HomeMy WebLinkAbout980059 RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST HARVEY AND GLADYS WOLLERT FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Harvey and Gladys Wollert , VI #9700195, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of January, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Harvey and Gladys Wollert, subject property owners, were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals as hereinabove named to correct said violation. This inspection revealed an unsanitary environment and is in violation of the Rules and Regulations Governing the Sanitation of Child Care Centers in the State of Colorado. During this inspection we felt that there was an immediate risk to the children in the home. Our main concerns were with the large number of animals in and around the home,the unsanitary environment of the home,and the fact that Mrs. Wollert refused (initially)to allow us to inspect all of the house. We did call the Weld County Sheriffs Department and request a welfare check for the children. Approximately a one hour period had lapsed between the time we left the Wollert Group Home and the time the Sheriffs officer was allowed inside the home. The Sheriffs officer did not feel that conditions warranted removing the children from the home presently. NARRATIVE/FACTS: ON 083096, RECEIVED A CALL FOR AN AOA FOR WELD COUNTY HEALTH DEPARTMENT AT 17775 FAIRLANE. UPON ARRIVAL, I CONTACTED CHARLOTTE DAVIS WHO ADVISED THEY HAD RECEIVED A REPORT OF F'OOR LIVING CONDITIONS AT THE RESIDENCE OF 17775 FAIRLANE. SHE ADVISED THERE WERE SEVERAL FOSTER CHILDREN LIVING IN THE HOME AFTER HAVING BEEN PLACED BY A COMPANY CALLED SYNTHESIS OUT OF LONGMONT. CHARLOTTE ADVISED THAT SHE AND SARA TETER HAD BEEN INSIDE THE HOUSE AND THEY WOULD LIKE THE HOUSE CHECKED FOR ADEQUATE LIVING CONDITIONS FOR THE FOSTER CHILDREN, AS THEY FELT THEY WERE SOMEWHAT LACKING. THEY ALSO FELT THERE WERE TOO MANY ANIMALS IN THE HOUSE AND THE ANIMALS WERE LEAVING FECAL MATERIAL AROUND AND WAS UNSAFE. I WENT TO THE RESIDENCE AND THERE CONTACTED RANDY WOLLERT, WHO WAS EXTREMELY UPSET THAT THE HEALTH DEPARTMENT HAD BEEN INSIDE THE HOUSE. I ASKED RANDY IF I COULD COME IN TO TALK WITH THEM AND HE DID ALLOW ME INSIDE ,THE FENCED PROPERTY. ONCE I GOT INSIDE, GLADYS CAME OUTSIDE WITH A PHONE AND SAID THAT SUSAN TALLEY WAS ON THE PHONE, WHO IS A MANAGER FOR SYNTHESIS WHICH PLACES THESE FOSTER CHILDREN IN THEIR HOME. I TALKED WITH SUSAN WHO EXPRESSED SOME CONCERN WITH THE LIVING CONDITIONS AT THIS ADDRESS. SHE ADVISED THAT THE CASEWORKER, WRENDA PARKER, WAS OUT THERE LAST WEEK AND THEY OKAYED THE PROPERTY. SHE ALSO ADVISED THAT THE STATE MONITORING SERVICE WAS OUT IN JUNE AND ALSO OKAYED THE PROPERTY . SUSAN ADVISED THAT SHE TOOK 17 CATS FROM GLADYS NOT TOO LONG AGO, AS GLADYS REFUSED TO DO SO. SHE ADVISED THAT THERE ARE NUMEROUS CATS AND DOGS ON THE PROPERTY AND THAT SHE HAS HAD CONCERNS FOR THE LIVING CONDITIONS AT THE HOUSE, BUT WHEN THEY GO OUT THE HOUSE HAS BEEN CLEANED UP . SUSAN ADVISED THAT MOST OF THE