Dear Ms. Dunn:
We have reviewed the above referenced proposal for a sand and gravel mining operation
on a parcel of about 6.5 acres. The applicant plans to proceed with the mining in four phases, A,
B, C, and D. The reclamation plan for the property is to create a pond for use as a amenity for
residential lots. There will be a maximum of 10 employees. No information was provided on the
amount of water that may be required during the mining operation nor to replace evaporative
depletions from the pond at the end of mining.
The applicant's consultant is in the process of generating a substitute supply plan for
submittal to the State Engineer for approval. We have no objection to the mining operation as long
as no groundwater will be exposed before the substitute supply plan is approved by the State
Engineer, and the required well permit is obtained.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. An Air Pollution Emission Notice (A.P.E.N. ) and Emissions Permit
application must be submitted to the Air Pollution Control Division,
Colorado Department of Health.
3. No permanent disposal of wastes shall be permitted at this site.
4. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
5. Fugitive dust shall be controlled on this site.
6. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
7. An individual sewage disposal system, is required for the proposed
facility and shall be installed according to the Weld County Individual
Sewage Disposal Regulations. A vault system will be acceptable.
8. A NPDES Permit shall be obtained from the Water Quality Control Division
of the Colorado Department of Health for any proposed discharge into State
Waterways.

9. A dust abatement plan shall be submitted to the health department for
approval prior to operation. The facility shall have sufficient equipment
available to implement the dust control as required by the health
department.
10. If applicable, a stormwater discharge permit shall be obtained from the
Colorado Department of Health, Water Quality Control Division.

On September 6, 1995, I visited the site and have the following comments:
This will be a small mining operation set up in four phases over an eight year period. The
approximate size of the facility will be 6.6 acres more or less.
The primary haul route will be south on WCR 23, which is a gravel road approximately one-half
mile to the intersection of WCR 32.5. From that point either west on the pavement to State Hwy 66
or east staying on the pavement to US Hwy 85. The applicant needs to enter into a road
maintenance agreement with Weld County on providing adequate dust control in front of the
residence on WCR 23 to minimize complaints. Also, any excessive hauling causing soft spots,
rutting, and loss of gravel on the haul route needs to be addressed in the agreement.
On WCR 32.5, Bridge 32.5/23A is a restricted bridge rated 17-27-28. Do not route your trucks over
this bridge if they exceed the weight limit. Legal loads may be routed in the westerly directly to
State Hwy 66, if needed.

Dear Gloria,
The Division of Wildlife received the referral from your department
concerning a Special Review Permit for a wet pit sand and gravel
operation in an Agricultural District. The application was
reviewed by Division personnel and an inspection was made of the
site. Our comments are included in this letter.
The site has been used as a storage area for old farm equipment.
The soils are gravelly, and of poor quality. There is a shallow
depression on site with a sparse stand of cottonwood and willow
species. In essence the site, as it now stands is of relatively
low value for wildlife. Mining activity will, therefore, have
little impact on wildlife.
On completion of mining the site will be reclaimed to include a
pond of several acres in size. If the reclamation process creates
a pond with shallow ( 3 : 1 slope or less) , irregularly shaped
shoreline, island/s, irregular bottom contours and shallow loafing
areas, this site should have enhanced wildlife values over what
exists now. Habitat biologists from the Division would be anxious
to work with the Odenbaughs to create a reclamation plan that will
maximize this site for wildlife and recreation.
In summary, the Division finds no conflict with this plan. We will
be available to assist your agency or the operators as needed in
providing ideas that will benifit wildlife on this site. Thank you
for allowing us to review this document. We look forward to
working with you in the future.

Reference is made to the Stanley L. Odenbaugh Gravel Pit located in the
Southwest '4 of Section 12, Township 3 North, Range 67 West, Weld County, Colorado.
The project has been reviewed in accordance with Section 404 of the Clean Water
Act under which the U.S. Army Corps of Engineers regulates the excavation and
discharge of dredged and fill material into waters of the United States including wetlands.
This letter is to inform you that the proposed activity, assigned number
199580842, will not require a Department of the Army (DA) Permit.
Although a DA Permit will not be required for the project, this does not eliminate
the requirement that other applicable federal, state, tribal, and local permits be obtained
as required.
