Dear Shani: Pursuant to our telephone conversation earlier this week this letter is intended to address Bataa Oil, Inc.'s concern and interest with the referenced request for a permit for mining operations. Enclosed are two Oil and Gas Leases covering the property, one dated May 30, 1991 between David D. Dersham and Bataa Oil, Inc. and the other dated May 31, 1991 between Bernice Larson and Bataa Oil, Inc. Under the Oil and Gas Leases, Bataa has the right to explore for, drill and produce oil and gas along with all rights and easements necessary for conducting operations. Within the last year Bataa has drilled three wells in the Northeast Quarter of Section 36 that have proven to be very productive wells. Our plans are to continue drilling one well at a time within the geological trend that seems to be running in a southeasterly direction. Our fourth quarter drilling plans include two additional wells scheduled to be drilled in this area, however, only one of them falls within the subject property. Enclosed is a survey plat for this well site location along with two plats indicating location of the tank battery facility, flowline and access road. Bataa will require approximately three acres for its drilling and completion operations that are tentatively scheduled for November. To maintain operations on the well, Bataa will need seventy-five feet surrounding the well with ingress and egress. The desired road width to service the well and tank battery facility is forty feet. We have proposed a location for the tank battery facility which will encompass an area of approximately 100 feet by 150 feet. A fifty foot wide strip will be used to construct the flowline from the well to the tank battery facility. After the line is constructed the easement can be reduced to twenty five feet. Section 36, T1N-R67W Section 31, TIN-R66W Dear Shani: My letter of October 1, 1997 concerning the referenced property stated that Bataa would like a width of forty feet reserved for access roads for maintaining its oil and gas operations. Jeff Gregg of Hall -Irwin Construction Company has requested Bataa reduce its road width to thirty feet. Bataa has agreed to this request, however, we will require a sufficient turning radius to accommodate service rigs to the well site and tanker trucks to the tank battery facility. The road should be constructed so that it will sustain a load weight of one hundred thousand pounds as may be required for workover operations. Should you have any questions please give me a call.
