RE: APPROVE CONTRACT AMENDMENT#1 FOR TUBERCULOSIS CONTROL AND
OUTREACH SERVICES AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Contract Amendment #1 for
Tuberculosis Control and Outreach Services between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Weld County
Health Department, and the Colorado Department of Public Health and Environment,
commencing January 1, 1998, and ending December 31, 1998, with further terms and conditions
being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Contract Amendment#1 for Tuberculosis Control and Outreach
Services between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Health Department, and the
Colorado Department of Public Health and Environment be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of August, A.D., 1998, nunc pro tunc January 1, 1998.

CONTRACT AMENDMENT#1
This AMENDMENT is made this day of JULY, 199 ,by and between: the State of Colorado,for the
use and benefit of the DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT,whose address
or principal place of business is 4300 Cherry Creek Drive South.Denver. Colorado 80246-1530,
hereinafter referred to as"the State"; and,the WELD COUNTY HEALTH DEPARTMENT,whose
address or principal place of business is 1517 16th Avenue Court. Greeley. Colorado.80631,hereinafter
referred to as"the Contractor".
WHEREAS,as to the State,authority exists in the Law and Funds have been budgeted, appropriated, and
otherwise made available and a sufficient uncommitted balance thereof remains available for subsequent
encumbering and payment in Fund Number 100, and Appropriation Codes 351,362, and 363 under Contract
Encumbrance Number PO FHA EPI9808149;
WHEREAS,the parties entered into a contract dated January 1.1998,whereby the Contractor was to
provide certain local health services to the residents of Weld County on behalf of the State;
WHEREAS,the State has received funding from the Centers for Disease Control and Prevention(CDC) and
the State of Colorado General Fund to provide tuberculosis control and outreach services;
WHEREAS,as of the effective date of this Amendment,the State has a currently valid Group II purchasing
delegation agreement with the Division of Purchasing within the Colorado Department of Personnel;
WHEREAS,this procurement is exempt from the Colorado Procurement Code and Rules because the
Contractor is a governmental entity of the State of Colorado;
WHEREAS, all required approvals,clearances, and coordinations have been accomplished from and with all
appropriate agencies.

WHEREAS,it is the intention of the parties hereto to increase the total financial obligation of the State in
the Original Contract by Twenty Thousand Three Hundred Six Dollars ($20 306.00.002,for the period of
January 1, 1998,through December 31, 1998,in exchange for the Contractor's performance of additional
work related to tuberculosis control and outreach services; and,
NOW THEREFORE,in consideration of their mutual promises to each other,stated below,the parties
hereto agree as follows:
1. Consideration for this Amendment to the Original Contract, Contract Encumbrance Number
EPI9808149,Contract Routing Number 98-08149,dated January 1.1998, consists of the
payments which shall be made pursuant to this Amendment and the promises and agreements herein
set forth.
2. It is expressly agreed to by the parties that this Amendment is supplemental to the Original Contract,
Contract Routing Number 98-08149,dated January 1. 1998,hereinafter referred to as the"Original
Contract",which is incorporated herein by this reference,made a part hereof, and attached hereto as
"Attachment I". All terms,conditions and provisions thereof,unless specifically modified herein,
are to apply to this Amendment as though they were expressly rewritten, incorporated, and included
herein.
3. It is agreed that the Original Contact is, and shall be,modified, altered, and changed in the following
respects only:
A. By amending paragraph 14 of the Original Contract to read:
14. The State shall, in consideration of the services satisfactorily performed by the
Contractor under this Contract,cause to be paid to the Contractor a sum not to
exceed FIFTY FIVE THOUSAND, ONE HUNDRED NINETY-ONE
DOLLARS($55,191.00)for the initial term of this Contract—January 1, 1998,
through December 31, 1998. Of the contractual amount,Twenty Seven Thousand
One Hundred and Twenty-Six Dollars($27,126.00) are derived from a federal
source; and Twenty Eight Thousand Sixty-Five Dollars ($28,065.00) are derived
from the State.
B. By adding to the Original Contract a new paragraph 18,which reads as follows:
18. Tuberculosis control services pursuant to section 25-4-501,et sue, 8 C.R.S., as
amended,(as outlined in the budget below,Paragraph 19), are funded at 80%from
state funding sources and 20%from the county in which the recipient resides. The
Contractor shall be responsible to provide the 20%county funding,which funding
may be contributed in the form of an in-kind agency match.

C. By adding to the Original Contract a new paragraph 19,which reads as follows:
19. Reimbursement during the initial,and any renewal,term of this Contract shall be
conditioned upon affirmation by the State that all services were rendered by the
Contractor in accordance with the terms of this Contract. The following budget
shall govern the expenditure of funds for the initial term of this Contract-January
1, 1998,through December 31, 1998. The Contractor's transfer of funds from one
line item to another must have the prior,express,written consent of the State:

D. By adding to the Original Contract a new paragraph 20,which reads as follows:
20. To be compensated under this Contract,the Contractor shall submit a signed
monthly billing statement within sixty(60)calendar days of the end of the month
for which services were rendered. The Contractor shall request reimbursement for
the Contractor's salaries, Tuberculosis control services, and subcontracts,which are
allowable and allocable expenses related to this Contract.
The monthly billing statement shall:
A. reference this Contract by its contract number,which number is located on
page one of this document;
B. state the applicable performance dates,the names of payees, and a brief
description of the services performed,total expenditures incurred,and the
total reimbursement requested;
C. attach a statement detailing Direct Observed Therapy(DOT)visits during
the invoice period reporting the patient name(s), and the number(s) and
date(s)of DOT visits. The State shall keep these statements containing
patient information confidential and secured.
D. reflect the total program cost as the sum of the"Local Agency Match" and
"Amount Requested for Reimbursement"on the monthly billing statement.
The"Local Agency Match"shall document the Contractor's 20%
contribution of program costs.
4. The effective date of this Amendment is July 1. 1998.

5. Except for the"General Provisions"and"Special Provisions",in the event of any conflict,
inconsistency,variance or contradiction between the provisions of this Amendment and any of the
provisions of the Original Contract,the provisions of this Amendment shall in all respects supersede,
govern, and control. The"Special Provisions"shall always be controlling over other provisions in
the Original Contract or in any amendments thereto. The representations in the"Special Provisions"
concerning the absence of bribery or corrupt influences and personal interest of State employees are
presently reaffirmed.
6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL
YEAR ARE CONTINGENT UPON FUNDS OR THAT PURPOSE BEING APPROPRIATED,
BUDGETED,AND OTHERWISE MADE AVAILABLE.
7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN
APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH
ASSISTANT AS HE MAY DESIGNATE.

Amendment #1 to TB Contract
Enclosed for Board review and approval is Amendment#1 to the contract between the Colorado
Department of Public Health and Environment and the Weld County Health Department for TB
Control and Outreach services.
The Colorado legislature recently approved increasing the appropriation of funds toward
Tuberculosis control. This amendment reflects Weld County's appropriation, $20,306, of these
additional funds. Under the terms of this contract Weld County Health Department will provide
active treatment, medical evaluation services, conduct contact investigations and follow-up with
active patients to ensure they receive appropriate information and education.
For these services, the Health Department will receive a total of$55, 191 for the time period
January 1, 1998 through December 31, 1998.
