The summary of the last regular meeting of the Weld County Planning Commission held on July 20, 1999, was approved as read. CASE NUMBER: USR-1217 APPLICANT: Faith Tabernacle Church PLANNER: Kim Ogle LEGAL DESCRIPTION: Lots 2 through 7, Block 1, of Peterson-Alexander Subdivision; being part of Section 16, T5N, R66W of the 6th P.M., Weld County, Colorado. REQUEST: Site Specific Development Plan and Special Review Permit for a Church in the R-1 zone district. LOCATION: North of and adjacent to US Hwy. 34 Bypass Frontage Road (28th Street) east of and adjacent to 71st Avenue(WCR 29). Kim Ogle, Department of Planning Services, presented Case USR-1217. The Department of Planning Services is recommending approval of this application along with the Conditions of Approval and Development Standards. Kim then read the recommendation into the record. Danny Perdew, applicant, said that he was the pastor of Faith Tabernacle. He addressed concerns that the surrounding property owner's had regarding the irrigation ditch. He explained that they would be able to provide adequate water to the surrounding property owners. Mr. Perdew added that they have hired a registered engineer to help design a grade and drainage plan. Fred Walker asked if Mr. Perdew had talked with the neighbors. Mr. Perdew stated that he has spoken to a few of the surrounding property owners to see if they had water rights to the ditch. The surrounding property owners then provided proof that they are to receive adequate water from this ditch. Kim clarified that the Boomerang Lateral Ditch comes up from the south and goes underneath the Highway 34 bypass and enters l:he corner of the property. From the right-of-way of the property to the south it extends up for about one hundred feet and is concrete lined, there after it is soil. Fred Walker asked Kim if the Boomerang Lateral Di^ch enters the property on the south west corner. Kim said that it did and pointed out on the map where the ditch lies. Michael Miller asked Mr. Perdew when he would have his engineered plans completed to determine what will l✓' n� �P 992068 l✓cf SUMMARY OF THE WELD COUNT PLANNING COMMISSION MEETING August 3, 1999 Page 2 be done with the ditch, Mr. Perdew stated that the engineer said that it would be completed in about three weeks. Stephan Mokray asked Mr. Perdew if he has provided plans as to where they will place the septic system. Mr. Perdew replied that they have found an alternative place to put the septic system. Stephan then asked if they had enough space for the septic system. Mr. Perdew said that they did have enough. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. David Uranno, surrounding property owner, addressed his concerns about having enough water for the neighbors and how septic system will affect flow of the ditch. Stephan Mokray asked Trevor if they considered the effects of the flow of the ditch when they approved Mr. Perdew's plans. Trevor stated that the plans will need to be approved through the Conditions of Approval. Fred Walker pointed out that Mr. Uranno's concerns are addressed through the Development Standards. Michael Miller asked Km if the hundred-foot setback requirement for the leach field comply with the site plan that has been submitted. Kim replied that it will be close, but possible for the leach field to comply with the 100-foot setback. Trevor stated that they will have to rework some of the envelopes shown on the maps based on the location of that ditch. Lee Morrison said they can also reach a variance on the location of the leach field. If the ditch will be piped then some of the issues will be different, but either way they will have to go through a variance. Trevor added that it has been the Board of Health's policy that they don't particularly like variances placed on new structures. Gary Wiederspon said that he had concerns with the septic and leach field. He also stated his concerns regarding the maintenance of the residential look and the landscaping. Cristie Nicklas verified with Trevor that the septic system that the applicants will use has to be designed by an engineer. Trevor said that the engineer design will have to comply with both the State and County regulations. Mike Miller asked Mr.Wiederspon if the septic system was an evaporative system or if it was a leach field with trenches. Mr.Wiederspon answered that when the house was built a septic system was originally used, but they will now put in a leach field. Kim stated that the Church has to meet several conditions that the City of Greeley has set forth. Suzanne Miller questioned the intensity of the Church and what type of activity would be taking place. Greg Thompson, City of Greeley, Clarified the storm water criteria and gave an overview of each. Conditions of Approval#3F, G, & I, deal with similar issues on the traffic analysis. Condition of Approval#31 requires a letter written to the City of Greeley in an attempt to address the City of Greeley's Concerns. Mr. Thompson said that he would like to add Condition of Approval#3O to read, "The applicant will demonstrate to the City of Greeley that the proposed structure is at least five hundred feet from all the oil and gas wells." He also indicated he would like Condition of Approval#3P added to require the applicant to submit a site plan to the City of Greeley. He concluded that he would like to add language to Condition of Approval#4 to indicate that this is a city of Greeley standard that the septic and water issues have been taken care of prior to granting any building permit. SUMMARY OF THE WELD COUNT PLANNING COMMISSION MEETING August 3, 1999 Page 3 Bryant asked Mr.Thompson why the City of Greeley didn't annex this proposal. Mr. Thompson explained that they would have to create a flag pole and the State had several issues. Mike asked Mr. Thompson if the development to north of this proposal were in the City limits. Mr. Thompson