RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST CHARLES AND RENEE OTTINGER FOR VIOLATION OF
THE WELD COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
•
WHEREAS, Charles and Renee Ottinger, VI #9800063, are allegedly in violation of the
Weld County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of January, 1999, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Charles Ottinger, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until January 19, 1999, to allow adequate time for a building permit to
be obtained, allowing for additional time for the property owners to bring the subject property
into compliance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Charles and Renee Ottinger to remedy the violation of
the Weld County Building Code Ordinance, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties, with an instruction for delay of action upon such referral until January 19,
1999, to allow adequate time for a building permit to be obtained, allowing for additional time for
the property owners to bring the subject property into compliance.

February 27, 1995 Building permit issued for a "move-in" house on a partially finished basement, attached
garage, and remodel on the structure.
April 11, 1996 Inspections called for and conducted through the issuance of a temporary certificate of
occupancy dated January 29, 1997.
April 15, 1998 Thirty day letter sent to Mr. and Mrs. Ottinger by Jeff Reif, Combination Inspector
requesting that they obtain approvals on final electric, final plumbing,final heating and
final building.
September 29, 1998 Letter sent to Mr. and Mrs. Ottinger by Sharyn Frazer, Code Compliance Officer
scheduling them to appear before the Board of County Commissioners on October 13,
1998, at 10:00 a.m.
October 13, 1998 Board of County Commissioners Violation Hearings. It was determined that not
enough contact by the Weld County Building Inspection Department had been
attempted. This case was continued until November 10, 1998. Resolution submitted
to the case file.
October 27, 1998 Telephone call from Dave Sprague, Building Official, to Mr. Ottinger. Recording
answered and stated that the telephone number had been disconnected.
October 29, 1998 Letter from Jeff Reif to Mr. Ottinger delivered to the property and left on the front door.
No one was at home.
November 2, 1998 Memo from Dave Sprague to the Board of County Commissioners. The memo stated
that the telephone number listed on the building permit had been disconnected. He
called directory assistance and was told that the new number is nonpublished. He also
stated that this would be the only violation case presented at the November 10, 1998,
violation hearings,and would the Board like to continue it until the December 8, 1998,
hearing. The Board of County Commissioners responded unanimously to postpone
until December 8, 1998.
November 24, 1998 Field inspection conducted by Jeff Reif. Left a note on the door for the property owner
to call the Building Inspection Department. Pictures were taken with the digital
camera.

December 8, 1998 Telephone call from Mr. Ottinger stating that he had been out of town. He agreed to
set up the final inspections and have all of the corrections inspected before January 1,
- 1999. Facsimile from Mr. Ottinger to Jeff Reif, Inspector, stating that he will attempt
to achieve final inspections within 30 days and will call for inspections on the items
completed.
December 8, 1998 The Department of Planning Services staff requested an extension until the January 12,
1999, hearing to allow additional time to work with Mr. Ottinger to achieve
compliance.
December 30, 1998 Letter from Dave Sprague, Building Official, to Mr. and Mrs. Ottinger scheduling them
to appear before the Board of County Commissioners at the violation hearings on
January 12, 1999, at 10:00 a.m.
January 5, 1999 Telephone call to Mr. Ottinger by Jeff Reif, Combination Inspector. A voice mail
message was left reiterating the violation hearings scheduled for January 12, 1999, at
10:00'a.m.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

a.m. to consider the violation occurring on the property. This meeting will take place in the County
Commissioners' Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley,
Colorado. It is recommended that you or a representative be in attendance to answer any questions
the Board of County Commissioners might have about the violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation. Our
records indicate that you were made aware of the nature of the violation, the action necessary to

At the recent violation hearing, October 10, 1998, the Board decided to continue this violation
until the next hearing, November 10, 1998. In the meantime, efforts were to be made to contact
Mr. and Mrs. Ottinger.
Since the hearing, Jeff Reif has called the phone number listed on the building permit, which
has been disconnected. I called directory assistance only to find that the current number is
not published. Jeff wrote a letter outlining the remaining items needed to complete the permit
and obtain a certificate of occupancy. The letter was left on the property in the front door of the
home.
This is the only violation that we intended to take to the violation hearings this month. Would
the Board like us to wait until next month to see if the Ottingers respond, or would you prefer
that we go ahead with the hearing as planned?

Dear Mr. Ottinger:
The property for which this Building Permit was issued remains in violation of the Weld County
Building Code. The final approval has not been called for or completed. A Temporary Certificate of
Occupancy was issued on January 29, 1997 which expired on April 29, 1997. At that time, the
following corrections were noted and need to be reinspected:
1. Fire block stair stringers
2. Maintain 1" clearance to combustibles at boiler vent
3. Install exterior brick-cover or paint all exterior wood
4. Need handrails for stairs
5. Finish deck
6. Pour garage slab
7. Finish room over and east of garage
8. Need 5/8" type X firecode sheetrock in garage
9. Need plumbing and insulation forms filled out and signed
10. Need front outside light installed
11. Need front receptacle installed
12. Need switches at front door installed
