RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST WOODY S. KISLOWSKI FOR VIOLATION OF THE WELD
COUNTY BUILDING CODE AND ZONING ORDINANCES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Woody S. Kislowski, VI #9700211, is allegedly in violation of the Weld
County Building Code and Zoning Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 10th day of February, 1998, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Woody S. Kislowski, property owner, was not present or represented at
said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS, the Board deems it advisable to bring legal action against the individual as
hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Woody S. Kislowski to remedy the violation of the Weld
County Building Code and Zoning Ordinances, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties.

October 15, 1997 Letter and petition received from surrounding property owners addressing concerns.
November 17, 1997 Letter sent to property owners from Dave Sprague, Lead Inspector, requesting that all
unfinished work be completed and the building permit finaled.
December 4, 1997 Letter sent to the property owner with a deadline of January 5, 1997, to correct this
violation.
January 19, 1998 Telephone conversation with property owner. He stated he wants to remove the
mobile home. He was informed that if the mobile home is not removed by January 29,
1998, the Department of Planning Services would schedule him before the Board of
County Commissioners at a violation hearing.
January 30, 1998 Progress inspection of the property. Property is still in violation.
January 30, 1998 Letter sent to the property owner notifying him of the impending violation hearing
scheduled for February 10, 1998, at 10:00 a.m.
The mobile home without final inspections is in a state of disrepair and still located on the property, therefore is
a violation of Sections 43.2.7.5 and 43.2.7.8 of the Weld County Zoning Ordinance and Sections 20.9.1.1,
20.9.3, and 70.4.2 of the Weld County Building Code Ordinance. To bring the property into compliance the
mobile home will have to be brought into compliance or removed from the property.
The Department of Planning Services also recommends that the County Attorney authorize legal action against
any other persons occupying the properties, any persons claiming an interest in the properties, and any persons
acting in active concert with the identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled a
meeting with the Board of County Commissioners on February 10, 1998, at 10:00 a.m.to consider the violations
occurring on the property. This meeting will take place in the County Commissioners' Hearing Room, first floor,
Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners

To bring the mobile home into compliance all required inspections must completed and the mobile home must be
fixed so that it is not in a state of disrepair. As another option, the mobile home could be removed from the
property.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have until January 5, 1997 to correct this
violation. Failure to do so will result in this office scheduling the violation before the Board of County
Commissioners to consider whether to refer the violation to the County Attorney's office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be of any
assistance in clarifying or answering questions concerning this matter. Please call or write the Department of

In reviewing our records, we noticed that the above permit has not been finaled. The Weld County
Building Code Ordinance requires that all inspections on mobile homes or manufactured homes be
satisfactorily completed within 180 days after the permit has been approved.
The blocking and skirting inspections need to be approved before the permit is completed.
Please make arrangements to complete all unfinished work and have all inspections completed within
ten (10) days of the date of this letter. Failure to comply with this notice by November 27, 1997, may
result in the issuance of a violation notice.

To Whom it May Concern,
In February of 1997,a 14'x 70' trailer(former mobile home)was moved on to the property adjacent to
mine. In an attempt to better understand Weld County zoning ordinances. I placed numerous phone calls
as well as visiting in person the Weld County planning and zoning office,Bruce Barker and Lee Morrison
of the county attorneys office regarding the trailer. On my July 24 visit I was told by Mr.Barker that he
would contact the Planning and Zoning department and inform them of my concerns and that I would be
kept informed of the status of the trailer permit. I have yet to hear from any Weld County agency.
A permit #PR-9730050 was issued on March 4, 1997 by the Weld County Planning and Zoning to a
Woody Kislowski allowing the trailer to be placed on his property 2726 WCR#10(24860-C4, L4 NE4
16 1 68 AKA CARLSON SUB)this permit expires on 10/21/97.
I understand the trailer was issued the permit under Zoning Ordinance 43.2.7. I do not however,feel that
the trailer meets all the requirements of the ordinance. Specifically 43.2.7.1.1.
The trailer has broken windows,holes in the exterior,and looks more like junk than a storage vessel.
(please see pictures). My husband and I,as well as the surrounding neighbors work hard to keep our
homes and property well maintained. This trailer is in no way compatible with the surrounding area and I
request that the permit not be renewed.
Attached please find a list of other concerned property owners. We would like to see the trailer:
1. Removed
2. Classify area as a commercial junk yard and screen trailer from view(screen with something
that would immediately block the trailer from public view), Or
3. Fix the trailer up to fit in with the harmony neighborhood.
I would like to note that a smaller, more attractive trailer(mobile home)in the area,was classified as a
commercial junk yard by the Weld County planning and zoning and the owners were forced to screen it
from view. This trailer was being used as agriculture storage. Why the inconsistency?
This letter was hand delivered to the Weld County planning and zoning as well as the county attorney's
office on Oct. 17, 1997.Please call me with your final resolution or I f you have any questions, I can

NOTICE
The applicant, agents and employees shall comply with all the rules, restrictions and requirements of Weld County Zoning Regulations
And Weld County Building Code Ordinance governing location, construction, demolition, and erection of the above proposed work for
which this permit is granted. The Building Official or her/his agents are authorized to order the immediate cessation at any time a
violation or the adopted, codes or regulations appears to have occurred. Violation of any of the codes or regulations may result in
the revocation of this permit.
Buildings must conform with the plans as submitted to the Department of Building Inspection. Any changes of the plans or lay out
must be approved prior to construction. Any changes in the use or occupancy of the building must be approved.
When the mobile home complies with the provisions of the Weld County Building Code Ordinance, the Building Official shall issue a
Certificate of Final Inspection. The Certificate of Final Inspection shall be obtained no later than 180 days after the mobile home
is issued. Failure to obtain the Certificate of Final Inspection within the stated 180 day period will be sufficient reason to
consider the mobile home in violation of the Weld County Building Code Ordinance.
