RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Jack Epple that the following resolution be introduced for passage by the Weld County Planning
Commission. Be it resolved by the Weld County Planning Commission that the application for.

REQUEST: A Site Specific Development Plan and Use by Special Review Permit for a Recreational
Facili':y and uses including a Golf Course (NCU-272)
LEGAL DESCRIPTION: N2 of Section 30, T7N, R65W of the 6th P.M., Weld County, Colorado
LOCATION: West of and adjacent to Weld County Road 39, South of Weld County Road 78
be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 24.7 of the
Weld County Zoning Ordinance, as amended.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section
24.3 of the W=_Id County Zoning Ordinance, as amended, as follows:
a. Section 24.3.1.1 --This proposal is consistent with the Weld County Comprehensive Plan.
The site is located within the town of Eaton's Urban Growth Boundary Area as defined in the
Weld County Comprehensive Plan. UGB.Goal 2 in the Weld County Comprehensive Plan
states"...concentrate urban development in or adjacent to existing municipalities and maintain
urbar growth boundary areas that provide an official designation between future urban and
non-urban uses." UGB Goal 4 states"whenever possible, open space within a development
shou'd be connected to existing open space. This would create a system in which visual
qualities can be maintained." A.Goal 3 discourages urban scale residential, commercial and
industrial development that is not located adjacent to existing incorporated municipalities.
P.Goal 2 requires adequate facilities and services to assure the health safety and general
welfare of the present and future residents of Weld County.
b. Section 24.3.1.2--That the proposal is consistent with the intent of the A(Agricultural)district.
Recreational facilities including golf courses, their Clubhouse facilities and support buildings
are a;lowed in the Agriculture zone district upon approval of a Special use permit, per Section
31.4.3..
c. Section 24.3.1.3 --This proposal is consistent with 24.3.1.3 of the Weld County Zoning
Ordinance, as amended and will be compatible with the existing surrounding land uses.
Surrounding properties include residential development, agricultural lands and the Eaton golf
course.

d. Section 24.3.1.4 --The proposed uses will be compatible with future development of the
surrounding area as permitted by the A (Agriculture) zone district, and with the future
development as projected by the Comprehensive Plan or Master Plan of the affected
municipality. As previously stated, the proposed plan lies within the Town of Eaton's Urban
Growth Boundary Area as defined in the Weld County Comprehensive Plan. The Town of
Eaton has reviewed this request and has indicated that the use at this site is acceptable per
their Comprehensive planning Policy.
e. Section 24.3.1.5 --The site is not located within any Overlay District Area as identified by
maps officially adopted by Weld County.
f. Section 24.3.1.6 --The applicant has demonstrated a diligent effort to conserve prime
agricultural land in the locational decision for the proposed Clubhouse addition. The site is
not presently farmed, thus the proposal will not remove farm ground from production. The
current Clubhouse and golf course has been in operation at this location since 1968. This
application is limited to a 3000 square foot expansion to the existing Clubhouse that will be
covered under this Use by Special Review thus, eliminating the existing non-conforming use
status for the property.
g. Section 24.3.1.7-The Design Standards(Section 24.5 of the Weld County Zoning Ordinance,
as amended), Operation Standards(Section 24.6 of the Weld County Zoning Ordinance, as
amended), Conditions of Approval, and Development Standards ensure that there are
adequate provisions for the protection of the health, safety and welfare of the inhabitants of
the Town of Eaton and the County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review Permit shall be adopted and placed on
the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the
Department o'Planning Services and be ready for recording in the Weld County Clerk and Recorder's
Office within 30 days of approval by the Board of County Commissioners. (Dept. of Planning

2. Prior to recording the plat:
A. A detailed landscaping plan identifying the number, size and species of plant
material for the new planters, shall be submitted to the Department of Planning
Services for review and approval. The plan shall also address maintenance of the
landscaping materials and potential replacement of dying materials. The approved
plan shall be delineated on the plat map. (Department of Planning Services)
B. The applicant shall provide adequate toilet facilities (port-a-pottie) during the
construction of the facility. (Health Dept.)
C. WCR 39 is designated on the Weld County Transportation Plan Map as a
local paved road. There is presently 60 feet of right-of-way. 30 feet from
centerline of WCR 39 shall be delineated on the plat. This road is maintained
by Weld County. (Public Works)

