RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #396 - WELD COUNTY BOARD OF COMMISSIONERS, C/O TODD HODGES, CURRENT PLANNER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 4th day of March, 1996, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of the Weld County Board of Commissioners, do Todd Hodges, Current Planner, 1400 North 17th Avenue, Greeley, Colorado 80631, for a Minor Resubdivision, S #396, on the following described real estate, to-wit: Portion of B Street and portion of West 1st Street in Johnson Subdivision, located in Section 2, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, Todd Hodges, Current Planner for the Weld County Department of Planning Services, represented said applicant, and WHEREAS, Section 8.2 of the Weld County Subdivision Ordinance provides standards for review of said Minor Resubdivision, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.2.5 of the Weld County Subdivision Ordinance. 2. The request is to vacate the portions of"B" Street and 1st Street west of 40th Avenue in the Johnson Subdivision, Weld County, Colorado. Based upon the submitted application materials and other relevant information regarding this request,the Department of Planning Service's staff recommends conditional approval of this request. The Planning Commission voted unanimously to recommend denial of the proposed vacation, and the Planning Commission Chair requested that staff write the Board a letter detailing its concern with the proposal. The Planning Commission indicated the proposed vacation: 1. Eliminates a logical extension of streets in this area. 2. Does not provide any access by vehicles, pedestrians, or bicyclists. 3. Creates a dead-end street which is not permitted by the Greeley Subdivision Regulations and Weld County Subdivision Regulations. 4. Increases fire and emergency response time. 5. Increases the probability of loss of life and property damage due to fire. 6. Eliminates required emergency access to both the Johnson and Larson Subdivisions. 7. Will increase costs to the adjacent land owners when maintenance on the existing water and sewer lines occurs. 8. Will require exclusive water and sewer easements which are 10 feet on either side of the water and sewer lines. 9. PLANNING COMMISSION SUMMARY ITEM: Weld County Referral for a Minor Resubdivision to Vacate a Portion of B Street and 1st Street within Johnson Subdivision PROJECT: Weld County Referral - Johnson Subdivision LOCATION: Adjacent to Greeley City Limits on B Street and 2nd Street (1st Street as Platted) West of 40th Avenue APPLICANT: Weld County Board of County Commissioners PLANNING COMMISSION HEARING DATE: February 13, 1996 PLANNING COMMISSION FUNCTION: Review the proposal for conformance with Greeley's Comprehensive Plan and Subdivision Regulations and offer a recommendation to the Weld County Board of County Commissioners. PROJECT OVERVIEW AND BACKGROUND: The Board of County Commissioners has applied to vacate B Street and 2nd Street (1st Street as platted) in Johnson Subdivision west of 40th Avenue. The Board issued a resolution dated May 10, 1995, which authorized the temporary closure of these streets for 120 days. The subject application is intended to "stop traffic from using the . . . right-of-ways to and from the Larsen (sic) Subdivision located in the City of Greeley." As proposed, the existing platted right-of-way would be vacated and the land given to the adjacent property owners. The subject property is located adjacent to the City of Greeley limits in unincorporated Weld County and is zoned R-1. Larson Subdivision, a City of Greeley subdivision, contains B Street and 2nd Street which are constructed to City standards (40 feet flowline-to-flowline, curbs, gutters, and sidewalks). Johnson Subdivision is located adjacent to Larson Subdivision but has not been annexed to the City. The area of B Street proposed to be vacated is already constructed with 25 feet of pavement and does not have curbs, gutters, or sidewalks. That portion of 2nd Street (1st Street as platted) which is proposed to be vacated in Johnson Subdivision (Attachment B) has not been constructed. 