TIME THEY PROVIDE THE WOLLERTS WITH A TIME AND DATE WHEN THEY WILL BE OUT. THERE WAS NO FOOD LEFT ON THE COUNTERS OR THE FLOOR AND I DID NOT FEEL THAT THIS WAS INADEQUATE LIVING CONDITIONS. I THEN WENT DOWNSTAIRS WHERE THE SINGLE BATHROOM DOWNSTAIRS WAS ADEQUATE. THE LAUNDRY ROOM IS PADLOCKED SO THAT THE TENANTS CAN ' T GET INTO THE LAUNDRY SOAP. THERE IS A SMELL OF URINE AND FECAL MATERIAL DOWNSTAIRS AND WHEN I ASKED GLADYS ABOUT IT SHE SAID THAT LANCE, ONE OF THE EIGHT /EAR OLDS THAT LIVES THERE, HAS BEEN URINATING BEHIND A COUCH ONTL . THE CARPET. SHE ADVISED THEY HAVE MOVED THE COUCH OUTSIDE, BUT NOW NEED TO STEAM CLEAN THE CARPETS TO GET THE. ODOR OUT. SHE ALSO ADVISED THAT LANCE SMEARS FECAL MATERIAL ON THE WALLS AND BEDS, AND DID SHOW ME A MATTRESS THAT HAD WHAT APPEARED TO BE STAINS ON IT. I NOTED-THAT THERE WERE NO SHEETS ON MOST OF THE BEDS, EVEN GLADYS ' AND THE OTHER REGULAR MEMBERS OF THE FAMILY. THEY ALL APPEARED TO SLEEP ON THE MATTRESS ITSELF WITH JUST A BLANKET. I WENT INTO GLADYS ' ROOM AND THAT WAS THE DIRTIEST ROOM I SAW. THERE WERE THREE ADULT SIZED DIAPERS ON THE FLOOR THAT HAD BEEN LAID OUT AND APPEARED TO HAVE BEEN URINATED ON. SHE DID SHOW ME SHE HAS A SICK OLDER DOG THAT STAYS IN THAT ROOM AND THAT ' S THE WAY SHE KEEPS HIM FROM ACTUALLY URINATING ON THE CARPET. SHE ADVISED THAT THE CHILDREN ARE NOT ALLOWED IN THAT ROOM AND THAT SHE KEEPS IT LOCKED AS HER ROOM. I DID NOT SEE FECAL MATERIAL OR UNSAFE LIVING CONDITIONS IN ANY OF THE ROOMS WHERE THE CHILDREN STAY OR MAY BE FOUND. I INFORMED THEM ABOUT THE NUMBER OF ANIMALS THEY CAN HAVE, AND GLADYS ADVISED THEY HAVE APPROXIMATELY 15 CATS, 8 DOGS, AND 6 HORSES. I TALKED WITH GLADYS ABOUT THE NUMBER OF ANIMALS, AND SHE SAID SHE WOULD TAKE FOUR OF THEM AND BUILD A KENNEL ON HER NEIGHBOR 'S PROPERTY TO STORE THEM THERE. SHE ALSO ADVISED THAT THEY HAVE A LOT OF NEIGHBORS ' CATS COMING ON AND OFF THE PROPERTY. THREE OF THE SIX HORSES ARE AT A NEIGHBOR ' S PROPERTY AND NOT ON THIS PROPERTY. I INFORMED THEM AS TO WHY I WAS THERE AND EXPLAINED IF THEY HAD ANY QUESTIONS TO CONTACT THE SHERIFF 'S OFFICE. THEY ADVISED THEY WOULD MAKE ARRANGEMENTS TO GET THE NUMBER OF ANIMALS TAKEN CARE OF. I THEN WENT BACK OUTSIDE AND CONTACTED SARA TETER AND CHARLOTTE DAVIS AND INFORMED THEM OF WHAT I HAD DONE. THEY PROVIDED ME WITH A CARD AND I INFORMED THEM THAT I DID NOT FEEL THAT THE HOUSE WAS IN SUCH A CONDITION THAT I WOULD NEED TO TAKE THE CHILDREN INTO PROTECTIVE CUSTODY AT THIS TIME. I WAS ALSO ADVISED THAT TWO OF THE THREE WHO ARE STAYING THERE WERE LEAVING TODAY ON A PERMANENT BASIS AS ONE WAS TURNING 21 AND WOULD BE GOING TO A PERMANENT HOUSING , AND THE OTHER WAS GOING TO LIVE CLOSER TO HIS MOTHER. CHARLOTTE AND SARA SAID THEY WOULD GET WITH SUSAN AND RECOMMEND THAT THEY PUT THE WOLLERTS ON A CONTRACT WITH MONTHLY HEALTH CHECKS THAT ARE MADE WITHOUT APPOINTMENTS. I ATTEMPTED TO CONTACT SUSAN TALLEY AT 678-1632, BUT WAS UNABLE TO DO SO. I ALSO ATTEMPTED TO CONTACT PAT CHASE AND INFORM HER OF WHAT HAD OCCURRED, BUT WAS UNABLE TO DO SO .
