HomeMy WebLinkAbout961031.tiff Ane49753d RESOLUTION 2497538 B-1552 P-1214 06/20/96 04:13P PG 1 OF 2 REC D0C Weld County CO Clerk & Recorder 0.00 RE: VACATION OF PORTION OF WELD COUNTY ROAD 22.5 FROM HALF-SECTION LINE OF S7, T2N, R66W, WEST TO SOUTH PLATTE RIVER AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by a letter dated August 28, 1995, Elton N. and Catherine S. Miller requested Weld County vacate Weld County Road 22.5 from the W% of Section 7, Township 2 North, Range 66 West and EA of NE'/ of Section 12, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, the Weld County Public Works Department has recommended said Weld County Road 22.5 from the bridge west of State Highway 85 to the river be vacated, since the section of road is not needed for the Weld County roadway system, and WHEREAS, the County Attorney's Office has specified that portion of the road right-of-way to be vacated is the stretch beginning at the half section line of Section 7, Township 2 North, Range 66 West and extending westward to the South Platte River, and WHEREAS, on June 10, 1996, the Board of County Commissioners considered the vacation of said portion, heard all of the testimony and statements of those present, studied the recommendations of the Weld County Attorney and Dave Becker, Operations Manager for the Weld County Public Works Department, and all of the exhibits and evidence presented in this matter and, having been fully informed, deemed it advisable to vacate said portion of Weld County Road 22.5 as designated on the attached plat, a copy of which:is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the portion of Weld County Road 22.5 beginning at the half section line of Section 7, Township 2 North, Range 66 West of the -6th P.M., Weld County, Colorado, and extending westward to the South Platte River be, and hereby is, vacated. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign any and all necessary documents pertaining to said vacation. Miller 12251 Weld County Road 22 '/2 Fort Lupton, CO 80621 RE: Vacation of a Portion of Weld County Road 22 '/z, West of U.S. Highway 85 Dear Mr. and Mrs. Miller: On Wednesday, June 10, 1996, the Board of County Commissioners of Weld County, Colorado, will consider the vacation of a portion of Weld County Road ("WCR") 22 '/, west of U.S. Highway 85. Specifically, that portion of the road right-of-way to be vacated will be the stretch beginning at the half section line of Section 7-2-66 and extending westward to the South Platte River. The bridge over the South Platte River for this portion of WCR 22 '/2 has not existed for many years. Weld County does not plan to rebuild the bridge over the South Platte and, therefore, it appears that there is no need to have access for the public a long this stretch of WCR 22 '/. The hearing before the Board will take place in the Board's first floor hearing room, Weld Centennial Center, 915 Tenth Street, Greeley, Colorado. The hearing will take place at 9:00 a.m. You may be present at that time to offer any testimony regarding your request for vacation, but it is not necessary for you to attend. The 3/10 mile on WCR 22.5 from State Hwy. 85 to the bridge will not be vacated. This section of road is not needed for the Weld County Roadway system. The County does need to retain any easements of record. The two property owners who use this road to access their property are Kenneth Miller, our son, and Bradley Thomas Windell . Both Kenneth and Bradley will receive an easement to their property and have agreed to the closure of this road . A draft copy of the easement is enclosed for your information.