960393 The Johnson Subdivision was approved by the County in 1963, and the plat, which was recorded, included a signature block for the City Planning Commission and City Engineer, although the City does not typically approve or sign County plats. Very little information is available regarding the review at that time. County Minor Resubdivision cases are reviewed by the Board of County Commissioners who, in this case, are the applicants. As noted in the County Subdivision Regulations (Attachment E), three criteria must be met to follow a minor resubdivision process: 1. There is right-of-way shown on an approved plat or map that has not been used for its intended purpose for the last 21 years or since the recording of the approved plat; 2. Seventy percent (70%) of the land owners adjacent to the proposed right-of-way vacation must waive any objection to the vacation by signing a petition; and 3. The vacation shall only be permitted when it is compatible with the surrounding the area and uses, is consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and does not deprive any parcel of adequate access to a public road or street right-of-way. SITE DATA: Surrounding Zoning See Attachment A Surrounding Land Uses Single-Family Residential KEY ISSUE: Does the proposed vacation comply with the policies of the City of Greeley Comprehensive Plan and good planning practice? ANALYSIS: The City Comprehensive Plan policy which addresses the proposed vacation is: Planning Comm. Summary 2 WCR/Johnson Resubdivision 960293 Comprehensive Plan Policy 4.9 All development is encouraged to provide convenient and safe pedestrian and bicycle access. Staff Comment: By eliminating the rights-of-way at B Street and 2nd Street connecting Johnson Subdivision with Larson Subdivision, all traffic between the two subdivisions would be halted. Pedestrian and bicycle traffic which is currently able to flow freely between the two subdivisions would now be precluded and would be forced out onto 4th Street, which • is classified as a collector street. Although County land use issues are not evaluated for compliance with City regulations, it is likely that the Johnson Subdivision will be annexed to the City at some time. Therefore, it is helpful to compare the proposal to the Subdivision Regulations which govern design within the City. Sections of the City Subdivision Regulations which are applicable include: • Section 3.2 Streets, Alleys and Easements B. All streets shall be aligned to join with planned or existing streets. F. Except as provided for cul-de-sacs, no dead-end street shall be permitted, except in cases where such streets are designed to connect with future streets or adjacent land. Staff Comment: The proposed vacation of B Street and 1st Street does not conform with these sections of the Greeley Subdivision Regulations. Streets within Larson 5th Filing were platted to align with the existing B Street within Johnson Subdivision and the platted right-of-way associated with 1st Street to allow for integrated traffic and pedestrian flow between neighborhoods. Currently, within Johnson Subdivision, B Street is constructed to the city limit line. As built, B Street is approximately 25 feet wide with curbs, gutters, and sidewalks on both sides of the street. While the streets are not designed to the same standard, integrated traffic flow is still possible. Planning Comm. Summary 3 WCR/Johnson Resubdivision First Street within Johnson Subdivision has not been constructed, although the right-of-way has been dedicated. While no road has been constructed, this section of road is a logical extension of the road system in the area. The street is already constructed to City standards on the City side. The proposed vacation creates a dead-end street, which is in direct conflict with City design standards and good planning practice. The applicant's narrative states: This proposed vacation is intended to stop traffic from using the mentioned right-of-ways to and from the Larsen (sic) Subdivision located in the City of Greeley and the potentially harmful effects of the increased traffic volume through the Johnson Subdivision. While it is unfortunate that a common design standard was not used for roads in both subdivisions, an effort has been made to provide an even traffic flow which benefits both subdivisions. As discussed in detail in the ART comments, vacation of the streets will be especially harmful to Johnson Subdivision in that necessary emergency vehicle access will be inadequate and access to fire hydrants will be cut off. Approval of this request should be carefully considered from all perspectives, especially considering the health, safety, and welfare of both affected neighborhoods. ADMINISTRATIVE REVIEW TEAM COMMENTS: The Administrative Review Team members who reviewed this proposal at the January 31, 1996, meeting indicated that the proposed vacation would create several life-safety issues and practical problems for residents in both the Johnson Subdivision and Larson 5th Filing. Points of concern included: Planning Comm. Summary 4 WCR/Johnson Resubdivision 960203 1. Easements A. Exclusive easements must be provided for the existing City water and sewer lines in both streets. The easements must be 10 feet on each side of each line. B. No structures, fences, or woody vegetation over three feet high at maturity may be placed within the required easements. C. When maintenance occurs on the lines, the land owner will be responsible for replacing any asphalt or concrete. Public rights-of-way are repaired by the City. D. Access to the water and sewer lines shall not be limited. Any barriers must be removed. 