said that there are two developments out there, one to the west of 71st Street and one to the east side, and both are in the City of Greeley. Mike then asked if either of the two developments were going to bring in the sewer line. Mr. Thompson said that if a sewer line were to be brought in, it would be within a '/mile of the site. He added that the developers are ones who bring in a sewer line. Teresa Wiederspon spoke about her concerns with the irrigation ditch and their ditch rights. She said that according to Mr. Perdew, she was told that she needed a contract by the ditch company with Faith Tabernacle Church. Ms. Wiederspon also stated concerns with the two lane access into the property, noise and pollution. She felt that possible screening could help this situation. Danny Perdew addressed the several issues concerning his proposal. He stated that he has had a soils test done and they will have an adequate engineered designed septic system. They will make themselves responsible for the sepl:ic system to work properly. Mr. Perdew said that the ditch could be moved further to the north to meet the 100' setback. They will have three services per week that will last two hours. He concluded that he has a landscape plan and is willing to comply with any changes made to that. Mike addressed his concerns with the access off of Highway 34 and the impact that will cause. He asked Mr. Perdew is it would be a big inconvenience to have their main entrance on the west side and abandon the access off of 28th Street. Mr. Perdew replied that he is expecting the majority of the traffic to enter on the west side because that is where the parking is; however, the entrance off of 28th Street will be the front of the church. He added that at any given time there are only about fifty cars in the parking lot. Mike asked Mr. Perdew if they are building this church in hopes to expand their congregation. Mr. Perdew answered yes. Stephan asked if Mr. Perdew has had any quotes on he cost of septic system. Mr. Perdew said he had not, he just has what the engineer has quoted. Stephan then questioned the possibility of the City of Greeley annexing this property. Mr. Perdew replied that they had tried to do a flagpole annexation but the State would not sign off on that. Bryant asked if the ditch would be open or underground piped. Mr. Perdew answered that the engineer originally said they could go underground or open trench. He is willing to work with the surrounding property owners to do what will benefit everyone. The Chairman asked Mr. Perdew if he was in agreement with the Conditions of Approval and Development Standards. Mr. Perdew stated he was in agreement. Cristie Nicklas moved to add Condition of Approval#3o to read, "A detailed Landscaping plan identifying the number, size and species of landscaping buffering materials shall be submitted to the Department of Planning Services for review and approval. The plan shall also address maintenance of the landscape materials and potential replacement of dying materials, the approved plan shall be delineated on the plat map." Stephan Mokray seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Sheri said that the Department of Planning Services is recommending approval of the application along with the Conditions of Approval and Development Standards. Sheri then read the recommendation into the record. Bruce Johnson, representative of the applicant, and John Eichman, applicant, were both present and had no comments. Mike Miller asked what type of business Mr. Eichman runs. Mr. Eichman explained that he does residential construction work. There would be no hauling of any materials back and forth, and no business being conducted on the property. He said it would just be a place to park their vehicles for the construction business and the buildings will tie used as a shop. Mr. Eichman added that they will be leasing the onion shed back to the original owner. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Mike asked about Development Standard #19 and why it is being required. Sheri answered that this Development Standard was added by the Building Inspection Department. Bryant asked if the access onto the property was off of Highway 14 and if there were any concerns from Colorado Department of Transportation. Mr. Eichman replied that there are three entrances off of Highway 14, but they will only use two of those entrances. Sheri added that condition of Approval#2f, states that they will have to go through Colorado Department of Transportation to get approval. The Chairman asked Mr. Johnson if he was in agreement with the Conditions of Approval and Development Standards. Mr. Johnson stated he was in agreement with all of them except for Condition of Approval#2E1, because they will not nave an access ramp/loading dock. Sheri said that they can remove either it or the applicant can write a letter to the Department of Planning stating they will not have a ramp/dock. Dave Sprague, Lead Building Official, addressed Development Standard#19 and stated that the necessity to have the building designed by an engineer or architect would depend on the type of building they would be constructing. Roger Vigil, Building Inspector, stated on commercial Buildings it is a requirement to be designed by an engineer or an architect. Cristie asked if the office would be placed in an existing building or if there is a building that will be constructed. Mr. Johnson said that it would be an addition to the existing building. Mike asked if these concerns be addressed when the applicant applied for a building permit. Mr. Sprague said that was correct and added that it just depended on the type of building being constructed. Mike said that they are not building a big commercial building, they are only adding onto an existing structure for their office. He then asked if an architect needs to be hired to design the