("Paxson"),' licensee of commercial television station KUBD-TV,2 Denver, Colorado, by its attorneys and pursuant to Sections 76.7 and 76.61 of the Commission's rules, hereby files this must-carry complaint against TCI of Colorado ("TCI") for its failure to carry the signal of KUBD-TV on its cable systems serving various communities in Adams, Arapahoe, Jefferson and Weld counties, and the surrounding areas (the"cable communities").3 By letters dated October 27, 1997, Paxson requested carriage on the TCI systems, informing the cable operator that it was entitled to carriage and that the station either currently ' Paxson Denver License, Inc., is a subsidiary of Paxson Communications Corporation. Both entities will be referred to as "Paxson." 2 Paxson's request to change the call sign of KUBD-TV to KPXC is pending before the Commission. 0412 IV 980265 sae j* ,x/92 � < <q delivers a quality signal or is committed to doing so and would purchase the requisite equipment to ensure signal delivery.' Pursuant to Section 76.61(a)(2) of the Commission's rules, TCI was obligated to respond to Paxson's requests for carriage in writing within thirty (30) days of receipt of the letters. TCI did not respond as required by the rules, however, and has failed to add KUBD-TV to its channel line-up. Thus, pursuant to Section 76.7(c)(4)(iii)(A) and (B) of the Commission's rules, Paxson is now filing this complaint within 60 days of TCI's failure to respond to KUBD-TV's requests for carriage.' KUBD-TV Is A Qualified Local Commercial Television Station KUBD-TV is licensed to Denver, Colorado, which is in the Denver"Area of Dominant Influence" ("ADI"). TCI operates cable systems serving communities in Adams, Arapahoe, Jefferson and Weld counties, which are also within the Denver ADI. Accordingly, KUBD-TV is entitled to mandatory carriage on TCI's systems if it satisfies the statutory definition of a "qualified local commercial television station"under the must- carry rules. Under this definition, a full-power local station is entitled to carriage if(1) such carriage will not cause increased copyright liability for the cable operator, and(2) it either delivers a signal of at least -45dBm to The cable systems are listed in Exhibit 1. ' TCI's failure to respond to the carriage request of KUBD-TV within the 30-day period is the "specific event" upon which this complaint is based. See 47 C.F.R. 76.61(a) (2). - 2 - the cable system's principal headend or agrees to be responsible for the costs of delivering a signal of good quality to the cable system.' KUBD-TV is a qualified local commercial television station as defined under the must- carry rules. First, because the TCI systems and KUBD-TV are located within the same ADI, the station's signal will not cause increased copyright liability for the cable operator.' Second, in the October 27 letters, Paxson assured TCI that should their systems be unable to receive a quality signal off-the-air from KUBD-TV at their headends, Paxson would commit to acquiring and installing any and all necessary improvements and equipment needed to provide Paxson with such a signal. TCI Has Failed to Fulfill Its Obligation Under the Rules The Commission has stated that it will not allow cable operators to avoid their statutory carriage obligations by refusing to cooperate with a local television station that seeks to obtain its 6 See 47 U.S.C. § 534(h)(1)(B)(ii)-(iii); 47 C.F.R. § 76.55(e)(2)-(3). As amended by the Satellite Home Viewer Act of 1994, the Copyright Act provides that a cable operator's carriage of a local station(i.e., within the same ADI as the operator) does not increase the operator's copyright liability. Bur. 1995) ("[A] station located within the same ADI as a cable system is no longer considered a `distant signal' on that system for purposes of compulsory copyright license liability."); Son Broadcasting. Inc , 10 FCC Rcd 8763, 8765 (Cable Serv. Bur. 1995). - 3 - must-carry rights.' In this case, TCI has not responded to Paxson's requests for carriage, as it was required to do under the Commission's rules.' In sum, TCI has failed to comply with its statutory obligation to provide carriage, upon request, to a qualified local television station. By refusing even to respond to KUBD-TV's requests, moreover, TCI has ignored its obligation under the must-carry law"to cooperate fully with broadcast stations so that they are not deprived of the statutorily mandated must-carry rights to which they are entitled."10 Accordingly, Paxson respectfully requests that the Commission ' Implementation of the Cable Television Consumer Protection and Competition Act of 1992, 8 FCC Rcd 4142, 4143 (1993) (Clarification Order). TCI did inform KUBD-TV, by a letter dated January 13, 1998, see Exhibit 3, that tests performed at its Greeley system headend had indicated that KUBD-TV's signal was insufficient and, accordingly, that it would not carry the station on its Greeley system. KUBD-TV has offered to provide equipment as necessary to ensure receipt of a good quality signal and, based on discussions between the parties, Paxson understands that TCI is willing to cooperate with the station in this endeavor. Paxson believes the better course would be to allow the station to work with TCI to resolve the signal delivery issue with regard to the Greeley system without the need to involve the Commission's complaint process. However, because the Bureau has taken a hard line in enforcing the requirement that stations file Must-Carry Complaints within 60 days of a "specific event," rig, e.&., Complaint of Horizon Broadcasting Corporation against Horizon Cable I Limited Partnership, CSR-5025-M (Cable Serv. Bur., Oct. 21, 1997), and because TCI's response to Paxson's carriage request was neither timely given nor contained the full information required under section 76.61(a)(2) of the FCC's rules to justify a refusal to carry for failure of the station to deliver a good quality signal, out of an abundance of caution and to preserve the station's must-carry rights, Paxson has decided to include TCI's failure to provide carriage on the Greeley system as part of this complaint. If the Bureau agrees that the 60 day period in which to file a must-carry complaint should not run while Paxson and TCI work to resolve the signal delivery issue, Paxson would consent to a dismissal of this Petition with respect to TCI's Greeley system, subject to permission to re-file if, contrary to Paxson's expectations, the issue is not resolved in due course. °j at 4143. - 4 - issue an order requiring TCI to commence carriage of the signal of KUBD-TV on channel 59 of the cable systems serving the cable communities. Unfortunately we missed the January bill notification, therefore customers will be notified in their February bills. KUBD will be added to the Basic line-up March 1, located on A-2, channel 98. The Greeley system will not be transmitting KURD as the signal level does not meet FCC standards.