2. Fire and Emergency Access A. No turnarounds for emergency vehicles are available at the north end of Johnson Subdivision; therefore, there is insufficient access for fire response and emergency vehicle response. As platted and designed, adequate access exists. B. Access to the fire hydrants which were placed in Larson Subdivision to cover Johnson Subdivision would be cut off, leaving Johnson Subdivision with inadequate fire flow. No fire hydrants exist in Johnson Subdivision. C. With no water supply for fire, and inadequate fire access, the loss of life, and additional property damage is more likely to occur because of the vacation. D. The existing access is necessary for emergency purposes for residents of both subdivisions. E. No cross-flow of traffic is possible between the two neighborhoods. 3. General A. Traffic will be twice as high on Johnson Subdivision with the vacation because traffic cannot go through but will be required to travel the same road twice. Planning Comm. Summary 5 WCR/Johnson Resubdivision 960228 B. The application narrative indicates that the vacation is necessary due to a lack of design and coordination with the City of Greeley. The rights-of- way and the centerline of the streets match and were designed to provide for an integrated traffic flow. PLANNING STAFF RECOMMENDATION: The staff recommends that the City of Greeley Planning Commission recommend the following to the Weld County Board of County Commissioners: The proposed minor resubdivision to vacate portions of B Street and 1st Street should be denied because the vacation: 1. Eliminates a logical extension of streets in this area. 2. Does not provide any access by vehicles, pedestrians, or bicyclists. 3. Creates a dead-end street which is not permitted by the Greeley Subdivision Regulations and Weld County Subdivision Regulations. 4. Increases fire and emergency response time. 5. Increases the probability of loss of life and property damage. 6. Eliminates required emergency access to both the Johnson and Larson Subdivisions. 7. Will increase costs to the adjacent land owners when maintenance on the existing water and sewer lines occurs. 8. Will require exclusive water and sewer easements which are 10 feet on either side of the water and sewer lines. 9. Eliminates fire hydrant coverage in Johnson Subdivision. The staff also recommends that the Planning Commission request that the Board of County Commissioners require that all barriers be removed. If, however, the Board of County Commissioners decides to approve the vacation, the following conditions should be included: Planning Comm. Summary 6 WCR/Johnson Resubdivision 9602°3 1. Exclusive water and sewer easements shall be provided. The easements shall be 10 feet on each side of each line. 2. No structures, fences, or woody vegetation over three feet high at maturity shall be placed within the required easements. 3. The City will not be responsible for any asphalt, concrete or pavement disturbed during maintenance of the water and sewer lines. 4. Access to the water and sewer lines shall not be limited. Any barriers shall be immediately removed. The Planning Commission also wishes to communicate to the Board of County Commissioners that inadequate fire and emergency vehicle access and no fire flow will exist in Johnson Subdivision as a result of the vacation. Summary 7 WCR/Johnson Resubdivision 960223 I VI. WELD COUNTY REFERRAL FOR A MINOR RESUBDIVISION TO VACATE A PORTION OF B STREET AND 1ST STREET WITHIN JOHNSON SUBDIVISION Greg Thompson, Planner II, advised that this item is a request by the Weld County Commissioners for a minor resubdivision in order to vacate a portion of B Street and 1st Street within Johnson Subdivision, an enclave of County property. The property is located adjacent to the city limits on B Street and 2nd Street west of 40th Avenue. The vacation would prevent traffic from using the right-of-way to and from the Larson Subdivision, which is located within the city limits. Mr. Thompson indicated that the • key issue is whether the proposed vacation would comply with the policies of the City's Comprehensive Plan and good planning practice. Mr. Thompson advised that Comprehensive Plan Policy 4.9 encourages safe pedestrian and bicycle access. He advised that vacating the right-of-way connecting the two subdivisions would force pedestrian and bicycle traffic onto 4th Street, a collector roadway. Mr. Thompson noted that it is likely that the Johnson Subdivision will eventually be annexed into the city. Therefore, he