APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the standards of Sections 11.5.1 through
11.5.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
The Environmental Protection Services Division of the Weld County Health Department was unable to locate a septic
permit for the septic system located on the larger parcel of this application. Any existing septic system(s) which is n of
currenity permitted through the Weld County Health Department will require an I.S.D.S. Evaluaiton prior to the issuance
of the required septic permit(s). In the event the system(s) is fuond to be inadequate, the system(s) must be brought into
compliance with current I.S.D.S. regulations.
The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld
County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for paying the recording fees.

RECORDED EXEMPTION QUESTIONAIRE
1. Explain the reason for the proposed recorded exemption and how each proposed lot will be used.
The purposed of proposed boundry line change is for better management of
land. Both parcel will remain farm land, Sewald for additional farm land
and Preists property farming and grazing land for sheep production.
Both to remain totally agriculture.
2. Describe the location, size and present use of the area where each proposed new lot will be created.
Both proerties to remain agricultural use — irrigated farm land.
The main property is 132± acres, and will be approximately 107 -1 -
acres, while the second property (Sewald Farm) is currently 73± acres
and will be increased to 98± acres.
3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted
municipal plan, if applicable.
Most of the surrounding area is smaller tracts and country estates - heavy agri-
cultural oriented. This change does not appear to change or affect the cur-
rent land use in the area.
4. Explain how the uses permitted will be compatible with existing uses surrounding the proposed
recorded exemption.
Surrounding area is very compatible to this change. Both parcel to
remain agriculture, and on account of irrigation management of land
will improve, as the subject parcel of land irrigated to the south
from Weld Cty Rd 84, while the rest of the farm irrigated from the east
and south.
5. Explain how the proposal is consistent with the intent of the zoning district it is located within.
Present agricultural and to remain same. Compatible with the surrounding
areas.
6. Explain how the proposal is consistent with efficient and orderly development.
Consistent with established agricultural uses in area as well as zoning
and land use.
7. Explain how adequate provision for the protection of the health, safety, and welfare of the inhabitants
of the neighborhood and the County will be accomplished.
Should be no change from present use, if anything improving total area.

also retain the monies they have received under the current five-
year mineral lease.

7. Grantors have negotiated or shall negotiate with their
tenant the use of approximately five (5) acres of the real estate
described above by September 1, 1992 to provide by that date for

Grantees shall reimburse Grantors at market value for crop damage.
8. Grantors agree to give -and do hereby give by this Deed an
easement to the Grantees for one or more power poles to be placed
on the land retained by the Grantors in order for electrical power
to be furnished in an appropriate manner to the Grantees.
9. The Grantors acknowledge that this sale is part of a
Section 1031 Tax Free Exchange under the rules of the Internal
Revenue Service of the United States.
10. Grantors state that they have received approval from the
Weld County, Colorado zoning authorities for the separation of the
above referred to tract from their farm and that the real estate
referred to above is a legal parcel.
