RE: APPROVE ACCEPTANCE OF DEED OF DEDICATION AND AUTHORIZE CHAIR TO
SIGN - ELTON AND PATRICIA MOSKALSKI
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authoril:y of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Acceptance of a Deed of Dedication
among the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, Elton and Patricia Moskalski, and Mary Baiamonte, with terms
and conditions being as stated in said deed on the following described real estate, to-wit:
That portion of the E% of the NE% of Section 25,
Township 8 North, Range 67 West of the 6th P.M.,
Weld County, Colorado, being more particularly
described in Exhibit A, attached hereto and
incorporated herein by reference
WHEREAS, after review, the Board deems it advisable to accept said deed, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Acceptance of a Deed of Dedication between the County of
Weld, State of Colcrado, by and through the Board of County Commissioners of Weld County,
and Elton and Patricia Moskalski be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said acceptance.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 15th day of March, A.D., 1999.

DEED OF DEDICATION
KNOW ALL MEN BY THESE PRESENTS that Elton A.Moskalski and Patricia B.
Moskalski, of 1269 49th Avenue Court,Greeley, CO 80634, and Mary K. Baiamonte, 41818 WCR
25, Ault, CO 80610 being the owners, collectively, of all of the following described property in
Weld County, Colorado, to-wit: a strip of land sixty feet (60') in width lying thirty feet(30") on
either side of a line described in Exhibit"A", attached hereto and incorporated by this reference,
do hereby dedicate forever said property as a public highway, pursuant to Colorado Revised
Statute
43-2-201(1)(a), free and clear of all liens and encumbrances and warrant title to the same.

That portion of the East Half of the Northeast Quarter of Section 25,Township 8 North, Range 67 West of
the 6 P.M.,County of Weld, State of Colorado being more particularly described as follows:
Considering the North line of the Northeast Quarter of said Section 25 as bearing South 89°50'54" East and
with all bearings contained herein relative thereto:
Beginning at the Northeast Corner of the Northeast Quarter of said Section 25;thence along the North line
of said Northeast Quarter South 89°50'54" East 382.16 feet to the TRUE POINT OF BEGINNING of the
centerline of a sixty(60)foot road right of way, being 30 feet on either side of and parallel to the following
described centerline; thence departing said North line and along said centerline the following six (6)
courses and distances: South 01°59'17" East 1116.58 feet; South 05°23'26" East 93.60 feet; South
02°03'41" East 55:5.86 feet to the beginning of a tangent curve being concave to the Northeast, having a
central angle of 20°52'00" and radius of 1000.00 feet, the long chord of which bears South 12°29'41"
East 362.18 feet; thence Southeasterly along the arc of said curve 364.19 feet; thence tangent from said
curve South 22°5:5'41" East 148.80 feet to the beginning of a tangent curve being concave to the
Southwest,having a central angle of 21°05'09" and a radius of 1000.00 feet, the long chord of which bears
South 10°23'07" East 434.34 feet; thence Southeasterly along the arc of said curve 437.83 feet, more or
less, to the Southeast Corner of the Northeast Quarter of Section 25 and the terminus of the above described
centerline.
Said above described Right of Way contains 3.68 Acres, more or less, and is subject to all existing
easements and/or n ghts of way of record

EXHIBIT "A"
ACCEPTANCE
The County of Weld, a body corporate and politic of the State of Colorado, by and through
its Board of County Commissioners, hereby accepts the above dedication of property as a public
highway pursuant to Colorado Revised Statute 43-2-201(1)(a). This acceptance shall not
constitute acceptance for maintenance by the County unless and until the road is improved to
County standards and accepted for maintenance by separate action of the Board of County
Commissioners.