evaluated the proposal against the City's Subdivision Regulations and advised that Section 3.2 requires that all streets be aligned to join with planned or existing streets and that dead end streets are not permitted except where they are designed to eventually connect with future roadways. Mr. Thompson pointed out that the streets within Larson 5th Filing were platted to align with the existing B Street in Johnson Subdivision and the platted right-of-way associated with 1st Street to allow for integrated traffic and pedestrian flow between the two neighborhoods. He advised that B Street has been constructed in Johnson Subdivision to the city limit line; 1st Street in Johnson has not been constructed, although the right-of-way has been dedicated. Mr. Thompson cautioned that vacating the streets will not only be harmful to the residents of the Larson Subdivision but will also be detrimental to the residents in the Johnson Subdivision as well because emergency vehicles access will be inadequate and • access to the fire hydrants within Larson Subdivision will be cut off. He asked the Commission to consider the health, safety, and welfare of both affected neighborhoods. Mr. Thompson advised that staffs concerns relate primarily to issues involving easements, fire and emergency access, traffic circulation, and design. Planning Comm. Minutes 7 February 13, 1996 960298 Therefore, Mr. Thompson recommended that the City Planning Commission recommend denial to the Weld County Commissioners for the following reasons: (1) The vacation would eliminate a logical extension of the streets in the area, (2) would preclude access; (3) would create a dead-end street; (4) would increase fire and emergency response time; (5) would increase the probability of loss of life and property damage; (6) would eliminate the required emergency access to both the Johnson and Larson subdivisions; (7) would increase costs to the adjacent land owners when maintenance on the existing water and sewer lines occur; (8) will require exclusive water and sewer easements which are ten feet on either side of the water and sewer lines; and (9) will eliminate the existing fire hydrant coverage in Johnson Subdivision. He further recommended that the Planning Commission request the Board of County Commissioners require all barriers currently in place be removed. However, if the County Commissioners decide to approve the vacation, Mr. Thompson recommended that the Commission place the following conditions: (1) Exclusive water and sewer easements shall be provided and shall be 10 feet on each side of each line; (2) no structures, fences, or woody vegetation over three feet high at maturity shall be placed within the required easements; (3) the City shall not be responsible for any asphalt, concrete, or pavement disturbed during maintenance of the water and sewer lines; (4) access to the water and sewer lines shall not be limited, or (5) any barriers shall be immediately removed. Commissioner Lockhart moved to approve the request. Commissioner Valencia seconded the motion. Rebecca Safarik, Community Development Director, inquired as to the rationale for an unconditional motion to approve the request since staff strongly urges that it be denied. She advised that when the Planning Commission approved the request for the Larson 5th Filing, it was with the understanding that the streets would line up with those in the Johnson Subdivision. She reiterated staff's concern about cutting off the fire access and fire hydrants located in the subdivision as well as the concerns over traffic circulation. Ms. Safarik noted that while the residents of the Johnson Subdivision are protective of their streets, they are using City of Greeley streets to access their neighborhood. Commissioner McGinn disagreed with Commissioner Lockhart's motion to approve the request since the Larson Subdivision was designed to be integrated with the Johnson Subdivision. She said that she appreciates staff's safety concerns and agreed with Ms. Safarik that the residents of the Johnson Subdivision should not be able to benefit from City services without experiencing City burdens as well. Planning Comm. Minutes 8 February 13, 1996 96024)8 Commissioner Coan asked about the possibility of a forced annexation. Ms. Safarik advised that the possibility of a forced annexation was explored several years ago, but because of a technicality, the Johnson property was not considered to be completely surrounded by City property, making a forced annexation impossible. Ms. Safarik advised that because of the recent merger between the City of Greeley Fire Department and the Western Hills Fire District, the City would be forced to respond to an area with inadequate fire fighting tools if the request is