Dear Mr. Jerman:
We have received the above referenced proposal to subdivide 79.3 acres into 5
residential lots. The proposed water source is Central Weld County Water District and a letter
of commitment has been submitted.
As required in Section 30-28-136(1)(h)(II), C.R.S., a municipality or quasi-municipality
which is designated as the source of water for a proposed subdivision, shall file a report with
the county and state engineer documenting the amount of water which can be supplied without
causing injury to existing water rights. Such a report should include a summary of water rights
owned or controlled by the District, the yield of these rights both in an average year and a dry
year, the present demand on the system and the anticipated demand due to commitments for
service entered into by the District, and the amount of uncommitted firm supply the District has
available for future development. A report of this nature has not been submitted to this office
since 1984.
The "Water Supply Information Summary" form which was provided to the county along
with the State Engineer's August 7, 1995 letter was not included with this submittal. As stated
in the State Engineer's letter, this form is required to be submitted along with each subdivision
referral in order for our office to respond to the county.
Based upon the above and pursuant to Section 30-28-136(1)(h)(II), it is our opinion that
the District has not submitted sufficient evidence documenting that the proposed water supply
can be provided without causing injury to existing water rights.

The Weld County Health Department has conducted a thorough review of this proposal.
Please note that our review was conducted with the understanding that this proposal is
subject to the Planned Unit Development Ordinance No. 197, effective January 26, 1998.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service.
Water will be provided by the Central Weld County Water District and sewer will be
provided by individual sewage disposal systems. The minimum proposed lot sizes (>4.5
acres) and the overall density of homes per acreage (1 home per 16.0 acres) meets
current Department policy.
The proposal does not provide a potential environmental impact plan as required in section
6.3.1.2.1 of the PUD Ordinance.
Our staff observed numerous agricultural type homes in the vicinity of the site. Many of
these homes have livestock that include but may not be limited to cows and horses. We
also observed that a small feedlot is located to the south of the site. It is our opinion that
any future property owner should be made aware that these agricultural uses exist and
that they may be exposed to noise, dust, flies, odors, etc. in excess of the common urban
experience. As a result, we recommend that the "Right to Farm" covenant be required to
be placed on any recorded plat.
In the event that you find the submitted application to comply with the PUD Ordinance, we
recommend that the following conditions be a part of any approval:
1),The applicant shall obtain water service from the Central Weld County Water District.
2) A Weld County Septic Permit is required for each proposed home septic system and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations.
3) Open space maintenance shall include removal of manure in a manner that will •
prevent nuisance. The manure piles shall not be allowed to exist or deteriorate to a
condition that facilitates excessive odors, flies, insect pests or pollutant runoff.
Please note: The Weld County Health Department, Environmental Protection Services

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
WCR 48 is designated on the Transportation plan Map as a local gravel road with an ADT of 159 vehicles. WCR
53 is designated as a Collector Status Road with an ADT of 216. Both average daily traffic counts are from 1997.
Both of these roads are maintained by Weld County.
I am reviewing this as a minor subdivision PUD (rural).
A traffic impact analysis for the rural PUD will not be required.
A storm water drainage study will not be required for the rural PUD. The large acres and flat needs of the area will
not generate a significant amount of runoff.
REQUIREMENTS:
Access: All lots will access from the internal road system, no direct access will be allowed onto the county road.
The typical cross section for a minor subdivision will be: 60 feet of right-of-way with adequate borrow pit ditches,
18 feet of driving surface, and a four-inch thick aggregate base course, Class 5 or 6. The cul-de-sac will have a
minimum 50-foot radius and the cross slope to drain water will be 2%. No culvert will be required at the proposed
access point from WCR 48. The applicant should provide an adequate turning radius in both directions to
accommodate larger vehicles.
The On-site Improvements Agreement will be submitted at Final Plat. At that particular time, the Improvements
Agreement Policy regarding Collateral for improvements (private road maintenance) will be submitted for review
and approval.

Dear Mr. Jerman:
I've reviewed this second submittal on Big Sky Properties,which indicates minor
changes in the plat: former lot 4 has been eliminated and the access road has been
extended to a cul de sac. With regard to petroleum operations, building exclusion zones
have been shown on the map, but the access easement to the tank on the eastern side of
the property has not. There should also be plat notes that indicate that the operator will
have access to the subdivision road, Burman Lane. The final plat should address both of
these issues.
My previous comments on the existing conditions at the site should be considered in
development, and I've included a copy of my January letter. The drainage on the site is
poor near the irrigation ditches. However, the 51-acre lot south of the Gilmore Ditch will
probably remain agricultural, and the former lot 4 has been eliminated. The remaining
lots should not experience any unusual drainage problems. Please call me if there are any

Dear Ms. Eastin:
In response to your request and in accordance with Senate Bill 35, I visited this property
to review the plat. A Geologic Engineering Report prepared by Terracon (January 1998)
was included in the referral.
The site consists of grassland that slopes gently to the north toward Gilmore Ditch. The
northern 53 acres that will not be developed is under cultivation. A piping assembly
related to oil and gas production is located in the center of the lower 27 acres. An oil
storage tank is located on the eastern margin of the property and another tank is located
just west of the southwest corner of the property.
1) Soil. The site is covered by silty sands derived from the underlying Laramie
Formation. Information from the Soil Survey of Weld County indicates that bedrock may
be present as shallow as 3 ft below ground level. If such subsurface conditions exist
excavating for foundations may be difficult.
In addition, shallow bedrock may pose problems for conventional septic systems.
Wastewater may pond on the bedrock surface and cause system inefficiency or failure.
I recommend that an 8-ft trench be excavated on each lot to observe the soil and bedrock
profile. The subdivision lots are of sufficient size to accommodate oversizing the leach
fields, if it does become evident that bedrock is present at shallow depths. Conversely, if
fractures are present in the bedrock, these may lead to faster percolation rates and
reduced filtration effect. In such instances the native soil should be combined with a clay
mix to slow percolation rates.

Soil on adjacent properties showed the presence of a whitish material,probably sulfates.
These compounds can be corrosive to concrete, and it would be worthwhile for
homeowners to have chemical analyses performed on the soil to determine whether a
special mix concrete is required.
2) Drainage on the site may be poor in places particularly near the Gilmore Ditch and the
onsite irrigation ditch. Residences and leach fields should be sited away from these
features to avoid this situation.
3) Petroleum operations. The plat shows circles around the storage tank and the piping
assembly, which I assume mean building exclusion zones. This should be labeled as such
on the plat. Access easements to the piping assembly should also be indicated, and plat
notes should indicate that the operators of Patina Oil and Gas will be permitted access to
their operations. The project surveyor should investigate whether the tank west of the
site is of such proximity that an exclusion zone would extend into Lot 2.
In summary, the main concern at the site is the potential for shallow bedrock and the
consequences this would pose for standard leach fields. Subsurface conditions should be
investigated lot-by-lot to determine the best design for the leach fields. Please call me if

Dear Mr. Jerman:
Reference is made to the Planned Unit Development Change of Zone planned
from A (Agricultural) to E (Estate). This is located in Section 5, Township 4 North,
Range 64 West, Weld County, Colorado.
The project has been reviewed in accordance with Section 404 of the Clean Water
Act under which the U.S. Army Corps of Engineers regulates the discharge of dredged
and fill material, and any excavation activity associated with a dredge and fill project, in
waters of the United States such as streams and wetlands. Based on the plans presented,
this project will not require a Department of the Army (DA) permit.
Although a DA Permit will not be required for the project, this does not eliminate
the requirement that other applicable federal, state, tribal, and local permits be obtained if
needed.
