Keithley Department of Planning Services Weld County Administrative Offices 1400 North 17th Avenue Greeley, Colorado 90631 Dear Kerri, This letter is concerning your inquiry of July 17, 1997 about Special Use Permit SUP -3 for a Commercial Hog Operation at 8845 Weld County Road 49. This property has not been used for a hog operation since we purchased the property in 1992. We have no intention of ever using this land for that purpose. Please vacate the Special Use Permit. Thank you, July 17, 1997 DEPARTMENT OF PLANNING SERVICES PHONE (303) 353-6100, EXT.3540 FAX (303)352-6312 WELD COUNTY ADMINISTRATIVE OFFICES 1400 N. 17TH AVENUE GREELEY, COLORADO 80631 Laverne Browning 8960 Weld County Road 49 Hudson, Co., 80642 Subject: Violation/vacation of Special Use Permit SUP -3 for a Commercial Hog Operation permitted by the Board of County Commissioners on October 24, 1997. Dear Ms. Browning: It has come to the attention of the Department of Planning Services' staff that the uses on your property, 8960 Weld County Road 49, may not be in compliance with the Weld County Zoning Ordinance, as amended. The potential noncompliance with the Zoning Ordinance is a Special Use Permit, SUP -3, which was permitted in 1967 for a Commercial Hog Operation. Since the use of the hog operation has discontinued for a period of at least three (3) consecutive years, the Department of Planning Services considers this Special Use Permit to be inactive. The Department will hold an administrative hearing to vacate the Special Use Permit. Prior to the vacation, however, a letter is required from all affected property owners indicating that the special use activity is no longer in existence. Please call me within five working days of the date of this letter to review the concerns with me. Sincer y, Kerri D. MEMORANDUM Is TO: Board of County Commissioners August 11, 1997 COLORADO From: Kerri D. Keithley, Current Planner SUBJECT: USR-1143, KKDD-FM Broadcasters USR-1143 was approved by the BOCC on May, 14, 1997. The USR was for a 493' radio booster station. The applicant, Bob Zellmer, has been in contact with the Department regarding certain conditions of approval. As this case is becoming rather confusing, the Department of Planning Services would like to update the Board on the process in which Mr. Zellmer and the Planning Department are pursuing. UPDATE ON USR-1143 COA#6E: COA #6F: This condition states that the Special Use Permit (SUP -3) currently on the site, which was for a commercial hog operation, shall be vacated prior to recording the USR plat. SUP -3 encompasses a total of 15 properties. The ideal remedy to vacate this SUP would be to have all 15 property owners write a letter in favor of the vacation or to sign petition. The Department of Planning Services sent letters to all affected property owners and has received responses for the vacation from 6 owners (40 percent of the total). In addition to the letters, staff has also followed up with a phone call to those not replying to the letter. Staff has left messages for the majority of the property owners, however two persons did indicate that they are writing the letter for the vacation. When discussing the situation with Lee Morrison, he indicated that for a small portion of the property owners not responding, a letter could be mailed stating that as no response was received, the permit was vacated. Lee, did say that this should not be done for the majority of the responses. Another option to vacate the permit would be to schedule it for Probable Cause/ Show Cause hearings. Staff has also created a petition list for Mr. Zellmer to give him the option of hand delivering the vacation request to the affected property owners to obtain their signatures. Mr. Zellmer indicated that he did not think that this approach would be wise, as people in the area did not want the tower to be erected. This condition states that the mobile home on the site permitted as an accessory to the farm shall be either removed from the site or documentation provided to substantiate its use. Documentation was provided from the resident of the mobile home that they currently do not have any animals on the site.