approved. Commissioner Valencia advised that he had been confused as to Commissioner Lockhart's motion and withdrew his second. The motion then died due to lack of a second. Chair de Besche questioned whether the County had provided notice of its intent to vacate the roadways to the surrounding property owners in the Larson Subdivision. Mr. Thompson indicated that the only adjacent property owners notified were those who would receive additional property. Property owners diagonally adjacent were not notified. Commissioner McGinn moved to approve the staff's recommendation which was to recommend denial of the request for the nine reasons stated. Commissioner Ewald seconded the motion. Commissioner Lockhart commented that he envisions the property eventually being annexed into the City of Greeley. A vote was taken on the motion to deny and carried 6-0 (Hernandez abstaining due to his absence during part of the hearing). Chair de Besche strongly recommended that Weld County notify the adjacent land owners who would be affected by the vacation, which she assumed would be most of residents of the Larson Subdivision. He noted that the requested action, a minor resubdivision, does not appear to meet the criteria specified in the Weld County Subdivision Regulations since the right-of-way has been used for its intended purpose for the last 21 years, less than 70 percent of the surrounding property owners have signed the petition, and since it could be argued that it is not efficient and orderly development. Mr. Thompson noted that the proposal would eliminate a logical extension of the street system in this area. Mr. Thompson asked Mr. Wells if the street was 1st Street or 2nd Street. Mr. Wells responded that it was 2nd Street. Dan Moore indicated that there are water and sewer lines within each right-of- way proposed to be vacated; therefore, the Water and Sewer Department needs an exclusive water and sewer easement with 10 feet on each side of each line. Additionally, no structures or fences may be located in the easement, and woody vegetation shall not be greater than three feet high. ART Minutes 13 January 31, 1996 9603.S Mr. Moore continued his thoughts by noting that any public right-of-way asphalt or concrete is replaced by the City during maintenance of the lines; however, if the land is not public right-of-way, the land owner is required to replace the asphalt. Mr. Moore concluded by noting that access shall not be limited to the water and sewer lines and that any barriers in the way shall be removed. Dan Correll had no comment regarding the proposal. Duane Scheel indicated that the Fire Department is strongly opposed to this vacation because it would hamper the Fire Department operations and adequate • fire services would not be provided. This proposal does not provide required turnarounds on a dead-end street. Additionally, the only fire hydrants which would serve the Johnson Subdivision are in the Larson Subdivision. The vacation will cut off use of the fire hydrants. As currently existing, the Larson Subdivision provides adequate access to the north part of Johnson Subdivision. With the vacation, no access will be possible to 42nd Avenue, where the water supply is. The vacation would prohibit access to fire hydrants that can provide fire flow in the north central portion of Johnson Subdivision. The Fire Department wants to ensure cohesive flow for its vehicles to respond. The vacation would impede the response of the Fire Department. The primary problems are lack of water and inadequate emergency vehicle access. Mr. Scheel noted the Greeley and Western Hills Fire Departments are now combined, and the Greeley Fire Department will be responding to this area. Additionally, there was a conscious design for the streets to line up so fire hydrants within Larson could serve the Johnson area. Mr. Scheel concluded by suggesting that the property be annexed. Mr. Thompson noted that the Johnson Subdivision, along with the gravel pit immediately to the east, are totally surrounded by the City, and a forced annexation appears possible. Mr. Wells also agreed that this should be considered. Mr. Wells noted that not only would Johnson Subdivision have inadequate access, but with this proposal, the Larson Subdivision would have inadequate access. Mr. Wells indicated that the Public Works Department is strongly opposed to this proposal and noted that the emergency response would be impaired in both directions. This proposal would restrict cross-flow between the adjacent neighborhoods. Additionally, there are no harmful effects of increased traffic, and that the amount of traffic within the subdivision will be increased because visitors and service vehicles will be forced to go up and back rather than through to the next