addition or if they can just imply the County Codes. Mr. Sprague said that if the building is fairly small then they would not require engineer or architect design. Mike moved to amend Development Standard#19 to read, "If deem necessary by the Weld County Building Inspection Department, the future office shall be designed by an architect or engineer licensed by the State of Colorado." LOCATION: From Ft. Saint Vrain to the Weld County Line south of and adjacent to Prospect Reservoir. Arlan asked to be excused for this case. Eric Jerman, Department of Planning Services, presented Case USR-1236. Eric gave a description as to where the transmission line would run and noted that condition of Approval #2b was added by the Weld County Health Department for air pollution. The Department of Planning Services is recommending approval of this application along with the Conditions of Approvals and Development Standards. Eric then read the recommendation into the record. Michael Diel, Representative of Public Service, explained that obtaining approval from Planning Commission is important because every aspect of our lives depend on electricity. They have conducted a study on the location of the line for :he best interest of Weld County Residents. Crisite Nicklas asked if money was not an issue, could the line be buried. Mr. Diel explained that there are several issues as to why they have decided against burying the line. There are right-of-way issues, easy access for technical faults, safety issues in digging and PUC regulates burying and does not always allow. John Folsum asked when Ft. St.Vrain as a nuclear plant was built was there a line built at that time to connect it to the grid or was Ft. St. Vrain considered a gas fueled generator. Mr. Diel replied that the initial phase of Ft. St.Vrain as a nuclear plant had one generator, but it was planned for more. There is one trench line that connects the Fort with a substation near Ft. Lupton and then through Lochbuie through the outer valve line. That line was capable of handling the capacity that the Fort gave out, which was minimal. Once the Fort was decommissioned, they converted to natural gas. He added that they currently have two lines generated but they will be adding a third. Fred asked most of the Fort line was on an old right-of-way. Mr. Diel said that the section coming east out of the Fort is within a 300-foot right-of-way and a portion of Weld County Road 31 is within a 250-foot right-of- way, which will require additional right-of-way. Fred asked if the proposed route will interfere with a mechanical irrigation system. Mr. Diel answered that there are several on the route, and they will find a strategy to work around each of them. Mr. Diel said that it would not interfere with the circular pattern of the mechanical irrigation system. John asked Mr. Diel to address the surrounding property owner's concerns for health hazards relating to high voltage transmission lines. Mr. Diel explained that they have done several studies on the magnetic fields and the results prove that they do not pose a public health threat. SUMMARY OF THE WELD COUNT PLANNING COMMISSION MEETING August 3, 1999 Page 7 John Folsum also asked Mr. Diel about the visual impacts the lines will cause. Mr. Diel stated that they have different structure types depending on area. They will work with the surrounding property owners as to which design will best fit their area. Craig Taggert, Representative of Public Service, identified each component they used in determining the route of the lines: • Determined the need for this process • Studied more than 550 square miles • Developed a set of criteria - • residential property • avoidance of homes • land use • environment visual conflicts • agricultural • Existing and future land use sources • Obtained preliminary routes -trying to avoid homes • Held three nights of open house- • advertised by newspaper and a newsletter was sent out to the land owners within a '/2 mile • approximately 71 people attended each night • Once the route was established individual land owners were contacted The Chairman asked if there was anyone in the audience who wished to speak for or against this application. Alvin Dechant, surrounding property owner, had concerns regarding the lines. He asked why Public Service doesn't update the existing line. What the difference is with an easement and a right-of-way easement. Lee Morrison stated that there are differences in the types of interest you can acquire in land. Generally a right-of-way has more rights than an easement. Typically the language will mix concepts together. Brian Perry, surrounding property owner, submitted a copy of his letter and summarized it into the record. He has read the Comprehensive plan and does not feel this fits in with the agricultural aspects. This will increase the cost in developing the land. Weld County Road 55 will be visually affected by this line. He said that there are other routes that are more reasonable in which the creation of additional rights-of-ways can be eliminated. Steve Snow, surrounding property owner, explained that he is building a new home and Public Service is placing the lines which will obstruct his view. He said that his main concern is that the lines are over his children's bus stop. What about the magnetic field they will endure day after day. He also stated concerns regarding that Public Service can change the lines at any time. Fred asked where the ridge is on Weld County Road 55. Mr. Snow said that if Weld county Road 56 existed then that would be the highest point of the Ridge; However, if Weld County Road 57 existed that it would be better because it is in a valley. Fred asked Mr. Snow if he had asked Mr. Diel about the magnetic field at the bus stop. Mr. Snow replied no because he was two hundred feet away. He said that Mr. Diel did bring out a packet of their scientific study. In