3. Early release of building and electrical permits were issued on the property to the applicant prior to
the release of and approval for the Special Review Permit. The applicant is aware of the risk involved
in this action. Upon approval, the Special Review plat shall be recorded in the office of the Weld
County Clerk and Recorder. (Department of Planning Services)

SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS
Eaton Country Club
USR-1241
1. The Site Specific Development Plan and Special Use Permit is for a Recreational Facility and uses
including a Gclf Course(NCU-272) in the A(Agricultural)zone district, as indicated in the application
materials on file in the Department of Planning Services and subject to the Development Standards
stated hereon. (Planning)
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County
Zoning Ordinance, as amended. (Planning)
3. No permanent disposal of wastes shall be permitted at this site. (Health Department)
4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-
101, C.R.S., as amended) shall be stored and removed for final disposal in a manner hat protects
against surface and groundwater contamination. (Health Department)
5. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance conditions. (Health Department)
6. The applicant shall provide adequate toilet facilities for the public and employees. (Health
Department)
7. The maximum permissible noise level shall not exceed the commercial limit of 60 dB(A), as measured
according to 25-12-102, Colorado Revised Statutes. (Health Department)
8. The facility siall utilize the existing municipal sewage treatment system. (Eaton Sewer) (Health

9. The facility :,hall utilize the existing public water supply. (North Weld Water District) (Health
Department)
10. The applicant shall comply with Colorado Retail Food Establishment Rules and Regulations
governing the regulation of food service establishments. (Health Department)
11. The applicant shall comply with the Town of Eaton Fire District requirements. (Eaton Fire
District)
12. The landscaping on site shall be maintained in accordance with the approved landscaping plan.

13. There shall be no staging or parking along WCR 39. All parking, loading and off-loading shall be on-
site in the paved parking areas. (Public Works)
14. All construction on the property shall be in accordance with the Weld County Building Code
Ordinance. (Planning)
15. Any signage located on the property shall require building permits and adhere to Section 42.2.3.0
of the Weld County Zoning Ordinance, as amended. (Planning)
16. The site shall maintain compliance at all times with the requirements of the Weld County Department
of Public Works, Weld County Public Health and Environment and the Weld County Department of
Planning Services.
17. The property owner or operator shall be responsible for complying with the Design Standards of
Section 24.5 of the Weld County Zoning Ordinance, as amended.
18. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 24.6 of the Weld County Zoning Ordinance, as amended.
19. Personnel frorn the Weld County Health Department and Weld County Planning Department shall be
granted access onto the property at any reasonable time in order to ensure the activities carried out
on the property comply with the Development Standards stated herein and all applicable Weld County
Regulations.
20. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission before such changes from the plans or Development
Standards are permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
21. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards may be
reason for revocation of the Permit by the Board of County Commissioners.

Kim Ogle, Department of Planning, presented Case USR-1241. Kim read the recommendation into the
record, and stated that the Department is recommending approval of the application, along with the Conditions
of Approval and Development Standards.
Don Chadwick, representative of the application, said there has been no controversy, and that the clubhouse
and golf course have been there prior to zoning, and now that they are expanding the clubhouse, they need
a variance.
Fred Walker asked what exactly the permit covers. Kim said that it covers the entire 125-acre parcel, and
although they are asking for the 3000-foot expansion, they are including the clubhouse and golf course in the
permit.
Sheble McConnellogue, Health Department, asked Mr. Chadwick about the service shop and shed, and if they
will be changing oil and working on vehicles. Mr. Chadwick said that it is a maintenance shed that is on the
other side of the golf course, and that there will be no change in the use.
The Chair asked if there was anyone in the audience who wished to speak for or against this application.
Jack Epple moved that Case USR-1241, be forwarded to the Board of County Commissioners along with the
Conditions of Approval and Development Standards with the Planning Commissions recommendation of
approval. Stephan Mokray seconded the motion.
The Chair asked the secretary to poll the members of the Planning Commission for their decision. John
Folsom, yes; Arlan Marrs, yes; Stephan Mokray, yes; Michael Miller, excused; Jack Epple, yes; Bryant
Gimlin, excused; Bruce Fitzgerald,yes; Cristie Nicklas, yes; Fred Walker,yes. Motion carried unanimously.