subdivision. Mr. Wells also noted that the County Resolution which closed the two streets for 120 days in May 1995 suggests that traffic investigations had been done. PROJECT OVERVIEW AND BACKGROUND: The Board of County Commissioners has applied to vacate B Street and 2nd Street (1st Street as platted) in Johnson Subdivision west of 40th Avenue. The Board issued a resolution dated May 10, 1995, which authorized the temporary closure of these streets for 120 days. The subject application is intended to "stop traffic from using the . . . right-of-ways to and from the Larsen (sic) Subdivision located in the City of Greeley." As proposed, the existing platted right-of-way would be vacated and the land given to the adjacent property owners. The subject property is located adjacent to the City of Greeley limits in unincorporated Weld County and is zoned R-1. Larson Subdivision, a City of Greeley subdivision, contains B Street and 2nd Street which are constructed to City standards (40 feet flowline-to-flowline, curbs, gutters, and sidewalks). Johnson Subdivision is located adjacent to Larson Subdivision but has not been annexed to the City. The area of B Street proposed to be vacated is already constructed with 25 feet of pavement and does not have curbs, gutters, or sidewalks. That portion of 2nd Street (1st Street as platted) which is proposed to be vacated in Johnson Subdivision (Attachment B) has not been constructed. 960293 The Johnson Subdivision was approved by the County in 1963, and the plat, which was recorded, included a signature block for the City Planning Commission and City Engineer, although the City does not typically approve or sign County plats. Very little information is available regarding the review at that time. County Minor Resubdivision cases are reviewed by the Board of County Commissioners who, in this case, are the applicants. As noted in the County Subdivision Regulations (Attachment E), three criteria must be met to follow a minor resubdivision process: 1. There is right-of-way shown on an approved plat or map that has not been used for its intended purpose for the last 21 years or since the recording of the approved plat; 2. Seventy percent (70%) of the land owners adjacent to the proposed right-of-way vacation must waive any objection to the vacation by signing a petition; and , 3. The vacation shall only be permitted when it is compatible with the surrounding the area and uses, is consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and does not deprive any parcel of adequate access to a public road or street right-of-way. SITE DATA: Surrounding Zoning See Attachment A Surrounding Land Uses Single-Family Residential KEY ISSUE: Does the proposed vacation comply with the policies of the City of Greeley Comprehensive Plan and good planning practice? ANALYSIS: The City Comprehensive Plan policy which addresses the proposed vacation is: Planning Comm. Summary 2 WCR/Johnson Resubdivision 960293 Comprehensive Plan Policy 4.9 All development is encouraged to provide convenient and safe pedestrian and bicycle access. Staff Comment: By eliminating the rights-of-way at B Street and 2nd Street connecting Johnson Subdivision with Larson Subdivision, all traffic between the two subdivisions would be halted. Pedestrian and bicycle traffic which is currently able to flow freely between the two subdivisions would now be • precluded and would be forced out onto 4th Street, which is classified as a collector street. Although County land use issues are not evaluated for compliance with City regulations, it is likely that the Johnson Subdivision will be annexed to the City at some time. Therefore, it is helpful to compare the proposal to the Subdivision Regulations which govern design within the City. Sections of the City Subdivision Regulations which are applicable include: Section 3.2 Streets, Alleys and Easements B. All streets shall be aligned to join with planned or existing streets. F. Except as provided for cul-de-sacs, no dead-end street shall be permitted, except in cases where such streets are designed to connect with future streets or adjacent land. Staff Comment: The proposed vacation of B Street and 1st Street does not conform with these sections of the Greeley Subdivision Regulations. Streets within Larson 5th Filing were platted to align with the existing B Street within Johnson Subdivision and the platted right-of-way associated with 1st Street to allow for integrated traffic and pedestrian flow between neighborhoods. Currently, within Johnson Subdivision, B Street is constructed to the city limit line. As built, B Street is approximately 25 feet wide with curbs, gutters, and sidewalks on both sides of the street. While the streets are not designed to the same standard, integrated traffic flow