that packet he read that there is a significant amount of magnetic field within 80 feet of these power lines. He added that the Keenesburg elementary school bus cannot come down Weld County Road 14 because the road is not maintained properly and is a one lane road. Mike asked if the quality of the road is what kept the bus from coming down Weld County Road 14. Mr. Snow said that it is the quality of the road and they are the only residents on that road. Cristie asked Don Carroll what the status is on Weld County Road 14. Don Carroll, Public Works, said that SUMMARY OF THE WELD COUNT PLANNING COMMISSION MEETING August 3, 1999 Page 8 Weld County Road 14 is designated as the section line access road. Weld County does not maintain section line roads, they provide access to land locked parcels and are privately maintained. Bob Fritzler, surrounding property owner, expressed concerns with notification on the open house meetings. He asked if Public Service has shown that the proposed routes are maxed out. He concluded that Public Service does not provide service to Keenesburg but that he wants the line. Dianne Pastelak Becker, surrounding property owner, would like to a build a home and will need electricity. Weld County does a good job to utilize their natural resources. She concluded that as people move to the area, we need to keep up with the resources and protect the land. Jim Brnak, surrounding property owner, explained that he farms approximately four miles on Weld County Road 55. His concern is that no one will want to buy a home under a power line. He added that Planning Commission needs to look at the comprehensive plan that addresses the power lines. Fred asked Mr. Brnak if the power lines were taken off of Weld County Road 55 would alleviate issues with Recorded exemptions on corner lots. Mr. Brnak said that it would be better for him. He added that he understands the importance of power lines and knows that we need them. Ray Guest, surrounding property owner, said that he is not on the proposed route but lives in the valley. Five years ago a high tension line was approved on Weld County Road 47 '/ and Weld County Road 49. He wonders why these lines have to be placed above ground as an eye sore when they can be placed underground. Ralph Gassman, surrcunding property owner, said that these power lines will decrease the value of his property. He feels that Public Service should use an alternative route for the power lines. Evelyn Yurk, surrounding property owner, explained that she owns 80 acres off of Weld County Road 55. She Sold 5 acres to Steve Snow in June 1999. If she had known that the power lines were to be placed on that road, she would not have sold them to Mr. Snow. Her property is adjacent to both Weld County Road 55 and Weld County Road 14, which is directly under the proposed power line. She would recommend that if they cannot place the lines underground, then they choose an alternative route. Mr. Diel responded to several of the surrounding property owner's concerns. There are population density issues on alternative mutes. They can't up grade existing power lines because of the down time that is involved. There is no place to transfer the power to while they repair the existing lines. Public service is willing to work with the public on future changes regarding the line. He said that the Line will be built to the 345 kV standards. The average land values at$1000.00 per acre based on the market data; however, every parcel will have its own unique value. He commented that Public Service is aware of the existing homes next to the right-of-way. The power lines will not decrease the land value but reduce the market. The easement will not give Public Service the right to do anything they wish. In regards to destroying the natural setting, the lines will obstruct the view, but there are power lines everywhere. He stated that there is a higher magnetic field from a microwave oven. It would be like standing next to a refrigerator. House hold appliances have larger magnetic fields than the power lines. Also, if the lines are placed underground, the magnetic fields will be greater because they will be buried six feet under instead of 30 feet above the ground. Public Service feels that they have gave adequate public notice. The public will have the same issues no matter where the line is located. He stated that they did research the area east of Keenesburg, but the population increases in area east of Keenesburg. The Town of Keenesburg is powered by United Power who purchases their power from Public Service. Electricity is necessary do to the greater public need for it. He said that the Comprehensive Plan does not mention power lines and that Public Service would be willing to work with Weld County. He concluded that if the lines are routed down the'''Asection, it will help some people but will move the line closer to others. Therefore, it will not change the impact on the public. Mike Miller clarified that in the future there is not a need to expand the lines beyond the 345 kV capacity. Mr. Diel said it is the wave capacity of the towers and it will give them more than enough capacity that they will need. Mike said that he realizes the need for the power lines but questioned the possibility of expanding the lines as the County grows. Mr. Diel said that the intention of Public Service is to build these lines big enough for future expansion. Johns Folsum asked if the original alternative line study included the transmission line that went east of Ft. Lupton. Mr. Diel replied that before they decided to add the new line, they studied the possibility of using the existing lines. The existing lines could not be expanded due to density of the development. Fred Walker stated his concerns about the people along Weld County Road 55. He asked why the line is on the half section and then jumps to Weld County Road 55.
