Home My WebLink About992663.tiff RESOLUTION RE: APPROVE AGREEMENT FOR SUBSTANCE ABUSE ASSESSMENT, EDUCATION AND/OR THERAPY SERVICES AND AUTHORIZE CHAIR TO SIGN - ARC COUNSELING CENTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Substance Abuse Assessment, Education and/or Therapy Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the 19th Judicial District Attorney's Office, and the ARC Counseling Center, with terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Substance Abuse Assessment, Education and/or Therapy Services between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the 19th Judicial District Attorney's Office, and the ARC Counseling Center be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. J. eile yAttorney Z jt ;" 'c , Glenn Vaad 992663 Fr; IA DA0014 AGREEMENT FOR SUBSTANCE ABUSE ASSESSMENT,EDUCATION AND/OR THERAPY SERVICES THIS AGREEMENT is made this 3'4 day of kkortnber- , 1999, by and between the County of Weld, a political subdivision of the State of Colorado, by and through the on behalf of the District Attorney for the 19th Judicial District("DA"), whose address is 915 10th Street, Greeley, Colorado 80631, and the ARC Counseling Center, Greeley ("ARC"), whose business address is 1122 9th Street, Suite 102, Greeley, Colorado, 80631. WITNESSETH: WHEREAS, the DA needs alternative treatment providers to which it may refer substance abusing adolescents for substance abuse assessment, education, and/or therapy services, and WHEREAS, ARC is able and willing to accept such referrals and to provide such services and intends to do so in accordance with the terms and conditions set forth in this Agreement. NOW, THEREFORE, in consideration of the premises and mutual promises herein contained, the sufficiency of which is hereby acknowledged, DA and ARC hereby agree as follows: 1. TERM: This Agreement will be effective upon signature hereunder, shall continue for a term of one year after signature, and shall continue automatically for successive one year terms thereafter, until and unless it is sooner terminated by either party pursuant to the termination provisions set forth in paragraph 4., below(such termination may take place even during the first year). 2. DUTIES OF ARC: For an unlimited number of adolescents referred to ARC by DA, ARC shall provide substance abuse assessment, education and/or therapy services, pursuant to the following terms and conditions: a. ARC will be open to receive DA adolescent referrals during regular office hours, which shall include the following: Monday, Tuesday 10 am to 8 pm, subject to change depending upon hours on Saturday. Wednesday, Thursday 10 am to 9 pm. Friday 11 am to 7 pm. Page 1 of 5 Pages 992663 Saturday Tentatively set as 9 am to 3 pm. Sunday Closed. b. ARC shall provide testing of referred adolescents upon initial appointment. Such test::ng shall include an ARC questionnaire on drug/alcohol use and a substance abuse inventory. Information obtained through the testing shall be discussed by the ARC counselor and the adolescent. c. Upon arrival at ARC by a referred adolescent, ARC staff will adhere to the following procedure: i. Provide the referred adolescent with testing material. ii. After the referred adolescent completes paperwork, schedule the referred adolescent for an assessment appointment. iii. Assess the referred adolescent and conduct the intake session. d. ARC shall submit, at the end of each calendar month, an invoice to DA itemizing the number, type, and cost of intervention for each referred adolescent. Type Cost Assessment (one time cost -- includes $75 meeting with counselor and second appointment). Individual Session (cost for each 50-minute session $40 attended by referred adolescent). Group Session (cost for each group session attended $25 by referred adolescent). e. Only the ARC professional staff listed below shall conduct counseling, or individual or group sessions pursuant to this Agreement: i. Steve Quackenbush: ED. S. in counseling (50 hours past masters degree). Also, CAC III and Domestic Violence Certified Counselor. ii. Scott Campbell: LPC (licensed professional counselor in Colorado) and masters degree in counseling field. Mr. Campbell is currently applying for a doctorate degree in counseling at the University of Northern Colorado. Page 2 of 5 Pages iii. Stacey Blank: certified as Substance Abuse Counselor. Holds masters degree in Counseling Psychology. Meets ADAD educational requirement. Holds LCPC FROM Illinois and will apply for reciprocity as LPC in Colorado. f. ARC shall keep sufficient professional and premises liability insurance. ARC agrees to indemnify and hold harmless DA, including the County of Weld, the Board of County Commissioners of the County of Weld, the District Attorney for the 19' Judicial District, their employees and officers, from any liability and/or damages arising out of or caused by the negligence or intentional acts of ARC staff members while performing the duties of ARC pursuant to this Agreement. 3. DUTIES OF DA: DA shall have the following duties pursuant to this Agreement: a. DA shall submit payment for services no later than 30 days from receipt of invoice from ARC. All such payments shall be sent to ARC at the address listed above. b. DA shall provide to ARC any urine test results of referred adolescents which DA has in its possession, only upon receipt by DA of written releases for such information. c. DA shall be under no obligation to refer to ARC any particular adolescents or any specific number of adolescents. d. DA does not, through any referral made to ARC, warrant or guarantee on behalf of any referred adolescent any specific results arising from or connected to the counseling or individual or group sessions. 4. TERMINATION: Either party may terminate this Agreement anytime after the date of signing, with or without cause, effective thirty (30) days after receipt of notice from the other party. A notice of termination shall be provided to the other party by first class mail,postage prepaid, to the respective address indicated above. 5. MODIFICATION OF AGREEMENT: All modifications to this Agreement shall be in writing and signed by both parties. 6. ENTIRE AGREEMENT/NO THIRD PARTY BENEFICIARY: This Agreement contains the entire Agreement and understanding between the parties to this Agreement and supersedes any other Agreements concerning the subject matter of this transaction, whether oral or written. It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties, and nothing contained Page 3 of 5 Pages in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Agreement shall be deemed an incidental beneficiary only. 7. ASSIGNMENT: Neither this Agreement nor the rights or obligations hereunder shall be assignable without the prior written consent of both parties. 8. CONTROLLING LAW: This Agreement shall be construed and enforced in accordance with the laws of the State of Colorado. 9. NO WAIVER OF IMMUNITY: No portion of this Agreement shall be deemed to constitute a waiver of any immunities the parties of their officers or employees may posses, nor shall any portion of this Agreement be deemed to have created a duty of care that did not previously exists with respect to any person not a party to this Agreement. 10. INDEPENDENT CONTRACTOR: ARC shall perform the services hereunder as an independent: contractor. Neither ARC, nor any agent or employee of ARC, shall be deemed an agent or employee of the DA. 11. SEVERABILITY: If any provision of this Agreement should be held to be invalid, illegal, or unenforceable for any reason, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.