is still possible. Planning Comm. Summary 3 WCR/Johnson Resubdivision 960293 First Street within Johnson Subdivision has not been constructed, although the right-of-way has been dedicated. While no road has been constructed, this section of road is a logical extension of the road system in the area. The street is already constructed to City standards on the City side. The proposed vacation creates a dead-end street, which is in direct conflict with City design standards and good planning practice. The applicant's narrative states: This proposed vacation is intended to stop traffic from using the mentioned right-of-ways to and from the Larsen (sic) Subdivision located in the City of Greeley and the potentially harmful effects of the increased traffic volume through the Johnson Subdivision. While it is unfortunate that a common design standard was not used for roads in both subdivisions, an effort has been made to provide an even traffic flow which benefits both subdivisions. As discussed in detail in the ART comments, vacation of the streets will be especially harmful to Johnson Subdivision in that necessary emergency vehicle access will be inadequate and access to fire hydrants will be cut off. Approval of this request should be carefully considered from all perspectives, especially considering the health, safety, and welfare of both affected neighborhoods. ADMINISTRATIVE REVIEW TEAM COMMENTS: The Administrative Review Team members who reviewed this proposal at the January 31, 1996, meeting indicated that the proposed vacation would create several life-safety issues and practical problems for residents in both the Johnson Subdivision and Larson 5th Filing. Points of concern included: Planning Comm. Summary 4 WCR/Johnson Resubdivision 960298 1. Easements A. Exclusive easements must be provided for the existing City water and sewer lines in both streets. The easements must be 10 feet on each side of each line. B. No structures, fences, or woody vegetation over three feet high at maturity may be placed within the required easements. C. When maintenance occurs on the lines, the land owner will be responsible for replacing any asphalt or concrete. Public rights-of-way are repaired by the City. D. Access to the water and sewer lines shall not be limited. Any barriers must be removed. 2. Fire and Emergency Access A. No turnarounds for emergency vehicles are available at the north end of Johnson Subdivision; therefore, there is insufficient access for fire response and emergency vehicle response. As platted and designed, adequate access exists. B. Access to the fire hydrants which were placed in Larson Subdivision to cover Johnson Subdivision would be cut off, leaving Johnson Subdivision with inadequate fire flow. No fire hydrants exist in Johnson Subdivision. C. With no water supply for fire, and inadequate fire access, the loss of life, and additional property damage is more likely to occur because of the vacation. D. The existing access is necessary for emergency purposes for residents of both subdivisions. E. No cross-flow of traffic is possible between the two neighborhoods. 3. General A. Traffic will be twice as high on Johnson Subdivision with the vacation because traffic cannot go through but will be required to travel the same road twice. Planning Comm. Summary 5 WCR/Johnson Resubdivision 9602°S B. The application narrative indicates that the vacation is necessary due to a lack of design and coordination with the City of Greeley. The rights-of- way and the centerline of the streets match and were designed to provide for an integrated traffic flow. PLANNING STAFF RECOMMENDATION: The staff recommends that the City of Greeley Planning Commission recommend the following to the Weld County Board of County Commissioners: The proposed minor resubdivision to vacate portions of B Street and 1st Street should be denied because the vacation: 1. Eliminates a logical extension of streets in this area. 2. Does not provide any access by vehicles, pedestrians, or bicyclists. 3. Creates a dead-end street which is not permitted by the Greeley Subdivision Regulations and Weld County Subdivision Regulations. 4. Increases fire and emergency response time. 5. Increases the probability of loss of life and property damage. 6. Eliminates required emergency access to both the Johnson and Larson Subdivisions. 7. Will increase costs to the adjacent land owners when maintenance on the existing water and sewer lines occurs. 8. Will require exclusive water and sewer easements which are 10 feet on either side of the water and sewer lines. 9. Eliminates fire hydrant coverage in Johnson Subdivision. The staff also recommends that the Planning Commission request that the Board of County Commissioners require that all barriers be removed.
