RE: VIOLATIONS OF THE WELD COUNTY BUILDING CODE AND ZONING ORDINANCES
A public hearing was conducted on May 16, 1995, at 10:00 a.m., with the following present:
Commissioner Dale K. Hall, Chairman
Commissioner Barbara J. Kirkmeyer, Pro-Tem

Commissioner W. H. Webster

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the County
Attorney to proceed with legal action against the individuals named for violations of the Weld
County Building Code and Zoning Ordinances. Cases were heard as follows.
VI #2177 - Joseoh and Dorothy Vidal: Keith Schuett, Department of Planning Services,
reviewed the case for the record and indicated significant progress has been made to bring the
property into compliance. He stated the tenant, Michael Charlesworth, has completed all but a
small section of screening and will need more time to bring the property into compliance. Mr.
Charlesworth was present and affirmed that less than twenty feet of screening is left to complete
and he should be able to finish it within fifteen days. No public comment was offered.
Commissioner Webster moved to delay referral of VI #22177 against Joseph and Dorothy Vidal for
thirty days to allow the tenant, Michael Charlesworth, time to complete the screening and for final
inspections. Commissioner Kirkmeyer seconded the motion, which passed unanimously.
VI #2180 - Hill -n -Park Sanitation District: Mr. Schuett reviewed the case for the record and
reported that all but one violation have been corrected. He reported the only violation not resolved
is a travel trailer parked on the property being used as a residence. Mr. Schuett indicated the
trailer is not properly permitted and the tenant is in the process of applying for appropriate water
and sewer/septic permits. Planning staff indicated the tenant has made significant effort to clean
up the property and is willing to do what is necessary regarding the trailer. Responding to
Commissioner Kirkmeyer, Mr. Schuett indicated the tenant applied for the permits May 15, 1995.
The property owners were neither present nor represented. No public comment was offered.
Commissioner Baxter made a motion to delay referral of VI #2180 against Hill and Park Sanitation
for thirty days to allow the property owner and tenant time to bring the property into compliance.
Commissioner Webster seconded the motion. Discussion followed during which Commissioner
Kirkmeyer questioned whether the property owner realized application for the appropriate permits
did not guarantee their approval. Mr. Schuett reiterated the property owner and tenant were willing
to do what was necessary and the situation was workable. He indicated Trevor Jiricek, Health
Department, was present and could address the permit application process. Mr. Jiricek stated the
property owners had initially applied for and were issued the incorrect permit for the use indicated.
Responding to the Board, he reviewed the type of permit required and potential for compliance.
Commissioner Baxter restated the motion clarifying that the Board would delay referral of VI #2180
to the County Attorney for thirty days to allow for appropriate permits to be applied for and
approved and the property brought into compliance. The motion so clarified carried unanimously.
