 303-651-8330, and Kelly Smith with the Town of Mead, at 970-535477, for information regarding the date, time and place of the meeting and the review process. It is recommended that you and/or a representative be in attendance at each of the meetings described above in order to answer any questions that might arise with respect to your application. A representative from the Department of Planning Services will be out to the property to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event the property under consideration is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property and post a second sign at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way. The Department of Planning Services' staff will make a recommendation concerning this application to the Weld County Planning Commission.
